HomeMy WebLinkAbout1962-05-22 Minutes97 MINUTFS OF FAYETTEV= CITY P -'TANNING COMMISSION • The City Planning Commission of Fayetteville, Arkansas, met in a special meeting on Tuesday, May 22, 1962, at 3:30 p.m. in the City Council Room in the City Administration Building, Present: Mr. Palmer, Miss Lighton, Mr. Walker, Mr. Caudle and Mr. Stubblefield. Absent: Mr. McClinton, Mr. Dalton, Mr. Shreve and Fa. Young. The special meeting was called to order by Chairman J. F. Palmer. Fir. Palmer read Resolution 9-62 from the City Council. The Planning Commission dis- cussed the resolution at great length. Discussion with reference to Resolution 9-62 from the City Council requesting study and recommendation to amend the clause whereby public school problems will be brought to the City Council in lieu of the Board of Adjustment brought out that on February 16, 1962,(see minutes of February 16) at 4:00 p.m. in the City Administration Building the Planning Commission held a public hear- ing on said problem at which time there were no objections. Therefore, Miss Lighton now moved that the Planning Commission recommend to the City Council that Zoning Ordinance No. 1239 be amended to refer all public school problems to the Planning Commission which will act forthwith and make recommendations to the City Council. The motion was seconded by'hr. Walker and passed unanimously. Discussion brought out that this amendment will elminate all provisions for the necessity of public' school problems being referred to the Board of Adjustment and will expedite procedures, and that state law requires that where there is a Planning Commission all such matters as mentioned above must first be referred to the Planning Commission. • The Chairman reported that Mr. H. H. Gose and Dr. Joe B. Hall had acquired the signatures of seven neighboring persons who did not object to Mr. Gose's and Doctor Hall's petition requesting the rezoning of certain property in the Park Village Addition from R-2 Two Family Residential District to R -P Professional Office Resi- dential District. Since the statement signed by the neighboring persons included property belonging to Mas. Alice Dorsett as well as property belonging to Mr. H. H. Gose and Dr. Joe B. Hall, the latter two being,the original petitioners, Miss Lighton moved that the Planning Commission call a public hearing on the petition of Mr. H. H. Gose and Dr. Joe B. Hall with the right of amending this petition to include Mrs. Alice Dorsett's property if she desires to .join in said petition and joins within five days. The motion was seconded by Mr. Caudle.. In the course of discussion Mr. Walker, Mr. Stubblefield and Mr. Caudle all expressed the opinion that Article IX, Section One, Paragraph "g" of the zoning ordinance which provides that the Planning Commission may not consider a petition for twelve months after disapproval of the rezoning of a larger tract including the tract set out in this petition, and that the Planning Commission's action on December 28, 1961, rejecting the proposed rezoning to R -P Professional Office Residential District of an area which included the area covered by this petition prohibited the consideration of the present petition. Upon roll call the following vote was recorded: Mr. Palmer and Miss Lighton "Yes"; Mr. Walker, Mr. Caudle and Mr. Stubblefield "No." There being two "Yeses" and three "Noes", the motion was lost. Mr. Grover Thomas' petition to rezone a certain area at the intersection of Garland Avenue and Highway 62 West from R-2 Two Family Residential to C-2 Thoroughfare . Commercial District was presented to the Planning Commission. Mr. Walker moved that the Planning Commission hold a public hearing at the earliest possible date to con- sider the rezoning of said property. The motion was seconded by Mr. Caudle and passed unanimously. 98 Minutes of May 22, 1962 • The City Building Inspector explained briefly to the Planning Commission a dra:v. ing of a building and street problem of Mr. Lloyd McConnell, Sr. The Chairman referred the matter to the Subdivision Committee for study and recommendation.
