MINUTES OF FAYETTEVILLE CITY PLANNING COMMISSION
• The City Planning Commission of Fayetteville, Arkansas, met in a special called meet-
ing on Thursday,. June 21, 1962, at 3:30 p.me in the City Council Room in the City
Administration Building,
Present: Mr. Palmer, Miss Lighton, Mr. Caudle, Mr. McClinton, Mr. Dalton and
Mr. Stubblefield.
Absent: Mr. Walker, Mr. Young and Mr. Shreve,
Chairman J. F. Palmer called the special meeting to order. The minutes of June 5,
1962 (regular meeting) were approved as written and mailed to the Planning Commission
members prior to the meeting.
The Chairman of the Subdivision Committee said that the committee had met and was ready I
to report on the subdivisions which had been presented to the Subdivision Committee
for study and recommendation.
Miss Lighton moved that the Planning Commission accept Clay Yoe's preliminary plat of
Block 6 of Broadview Subdivision. The motion was seconded by Mr. Caudle and passed
unanimously.
Miss Lighton moved that the Planning Commission recommend to the City Council that
Ralph Stubblefield's final plat of Stubblefield's Addition to the City of Fayetteville,
Arkansas, be accepted provided that Mr. Stubblefield works out the water line problem
and further recommend that the road shown on the plat be known as Stubblefield Road
instead of South Zion Road; that the building inspector be authorized to issue building
permits on said improved South Zion Road (or Stubblefield Road); and that L.o:cley Avenue
does not have to be improved until Mr. Stubblefield wants to build south of the lots
bordering South Zion Road (or Stubblefield Road). The motion was seconded by
Mr. Caudle and passed unanimously.
Miss Lighton moved that the Planning Commission approve R. T. McClinton's preliminary
plat of McClinton's Second Addition to the City of Fayetteville, Arkansas, provided
that Mr. McClinton cut ditches north from the north end of Cline Avenue across the
Byrd property to the railroad ditch; the ditches are to be a continuation of the ditches
on the sides of Cline Avenue. The motion was seconded by Mr. Stubblefield and passed
unanimously. 0640
Miss Lighton moved that theVto
Planning Commission approve Ira Hammond's r plat of lots
5, 6, 7 and 8 of Block 1 and lots 5 and 6 of Block 1, the latter being the latest plat
on file, provided that Mr. Hammond give a 10 -foot easement for utilities; that he be
required to change the street location by the proper legal process; and that the 40 -
foot street be approved because the old street was a 40 -foot street and the street is
only a short one which does not serve many lots. Mr. McClinton seconded the motion,
and the motion passed unanimously.
Chairman Palmer presented Dr. LeMon Clark's petition for the rezoning of lots 3, 4 and
5 of the subdivision of Block 11 of the Original Plat to the City of Fayetteville,
Arkansas, from R-4 Multi -family Residential and Dormitory District to C-3 Central
Commercial District. The following was pointed out during the discussion which
followed: The Zoning Ordinance has since been amended, after the zoning map was pre-
pared, whereas an apartment structure can be erected in a C-3 zone upon approval by the

• Board of Adjustment and single family and duplex residences can be erected in a C-3
zone provided that the area and set back requirements can be met (see Ordinance No. 1239
and amendments thereof), and whereas there are already several commercial buildings
in this area; therefore Mr. Dalton moved that the Planning Commission hold a public
hearing at the earliest possible date to consider the rezoning of said R-4 Multi -family
Residential and Dormitory District, described as: Subdivision of all of Blocks 10, 119
19 and 20; part of lot 4 and all of lots 5 and 6 of Block 3; part of lots 5 and 6 and
all of lots 7, 8, 9 and 10 of Block 4; lots 12, 13, 18, 19 and 20 of Block 5; lots 19
22 5, 6, 7 and 8 of Block 9; lots 7 and 8 of Block 12; and lots 1 and 2 of Block 18,
all lots and blocks being located in the Original Plat of the City of Fayetteville,
Arkansas, and being more particularly described as follows, to -wit: Beginning at a
point on the east side of North Locust Avenue and on the south side of West Center
Street running thence 750 feet west along the south side of West Center Street to the
east aide of South West Avenue; thence 575 feet north along the east side of South West
Avenue; thence 165 feet east; thence 160 feet north to the south side of West Spring
Street; thence 375 feet east along the south side of West Spring Street; thence 325
feet north; thence 750 feet east; thence 650 feet south to the north side of West
Meadow Street; thence 210 feet west along the north side of West Meadow Street to the
west side of North Church Avenue; thence 200 feet south along the west side of North
Church Avenue; thence 340 feet west to the east side of North Locust Avenue; thence
210 feet along the east side of North Locust Avenue to the point of beginning, more
or less. Said R-4 zone is to be considered for the rezoning from R-4 Multi -family
Residential and Dormitory District to C-3 Central Commercial District. Dr. LeMon
Clark's property is located within said above described real estate. The motion
was seconded by Mr. Stubblefield and passed unanimously.
