MINUTES OF FAYETTEVILLE CITY PLANNING COMMISSION

The Fayetteville Planning Commission held a public hearing at 4:00 P.M. on Tuesday,
'September 12, 1961. Miss Suzanne Lighton was elected temporary chairman.
Planning Commission members present: Miss Lighton, Mr. Palmer, Mr. McClinton,
Mr. Young, Mr. Stubblefield, Mr. Caudle and Mrs. Siegel.
Others present at the meeting: Mr. Schera, Mr. Bradford, Mrs. Redfern, Mr. C. E.
Yerton, Mr. Lieberenz, Mr. Nelson, Mr. Walker, and Mr. V. Yerton.
1. Miss Lighton asked the secretary to read the proposed amendment to Zoning
Ordinance No. 1239 and then asked for discussion for and against the proposed
amendment. Mrs. Redfern was the only one present and favored the change.

Mr. Stubblefield moved that we recommend to the City Council the adoption of
the amendment to Ordinance No. 1239, Mr. McClinton seconded. The motion
carried.
The University Baptist Church requested rezoning to a special P-lA Church
District. Mr. Bradford spoke in favor of the rezoning. He gave a brief history
of the church. The property was purchased in April 1953 and a complete outline
of' the building program was published April 30, 1954• They did not ask to be
rezoned P-lA at the time the new Zoning Ordinance was passed. They are required
to comply to a side setback of 50 feet from the residential property. The
Board of Adjustment reviewed their case and approved a compromise of a 25 -foot
setback which is acceptable to the property owners to the east, but not
acceptable to the church. The church people would have been allowed to build
within five (5) feet of the lot line under the old ordinance.
There were no objectors present. Mr. McClinton moved that we recommend to the
City Council the rezoning of the University Baptist Church to P-lA. Mr. Caudle
seconded.
Miss Lighton called for discussion. There was concern that the Planning
Commission was out of order in reviewing the case after the Board of Adjustment
has acted on it. Mr. Nelson said that this was a proper case for the Board of
Adjustment and that they do have the authority to grant or deny a variance to
the setback.
After a long discussion, Mr. Palmer suggested a substitute motion;that the
Planning Commission meet with the Board of Adjustment to work out a compromise,
if however, this cannot be resolved in time to be placed before the next Council
meeting (September 25) then we -do' recommend to the City Council the rezoning
of the University Baptist Church to P-lA. Mr. McClinton accepted the substitute
motion. Mr. Palmer seconded. The motion carried.
Mr. Palmer moved that we attempt to get a quorum of the Planning Commission
Friday, September 15, at 4:00 p.m. with a quorum of the Board of Adjustment for
the purpose of resolving the University Baptist Church problem and that the
Board of Adjustment may so inform the property owners. Mr. McClinton seconded.

3. Proposed zoning map for recently annexed area to the south of Fayetteville:

• Mr. C. E. Yerton and his brother appeared to ask that their property be zoned
commercial on the highway and the back area be zoned 0-1, so that they could
subdivide in the future. There was general agreement.
Mr. Nelson presented a tentative plan. Mr. Lieberenz spoke in favor of strip
zoning the highway area and leaving the area behind it for residential. The
Elkhart property to the north of Mr. Yerton should be zoned I -1B. Mr. Nelson
and Mr. Lieberenz were asked to prepare a larger map incorporating the ideas
presented and that we would call another meeting and try to get more of the area
residents to come as well as the City Council Planning Committee and represent-
atives from the Chamber of Commerce.
The meeting adjourned.
PROPOSED AMENDMENT TO ORDINANCE NO. 1239
• BE IT ORDAINED by the City Council of the City of Fayetteville, Arkansas:

That Article VI, Exceptions and Modifications of Ordinance No. 1239, dated
June 13, 1960, be and the same is hereby amended by adding Section 7, to
read as follows, to -wit:
Section 7. Residential Uses in Industrial and Commercial Districts
In I-lA and I -1B Light Industrial Districts, I-2 Heavy
Industrial District and in C-2 Thoroughfare Commercial
District, single family homes may be constructed on open
and improved dedicated streets provided that such con-
struction conforms to the area and setback requirements of
R-3 Multi -Family Residential District.
