HomeMy WebLinkAbout1962-08-09 Minutes116 MINUTES OF FAYETTEVILLE CITY PLANNING COMMISSION • The City Planning Commission of Fayetteville, Arkansas, met in a special meeting on Thursday, August 9, 1962, at 4:00 p.m. in the City Council Room in the City Administration Building. • I Present: Mr. J. F. Palmer, Miss Suzanne Lighton, Mr. Hugh Stubblefield, Mr. George Caudle, Mr. Bryan Walker and Mr. Clark McClinton. Absent: Mr. Henry Shreve, Mr. Paul Young and Mr. Bill Dalton. Chairman J. F. Palmer called the meeting to order and called upon Lewis Jones, the attorney of the property owners protesting the rezoning of a strip of land as petition- ed by Evelyn Hills Shopping Center, Inc., and Mr. T. I. Abshier, to report on the result of his meeting with these property owners. Mr. Lewis Jones told the members present that he had met with the property owners owning houses across from the shopping center and that the only compromise to which the property owners would agree is that a wide buffer zone be established between their property and the shopping center. Mr. Jones presented a copy of the plan ident- ical to the master plan of Evelyn Hills Shopping Center, Inc., which had been printed in the Northwest Arkansas Times on June 14, 1960. The property owners objected to the master plan at that time, June 1960. When the area was first rezoned to a commercial zone, it was understood by verbal agreement that a strip of land 150 feet wide would remain between the shopping center and Hillcrest Avenue and would serve as a buffer. Now, two years later, the shopping center requested the rezoning of an additional area. The property owners feel that the Evelyn Hills Shopping Center, Inc., is not in good faith. E. J. Ball, attorney for said petitioners, stated he knew nothing about the shopping center's master plan and he felt sure that neither John Askew nor John Maquire knew anything about the plan. Mr. Ball again stated the shopping center's position regard- ing any compromise. Clark McClinton arrived at the meeting at this time. After further discussion and there being no additional questions, E. J. Ball and Lewis Jones retired. Miss Lighton moved that subject to revision by Evelyn Hills Shopping Center, Inc., and T. I. Abshier.arid Grace E. Abshier of the proposed restrictive covenants in accordance with revisions as made by the Planning Commission this day, August 9, 1962, including making them effective as to the area rezoned, the Planning Commission recommends to the City Council that the west 130 feet of the 150 foot east -west strip of land in question be rezoned from R -IA Single Family Residential District to C-2 Thoroughfare Commercial District, and that the east 20 feet of the 150 foot strip be retained in RrU Single Family Residential District as a buffer zone to be beautified and maintained by Evelyn Hills Shopping Center, Inc., in accordance with their cove- nants and a further condition to the Planning Commission's recommendation for approval is that the petitioners shall submit to the Executive Committee of the Planning Commission a revised restrictive covenants forthwith; and that if, should the petition- ers refuse so to amend the covenants, the Planning Commission recommends to the City Council that said area be not rezoned.