• Another rezoning petition was presented to the Planning Commission by Chairman Palmer.
Evelyn Hills Shopping Center, Inc., petitioned the Fayetteville Planning Commission to
hold a public hearing to rezone a certain strip of land from R-lA Single Family
Residential District to C=2 Thoroughfare Commercial District. The petition presented
by Evelyn Hills Shopping Center, Inc., was signed by three property owners. After
carefully studying the conditions of said petition, the Planning Commission felt that
changes were necessary inorder to comply with the Zoning Ordinance. Mr. Dalton moved
that the Planning Commission hold a public hearing at the earliest possible date to
consider the rezoning of property belonging to said petitioner and being described as:
A strip of land one hundred fifty (150) feet deep located on and abutting the West
boundary of Hillcrest Avenue, beginning at Abshier Drive, and running, thence North
three hundred seventy (370) feet, and a strip of land one hundred fifty (150) feet
deep located on and abutting the West boundary of Hillcrest Avenue, beginning three
hundred seventy (370) feet North of Abshier Drive, and running, thence North six hundred
sixty (660) feet; from R -U Single Family Residential District to C-2 Thoroughfare
Commercial District and that E. J. Ball, Attorney for petitioner, be required to make
the necessary changes in said petition by restating and/or clearifying certain state-
ments and by adding a paragraph giving the reasons why the proposed petitioned zone will
be good land use and will not conflict with surrounding land uses if rezoned. The
motion was seconded by Miss Lighton and passed unanimously.
Joe Hinton's building problem of building an addition onto the Majestic Lounge located
on West Dickson Street was presented to the Planning Commission. After discussion the
Chairman referred Mr. Hinton's problem to the Judicial Committee for study of the
possibility of said problem being taken directly to the City Council instead of the
Board of Adjustment.
• The City Building Inspector, Harold E. Lieberenz, showed the Planning Commission
members a drawing of Pat Watkind proposed subdivision which is located in the north-

• west part of the City of Fayetteville. The Planning Commission discussed the proposed
subdivision and made several suggestions. There was no action taken by the Planning
Commission as the drawing was not a preliminary plat.
Mr. Dalton, Chairman of the Zone Revision Committee, reported that his committee had
met and was ready to make a recommendation on the location of trailers on individual
lots within the City of Fayetteville. Mr. Dalton moved that the Planning Commission
adopt a resolution recommending to the City Council that Ordinance No. 1239 be amended
to permit mobile homes (trailers).in all Industrial Zones within the City of Fayette-
ville: I-lA Light Industrial District, I- BLight Industrial District and 1-2 Heavy
Industrial District, without going before the Board of Adjustment as long as the
area and set back requirements can. be met and further recommend that the Planning
Commission be instructed to hold a public hearing. The motion was seconded by Miss
Lighton and passed unanimously.
