HomeMy WebLinkAbout1962-07-18 Minutes• • 105 MINUTES OF FAYETTEVILLE CITY PLANNING COMMISSION The City Planning Commission of Fayetteville, Arkansas, met in a special called meet- ing on Wednesday, July 18, 1962, at 3:30 p.m. in the City Council Room in the City Administration Building. Present: Mr. J. F. Palmer, Mr. Henry Shreve, Mr. Paul Young, Mr. George Caudle and Mr. Bryan Walker. Absent: Miss Suzanne Lighton, Mr. Clark McClinton, Mr. Bill Dalton and Mr. Hugh Stubblefield. Chairman J. F. Palmer called the special meeting to order. The minutes of June 21, 1962 (special meeting) and June 26, 1962 (public hearing) were approved as written and mailed to the members prior to the meeting. Chairman Palmer reported that the purpose of the special meeting was to study and re- commend what action should be taken by the Planning Commission and the City Building Inspector regarding a subdivision problem on Wheelock Street which is east of U. S. Highway 71 South. The City Building Inspector Harold E. Lieberenz explained the problem to the Planning Commission members. ,One of the inspectors had noticed that construction had been begun of the erection of four shell homes by Better Built Homes, Incorporated. The property in question is approximately 840 feet east of Us S. Highway 71 South, is bounded on the north by Wheelock Street and is bounded on the south by lots 10 and 11 of J. W. Skelton's Subdivision, more or less, and is described as follows, tomwit: Part of the Northeast quarter of the Northwest quarter of Section Thirty three in Township Sixteen North of Range Thirty West of the 5th P.M. more particularly described as follows: Beginning at a point eight hundred forty feet East of the Northwest corner of said forty acre tract, and running, South one hundred ninety two and one-half feet to the point of beginning. This property has been divided into four 120 by 192.5 foot lots. The houses and lots do not violate Zoning Ordinance No. 1239 and amendments; however the City Building Inspector cannot issue a building permit on an existing street for more than one house according to the subdivision regulations unless author- ized by the Planning Commission. Mr..Lieberenz continued his explanation. One house has already been moved on the first lot east of U. S. Highway 71 South and the foundations constructed on the other three lots. No building permits had been obtained because the purchaser's age', Mr. Glen Fitzhue, did not know the property was inside the City limits. Mr. Lieberenz stated that several calls questioning the activity in this area had been received by hie office. Mr. Glen Fitzhue, manager of Better Built Homes, Incorporated, of Springdale, Arkansas, was present to answer any questions. Mr. Fitzhue stated that when the property was purchased from Carl Tune, it was understood that the property was not inside the city limits of Fayetteville, Arkansas. Mr. Fitzhue pointed out that he had no reason to question the validity of Mr. Tune's statement; therefore he acted accordingly. Mr. Fitzhue said he had also purchased property south of Wheelock Street. • There being no further discussion, Mr. Paul Young moved that the Planning Commission authorize the City Building Inspector to issue building permits to Better Built Homes, Incorporated, for the houses on the other three lots and that Better Built Homes, Incorporated, be required to submit a preliminary plat before further subdividing any 106 • Minutes of July 18, 1962 more land. The motion was seconded by Mr. Shreve. Mr. Young stated that he felt justified in taking the action outlined in his motion as similar action was taken by the Planning Commission on a similar situation a few months ago.
