MINUTES OF CITY PLANNING COMMISSION MEETING
is The Fayetteville City Planning Commission met in a special meeting at 4:00 p.m, on
Tuesday, November 20, 1962, in the Municipal Court Room in the City Administration
Building.
Members present: Miss Suzanne Lighton, Mr. Clark McClinton, Mr. Hugh Stubblefield
and Mr. George Caudle.

The meeting was called to order by Vice-chairman Suzanne Lighton. The vice-chairman
declared that although a quorum of the Planning Commission was not present, those
present would be heard. The vice-chairman reported that the purpose of the meeting
was to hold a public hearing to give consideration to the rezoning from R-2 Two Family
Residential District to P-lA Special Church District property on West Sixth Street
belonging to the Wiggins Memorial Methodist Church; from C-2 Thoroughfare Commercial
District to R-4 Multi -family Residential and Dormitory District lot 12 of Block 1 of
the Evelyn Hills Addition to the City of Fayetteville, Arkansas; and from I-2 Heavy
Industrial District to C-2 Thoroughfare Commercial District the west part of real
estate belonging to Carl E. Millheisler and Zola Millheisler, husband and wife, which
is not already zoned C-2 Thoroughfare Commercial District.
The Wiggins Memorial Methodist Church rezoning request was considered first. Vice-
chairman Suzanne Lighton read the notice which outlined the zoning change requested
• and also contained a legal description of the property to be rezoned. A statement from
Ray Adams who owns lot 1 of Block 2 of the Fegruson's Addition in which he agreed to
sell the east 75 feet of said lot to Wiggins Memorial Methodist Church and in which he
stated he had no objection to the rezoning was read by the vice-chairman. (A copy of
said above-mentioned statement is contained in and made a part of the minutes.)
I, Ray Adams, being the owner of Lot one (1), of Block two (2), of the Ferguson's
Addition of the City of Fayetteville, have agreed to sell the east tseventy five
(75) feet of this lot to the Wiggins Memorial Methodist Church and, therefore, I
have no objection to this portion of this lot being placed in whatever zone the
rest of the church property is placed. This specific portion of land begins at
the Northeast corner of Lot one (1) and extends west seventy five (75) feet parallel
to and adjacent to Sixth Street, thence south fifty (50) feet, thence east seventy
five (75) feet, thence north fifty (50) feet to the point of origin.

The vice-chairman declared the meeting open for discussion and declared that those
. present who were interested in this rezoning proposal would be heard at this time.

Wade Fincher, a member of the Church Board of the Wiggins Memorial Methodist Church,
and Clark McClinton, Planning Commission member and also a member of the church,
were the only persons who were present and who were interested in the rezoning pro-
posal. Mr. Fincher said that since Reverend Hughes was unable to attend the meeting
that he had been requested to attend; however he said he was not as familar with the
building plans as Mr. McClinton. Ma. McClinton, therefore, explained to the Planning
Commission that the church planned to enlarge their present building and would like
to have their property zoned for church use. Should their property be rezoned as
requested the church would not have to appeal to the Board of Adjustment as long as
they complied with the zoning ordinance.
There were no questions; however it was the unanimous opinion of those Planning Commiss-
ion members present that the rezoning of the Wiggins Memorial Methodist Church property
from R-2 Two-family Residential District to P-lA Special Church District would be
desirable.
The rezoning proposal of lot 12 of Block 1 of the Evelyn Hills Addition was considered
next. The vice-chairman related the error which was made at the time the property
was being placed in a zone when the new ordinance and map were being prepared. This
hearing,as was pointed out by Miss Lighton, was to determine if this lot should be
changed in zoning or not.
The vice-chairman declared that those present in favor of the rezoning proposal would
be heard and then those opposed to the rezoning proposal would be heard.
Dr. James Mashburn, 236 Oakwood, stated that at one time this lot in question was in a
1-A residential district. During the preparation of the zoning map about two years ago
it was agreed by the Planning Commission, persons who owned homes in the area and
• Mr. W. M. Ritter who owned lot 12 at that time should lot 12 be zoned for commercial
use that said lot would be used for parking only. This stipulation of parking only
was mentioned in the Planning Commission meetings; however after the zoning change be-
came an ordinance there was nothing mentioned about the parking agreement. Doctor
Mashburn said he would like for this error to be corrected.
Mr. Carl Ferguson, owner of the property in question, said that he checked with the
City Building Inspector's office before he purchased the property from W. M. Ritter.
The zoning at the time would permit commercial uses but nothing, according to
Mr. Ferguson, was mentioned to him about the parking restriction supposedly existing
on lot 12. Mr. Ferguson said he had planned to construct a one-story office building
adjacent to his present shopping center and this construction would involve lot 12.
After checking the location of the commercial and residential zones on the zoning map
and after hearing the statements of those present, the Planning Commission members
felt that further study would need to be given this matter before any action could be
taken.
The vice-chairman reported that the last rezoning proposal to be heard by the Plan-
ning Commission at this hearing would be the petition of Carl E. and Zola Millheisler,
husband and wife, in which real estate owned by the above-mentioned parties and not
already zoned C-2 Thoroughfare Commercial District is being requested to be rezoned
from I-2 Heavy Industrial District to C-2 Thoroughfare Commercial District.
The property owners would like to expand their existing "motel" business. The pro-
posed zoning change, according to said petition, would not conflict with surrounding
land uses because most of the property is already zoned for commercial use and the land
west of the property is next to the Northwest Arkansas Riding Club; therefore the

the members present felt that the rezoning request of said petition would be desirable.
There was
no one present who was
for or against said
petition
requesting a change in
• zoning.
There was no further discussion; therefore the vice-chairman reported that the pur-
pose of the public hearing having been accomplished, the public hearing was adjourned
and action on the rezoning proposals would be taken at a later meeting when a quorum
was present.
The meeting was adjourned.
