MINUTES OF FAYETTEVILLE CITY PUNNING COMMISSION
• The City Planning Commission of Fayetteville. Arkansas, met in a regular meeting on
Tuesday, May 1, 1962, at 3:30 p.m. in the City Council Room in the City Administration
Building.
Present: Mr. Palmer, Mr. Shreve, Mr. Young, lir. Stubblefield, Mr. Walker and
Mr. McClinton.
Absent: Miss Lighton, Mr. Dalton and hir. Caudle.
The meeting was called to order by Chairman J. F. Palmer. The minutes of April 10, 1
(regular meeting) were approved as written and mailed to the members prior to the
meeting.
Mr. A. J. Miller appeared before the Planning Commission to request permission to open .
a subdivision on the property he owns on Highway Seventy -Ona South. This property is
410 feet by 200 feet but is located in a zone which prohibits subdivisions.
The Chairman checked with the Industrial Foundation and the Chamber of Commerce and
reported that there were no objections to a subdivision in this area. No future
industrial plans were cited by either organization.
Mr. Walker reported that he had received telephone calls from the property owners to the
north, south and across the highway from lir. Miller's property. The property owners
protested to this proposed subdivision.
Mr. Young moved that the Planning Commission approved Nr. A. J. Miller's plans for a
40 subdivision on Highway Seventy=One South and that Nr. Miller be instructed to proceed
with the necessary procedures set out by city ordinance. The motion was seconded by
Mr. Stubblefield and passed unanimously.
The City Building Inspector presented Mr. Hugh Dill's final plat to the Planning Commiss-
ion for approval. The City Building Inspector reported that the City Engineer was work-
ing on the water plans and that McGoodwin's office was working on the sewer and street
plans; however there was a problem concerning the setback lines on the turn around.
Mr. Lieberenz emphasized that the Planning Commission had approved in the past the build-
ing setback line to extend twenty-five (25) feet from the street right of way line past
the turn around so that houses could be built in line along these new streets. Nr. H.
Lieberenz requested that the Planning Commission study and permit the building set back
line to run twenty-five (25) feet from the street right of way from Center Street to a
point seven and one-half (7 1/2) feet from the cul de sac street line opposite the center
of the cul de sac and then the building setback line follow a line seven and one-half
(7 1/2) feet from the outer edge of the cul de sac instead of the twenty-five (25) feet
from the outer edge of the cul de sac street line.
Yr. Stubblefield moved that the Planning Commission recommend to the City Council that
Kra Hugh Dill's final plat be accepted provided that the building setback line runs
twenty-five (25) feet from the street right of way from Center Street to a point seven
and one-half (7 1/2) feet from the cul de sac street line opposite the center of the cul
de sac and then the building setback line follow a line seven and one-half (7 1/2) feet
from the outer edge of the cul de sac instead of the twenty five (25) feet from the
40 outer edge of the cul de sac street line. The motion was seconded by Mr. Young and
passed unanimously.
Mr. Hugh Dill, who was present to answer any questions the Planning Commission members
had, asked if he could begin construction on one of his duplexes. !r. Young moved that

the Planning Commission Authorize the City Building Inspector to issue Mr. Hugh Dill
a building permit to build on lot 1. The motion was seconded by Mr. McClinton and
passed unanimously.
The City Building Inspector presented Mr. Roy Adams' final plat to the Planning
Commission for final plat approval. He reported that the sewer was already installed;
curb, gutter and black top were constructed; and that the water mains would be laid by
the city as the houses were built. Mr. Stubblefield moved that the Planning Commission
recommend to the City Council that Mr. Roy Adams' final plat be accepted. The motion
was seconded by Mr. Walker and passed unanimously.
Mr. Walker reported that the special committee appointed to study the jurisdiction map
had no report to make at this time. Mr. Walker requested more time. The Chairman
granted the committee more time and deferred action until a later meeting.
The Chairman read the petition of Mr. H. H. Gose and Dr. Joe Be Hall requesting the re-
zoning from R-2 Two Family Residential District to R -P Professional Office Residential
District two tracts of land being described as:
Tract 1: (owned by Joe Be Hall) Lots 7 and 8 of Park Village Addition to the
City of Fayetteville, Arkansas,
Tract 2: (owned by H. H. Gose and now under contract of sale to Dr. J. W. Murry)
and being all of lot 1 and 10 feet of equal width off the south side of lot 2,
extending a distance of 15 feet east of the east line of lot 1 in Park Village
Addition to the City of Fayetteville and 15 feet of equal width off the west side
of lot 11 of said Addition, extending a distance of 10 feet north of the north
line of said lot 1.
Mr. Lieberenz pointed out that the Planning Commission held a public hearing on
December 28, 1961, in which lots 1 through 10 of Park Village Addition to the City of
Fayetteville, Arkansas, were being considered for rezoning from R-2 Two Family Resident'
District to R -P Professional Office Residential District. The area was not rezoned. '
According to Article IX AMENDMENT, 1. Amendment Procedure for Private Partiesg. Re-
petitions for Amendments, "No application. for zoning amendments will be considered by
the Planning Commission within twelve (12) months from the date of final disapproval of a
proposed amendment unless there is evidence submitted to the Planning Commission which
justifies reconsideration." The members present were reluctant to set a date for a
public hearing; therefore the members requested that Mr. H. H. Gose and Dr. Joe Be Hall
acquire in the form of a petition the neighboring property owners' opinion of the re-
quested rezoning. Action was deferred until Mir. Gose and Doctor Hall were contacted.
Mr. Young, Chairman of the Housing Code Committee, gave a report on the progress he and
his committee had made. Mr. Young urged that caution be used while drafting a housing
code. He reported the code he had studied was the "ideal" housing code, but it was too
severe to begin enforcing in Fayetteville. The Planning Commission requested the City
Building Inspector to obtain copies of the housing codes used in other cities. Mr. H.
Lieberenz said he would check with Mr. Nelson at the Division of Planning, University of
Arkansas, and see if Mr. Nelson had copies used by other cities as well as extra copies
of the housing code which Mr. Young and his committee had studied.)
