• MINUTES OF THE FAYETTEVILLE CITY PLANNING COMMISSION
A special meeting was called to order by temporary chairman Mr. Forrest Palmer at
7:15 p.m., Tuesday, September 19, 1961.
The Planning Commission members present: Mr. Palmer, Miss Lighton, Mr. Young,
Mr. Stubblefield, Mr. Caudle and Mrs. Siegel.
Others present at the meeting: Mr. Raymond Nelson, Mr. H. E. Lieberenz, Mr. Bryan
Walker and about fifteen visitors.
The minutes of the September 5 meeting were read and corrected.
1. A revised rezoning map was presented by Mr. Nelson. (The secretary has a copy
of the map.) Mr. Palmer asked for discussion by the audience and the members
of the Planning Commission. Mr. L. L. Baxter, Mr. Ralph Sandford, Mr. J. 0.
Ware and Mr. Dave Collins all spoke in favor of the area on Ila between
Vandeventer and Shady being zoned R -1B. Mrs. Dwight Moore spoke in opposition
since hers and the surrounding property is presently in use as student housing.
She would like to have the area remain R-4.
Miss Lighton moved that the Planning Commission recommend to the City Council
the rezoning of the areaeindicated on the map. Mr. Young seconded. The
motion carried.
• 2. Mr. Palmer asked Mr. Nelson to explain the zoning map for the newly annexed
areas to the south of Fayetteville. Mr. Nelson also explained a new district
0-1, which is an area now mainly farm land but reserved for future development.
The area needs protection until a time when its use can be defined. Rezoning
would be required to do industrial or commercial development of this O-1 Zone.
Mr. Nelson wondered how much frontage on Highway 71 should be zoned C-2
Commercial.

Mr. Palmer asked Mr. Wes Gordon of the Chamber of Commerce to speak. Mr. Wes
Gordon stated that in his experience, industrialists wanted highway property
to the front and railroad to the rear. This arrangement is difficult to find
in Fayetteville, and we need to reserve what we do have for industry. He
opposed a commercial zone in front of the Elkhart property stating that the
larger companies are "good housekeepers" and their well kept yards Facing the
highways are good advertising. He thought there was possibly too much 0-1 on
the railroad.
Mr. L. L. Baxter as chairman of the Industrial Development Foundation stated
that he thought everything should be zoned commercial which is now in commercial
use. He questioned permitting subdivisions in 0-1, but requiring rezoning for
industry.
Mr. Bill Dalton stated that he thought no zoning should be done until we learn
the location of the by-pass which would leave the present Highway 71 at about
Purdy's Store. Also, an industrial sewer line will be run south from Obermants.
Actually it is difficult to zone the area property until the locations of the
by-pass and the sewer line are known.

• It was explained that under state law newly annexed territory is automatically
placed in R-lA until rezoned correctly and that Mr. Lieberenz can now issue
permits for R-lA only.
Mr. Marvin Murphy stated that almost all industry requires railroad frontage.
Property.owners from the area were asked to speak.
Mr. Yerton, who owns land south of the Elkhart property, appeared on
September 12, 1961, to ask that his property be zoned commercial on the high-
way and residential or 0-1 in the rear.
Mr. Young said he would favor Mr. Lieberenz' issuing interim permits for
residences. However, since Mr. Yerton does not have a road, Mr. Lieberenz
cannot issue him a permit for more than one house.
Mr. Cox, north of the Elkhart property, is satisfied with his zoning of
commercial in the front and R-2 Residential in the rear. He is permitted
two-family dwellings, but he is required to put in a fifty -foot street which
would leave lots one hundred (100) feet deep.
Mr. Baxter asked that the Zoning Ordinance be changed to allow the Elkhart
plant to carry out their forging operation on the site already purchased for
them. Miss Lighton moved that we recommend to the City Council that the
Elkhart property be zoned I-2. Mr. Stubblefield seconded the motion. The
• motion carried.
Mr. Burl Ramey has an auto repair shop across from Mr. Yerton, and the map
showed his property to be 0-1. He wants to be zoned commercial. Mr. Lieberenz
explained that if he remained 0-1, his business would be non -conforming and
in order to add on, etc. seventy-five per cent of the owners within 300 feet
would need to give their approval.
Mr. Walker made several suggestions where he recognized the need for change.
The F. A. A. requires a "glide path" where buildings above a specific height
are not permitted. The C-2 commercial should include the Schaffer garage at
the north of the area.
3. Mr. Palmer commented on two of the problems facing the Planning Commission
at the present time:
a. Lack of chairman and vice-chairman.
b. Need for the Planning Commission to try to find what it can do to
encourage increase in issuance of building permits.
Mr. Young moved that we elect Mr. Forrest Palmer permanent chairman of the
Fayetteville Planning Commission. Mr. Stubblefield seconded. The motion
passed unanimously.
Mrs. Siegel moved that we elect Miss Lighton permanent vice-chairman. Mr.
seconded. The motion passed unanimously.
4. Mr. Palmer asked Mr. Nelson and Mr. Lieberenz to bring in suggestions with

. regard to:
a. Subdivision Regulation changes.
b. Churches and places of assembly.
c. Realistic front yard setbacks.
5. Mr. Nelson presented a status report (Summary Statement on the Fayetteville
Planning Program) which he would like the members to study before the next
meeting.
6. Mr. George Wolf was told there would not be time during this meeting to
consider his problem of lot split definition.
Mr.
Stubblefield made a
motion to adjourn.
Mr. Young seconded. The motion carried.
