M MW OF FAYETTEVILIE CITY PLANNING COMMISSION
The City Planning Commission of Fayetteville, Arkansas, met in a special meeting on
Tuesday, November 28, 1961, at 4:00 p.m. in the Council Room in the City Administration
Building.
Present: Mr. Palmer, Mrs. Siegel, Miss Lighton, Mr. Dalton, Mr. Stubblefield,
Mr. Caudle, Mr. McClinton and several interested persons.
Absent: Mr. Shreve and Mr. Young.
The Chairman reported that the purpose of the meeting was to hold a public hearing to
discuss and recommend to the City Council that Zoning Ordinance No. 1239 be amended
and to amend the Zoning District Map,
The Chairman asked the secretary to read that portion of the November 6, 1961, minutes
which stated the recommendation of the Planning Commission and applied to the proposed
amendment of Zoning Ordinance No. 1239. The amendment would permit commercial parking
lots with shelter structures for attendants in R-4 Mulit-family and Dormitory Districts.
The Chairman called for discussion. There being no discussion_, no further action was
taken.
The secretary read that portion of the November 6, 1961, minutes which stated the
Planning Commission's recommendation to amend Zoning Ordinance No. 1239 to permit
residential use in C-1 Neighborhood Commercial Districts,and in C-3 Central Commercial
• Districts and apartments and rooming houses in C-2 Thoroughfare Commercial Districts
following review and approval by the Board of Adjustment.
The Chairman called for discussion. There being no discussion, no further action was
taken.
The secretary read that portion of the November 6, 1961, minutes which stated the
Planning Commission's recommendation to consider the rezoning of the south side of
Huntsville Road from Wood Avenue to Pump Station Road.
Dir. Carl Smith and Mr. C. D. Ritchie appeared before the Planning Commission relative
to the proposed rezoning outlined above.
Mr. Smith owns lots on Huntsville Road which he had wanted to be zoned commercial;
therefore he does not object to the rezoning.
Mr. Ritchie wishes to erect a nursery in this area and wants the property to be zoned
to permit the nursery.
The secretary read that portion of the November 6, 1961, minutes which stated the
Planning Commission's recommendation to consider the rezoning of an area on the west
side of North Leverett from Holly north to a point in line with Lawson Street.
Mrs. John W. Vinzant and Mr. Clarence Tune appeared before the Planning Commission
relative to the proposed rez6n3ng outlined in the above paragraph.
. Mrs. John W. Vinzant at 1627 North Oakland said that between the church, the shopping
center and Tune Construction the residential area is deteriorating. She was not as
concerned about the Tune property being rezoned to I-lA Light Industrial District as

• long as the Tunes continued to live in the area, but she did not want to think about
what would happen should another party buy the property.
Clarence Tune wants the property to be rezoned so he can continue his business without
the business being non -conforming and he plans to increase the size of his shop in the
future. Mr. Tune said his brother, Carl, is moving and Carl's property will probably
revert back to residential after the proper procedure is taken. He also said the
property owner to the north, Mr. V. Q. Blumenberg, has no objections to the rezoning.

the public hearing was adjourned. The chairman then declared the Planning Commission
in regular executive session to officially act on recommendations presented at the
public hearing and other urgent business.

Mr. Caudle moved that the Zoning Ordinance No. 1239 be amended to permit commercial }
parking lots with shelter structures in R -k Mulit-family and Dormitory Districts and,
Zoning Ordinance No. 1239 be further amended to permit residential use in C-1 Nieghbor-
hood Commercial Districts and in C3 Central Commercial Districts and apartments and
rooming houses in C-2 Thoroughfare Commercial Districts, following review and approval
by the Board of Adjustment. Mr. Dalton seconded the motion.
Before the vote was taken, Miss Lighton made a substitute
separately on the amendments outlined in the motion above
by Mrs. Siegel and upon roll call the following vote was
McClinton, Lighton and Siegel "Aye" and Dalton "Nay".

• A vote was then taken on the first amendment of the motion outlined above, and upon
roll call the motion passed unanimously. A vote was taken on the second amendment of
the motion outlined above, and upon roll call the vote was recorded as follows: Siegel
and Lighton "Nay" and Dalton, Caudle, McClinton and Stubblefield "Aye". There being 4
"Ayes" and 2 "nays", the Chairman declared the motion passed.
Mr. Stubblefield moved that all of lots 1, 2 and part of lots 3, 6, 7, 8 and 9 of
Aumick's Addition lying north of a line extended east from the center line of Sixth
Street at the junction with Wood Avenue to the south line of Huntsville Road be re-
zoned from C-1 Neighborhood Commercial to C-2 Thoroughfare Commercial. Also all of
lots 10 and 11 and that part of lots 6, 7, 8 and 9 of Aumick's Addition lying south
of a line extended east from the center line of Sixth Street at the junction with Wood
Avenue to the south line of Huntsville Road and that property located on the south west
corner of the intersection of Huntsville Road and Pump Station Road which is a part of
the Northeast quarter of the northwest quarter of Section 22 and part of the southeast
quarter of the southwest quarter of Section 15 Township 16 North of Range 30 West,
more particularly described as follows: Beginning at a point 20 feet west of the
northeast corner of the northeast quarter of the northwest quarter of said Section 22
thence south 138 feet, thence west 219 feet, thence north 138 feet, thence east to the
southeast corner of lot ll of Aumick's Addition 135 feet more or less, thence north to
the south line of Huntsville Road, thence southeasterly along the south line of Hunts -
y ville Road to a point due north of the beg4uiing point, thence south to the point of
beginning. This area is to be rezoned from R -a Multi -family Residential District to
C-2 Thoroughfare Commercial District. Mr. Caudle seconded the motion. The motion
passed unanimously.
Mr. McClinton moved that we recommend to the City Council the rezoning of Jess and
Clarence Tune's property from R-2 Two-family Residential District to I-lA Light

Industrial District. Mr. Caudle seconded the motion and the motion passed unanimously. I
Miss Lighton moved that we recommend the rezoning of Mr. Vernon Wilsons property with
the provision he gives the necessary footage on the south side to comply with the
Major Street Plan and that a public hearing be called if necessary after conferring
with the City Attorney; however it is our opinion after reading the Planning Commission
minutes of December 27, 1960, and January 17, 19612 that a public hearing is not needed.
Mr. Dalton seconded the motion and the motion carried unanimously.
Mr. Caudle was excused at this time.
Mr. Dalton moved that a public hearing be held to rezone that area on School Street
beginning at Rock Street and running south to the outline of the C-2 Thoroughfare
Commercial District, thence east to Locust Street, thence back north to Rock Street,
thence west to School Street to a district with the proper designation to allow doctors'
offices and clinics. Mr. Stubblefield seconded the motion and the motion passed
unanimously.
Mr. Dalton reported his committee, Zone Revision Committee, has met and discussed the
rezoning of the area on the north side of Cato Springs Road. He had talked to Hal
Douglas of the Industrial Foundation. Mr. Douglas saw no objections in rezoning the
area for residences. A strip of ample width would be left between the town branch
and the railroad spur for industrial use. The property owners on the east and west
of the area have no objections.
Mr. Dalton moved that the area on the north side of Cato Springs Road, beginning at
• the west edge of the horse show grounds and running west to the town branch and north
a distance of 660 feet, be rezoned to R -1B Single-family Residential District and that
a public hearing be held at the earliest possible time. The motion was seconded by
Miss Lighton and passed unanimously.
Miss Lighton moved that we approve Mr. King Wheeler's corrected preliminary plat,
