MINUTES OF FAYETTEVILLE CITY PLANNING COMMISSION
The Fayetteville City Planning Commission met in regular session at 3:30 p.m. on
Tuesday, October 2, 1962, in the Municipal Court Room in the City Administration
Building.
Members present: Miss Suzanne Lighton, Mr. Clark McClinton, Mr. Bill Dalton, Mr. Bryan
Walker, Mr. Hugh Stubblefield and Mr. George Caudle.
Members absent: Mr. Henry Shreve, Mr. J. F. Palmer and Mr. Paul Young.
In the absence of the chairman, Miss Suzanne Lighton, vice-chairman, took charge of the
meeting. The minutes of September 4, 1962 (regular meeting) and September 7, 1962
(adjourned session of the September 4 meeting) were approved as written and mailed to
the members prior to this meeting.
The Chairman of the Subdivision Committee reported that the committee had met and dis-
cussed Ira Hammond's Subdivision with Mr. Hammond. The committee felt that lots 1 and
2 of Block 2 and lot 1 of Block 1 were too small. To prevent re -numbering the lots
of Block 2 it was suggested to Mr. Hammond that lot 1 of Block 2 be enlarged by combin-
ing lot 1 and part of lot 2 and that lot 2 of Block 2 be only a narrow strip 20 feet
or 30 feet wide, and said strip be sold with either lot 2 or lot 3. The committee
recommended that Ira Hammond's engineer correct the plat with red pencil or ink and that
after correction, the plat be re -submitted to the Planning Commission.
Mr. Harvey E. Smith and Patricia A. Smith, husband and wife, and Mr. L. G. Burell and
Fay Bourland Burrell, husband and wife, want to dedicate land for the purpose of a street
• and turnaround. This land is described as follows:
Mr. Harvey E. Smith and Patricia A. Smith: A tract of land for street or road
purposes located in the Southeast Quarter of the Southwest Quarter of Section 26, Town-
ship 17 North, Range 30 West, described as: Beginning at a point 515 feet North of the
Southeast corner of said 40 -acre tract (which point is the center line of said street)
and running thence West 50 feet for the center of the circular turnaround and from that
point a circular tract of 50 feet radius.
Should a street ever be opened to run West from the East line of said 40mmacre tract so
that a turnaround is no longer needed, all that part of the 50 -foot radius turnaround
herein conveyed lying North and South of a 50 -foot street, the center line of which is
the point 515 feet North of the Southeast corner of said 40 -acre tract, shall revert to
the grantors, their heirs or assigns.
Mr. L. G. Burrell and Fay Bourland Burrell: A strip of land for street or road
purposes located in the Southwest Quarter of the Southeast Quarter of Section 26, Town-
ship 17 North, Range 30 West, described as: Beginning 490 feet North of the Southwest
corner of said 40 -acre tract, thence North 50 feet, thence East 482.5 feet to the West
side of a 40 -foot road, thence south along the West aide of said road 50 -feet to an
existing fence line, thence West along said fence 482.5 feet to the point of beginning.
It was the Subdivision Committee's recommendation that as there is no conflict with the
Major Street Plan, the street and turnaround dedicated to the City of Fayetteville,
Arkansas, by Harvey E. Smith and Patricia A. Smith, husband and wife, and L. G. Burrell
• and Fay Bourland Burrell, husband and wife, be accepted. Mr. Clark McClinton moved
that the Planning Commission accept the Subdivision Committee's recommendation. The
motion was seconded by Mr. Bryan Walker and passed unanimously.

• A motion was made by George Caudle and seconded by Hugh Stubblefield that the Planning
Commission accept Mr. Clay B. Yoe's proposal to locate and construct a street before
the engineer prepares the subdivision plat of the south end of Block 6 of Broadview
Addition. In the discussion which followed it was pointed out that due to the topo-
graphy Mr. Yoe wanted to first locate his street and then divide the lots accordingly.
The motion passed unanimously.

The Subdivision Committee recommended to the Planning Commission that the City Building
Inspector be instructed to deny Mr. F. F. Nonnamaker a building permit to build on lots
1 and 2 of Block 3 of his proposed subdivision plat because it would interfere with
future street planning and development of Yr. Nonnamaker's property. Mr. George Caudle
moved that the Planning Commission accept the recommendation of the Subdivision Com-
mittee. The motion was seconded by Mr. Clark McClinton and passed unanimously.
The defining of day nurseries and kindergartens was assigned to the
Zoning
Committee and
a report from this committee was requested to be
given at the next
regular
meeting. I
The City Inspector, Harold E. Lieberenz, presented the zoning problem confronting
Mr. Co E. Millheisler who owns the Atlas Courts on Highway 71 South. Part of Mr. Mill-
heisler's property is in a commercial zone (approximately 250 feet along Highway 71
South) and the rest of the property to the west is located in an industrial zone.
Mr. Millheisler would like to expand his business which cannot be done because of the
zoning. Some members of the Planning Commission questioned whether or not all of his
property would be in the commercial zone as th9 building inspector has the authority
to move a zone which splits property such as in this case 25 feet either way. Mr. Bryan
Walker moved that the Planning Commission call a public hearing at the earliest possible
time to consider rezoning above-mentioned property after the proper petition is filed
by Mr. C. E. Millheisler; and that this hearing be called unless the city building
inspector, after checking the zoning further, can issue the necessary permits without
rezoning the property. The motion was seconded by Mr. Clark McClinton and passed un-
animously.
The vice-chairman read a resolution, Resolution 1542, from the City Council in which
the Planning Commission was given the authority to call a public hearing to hear all
persons interested in the petition to rezone Lot 12 of the Evelyn Hills Addition of the
City of Fayetteville, Arkansas. Mr. Bryan Walker moved that the Planning Commission
hold a public hearing at the earliest possible time to study and give consideration to
the rezoning of Lot 12 of Evelyn Hills Addition of the City of Fayetteville, Arkansas,
from C-2 Thoroughfare Commercial. District to R-4 Multi -family Residential and Dormitory
District. The motion was seconded by Mr. Clark McClinton and passed unanimously.
Mr. Clark McClinton stated that he had been requested by the Wiggins Memorial Methodist
Church to present to the Planning Commission the zoning problem of the church. Wiggins
Memorial Methodist Church would like to have the church property on West Sixth Street
to be rezoned to P-lA Special Church District. Mr. Bryan Walker moved that the Plan-
ning Commission adopt a resolution asking the City Council to authorize the Planning
Commission to hold a public hearing to give consideration to the rezoning of the
Wiggins Memorial Methodist Church property on West Sixth Street from R-2 Two Family
Residential District to P-lA Special Church District. The motion was seconded by
Mr. Bill Dalton and passed unanimously.
There being no further business, the meeting was adjourned.
