HomeMy WebLinkAbout1961-08-15 Minutes43 • MINUTES OF FAYETTEVILLE CITY PLANNING COMMISSION A special meeting of the Fayetteville Planning Commission was called to order at 3:30 p.m., August 15, 1961, by Vice-chairman Clay Yoe for the purpose of discussing the east side yard setback of the University Baptist Church. Planning Commission members present: Mr. Stubblefield, Mr. Young, Mr. Caudle, Mr. Palmer, Miss Lighton, Mr. Yoe and Mrs. Siegel. Others present at the meeting: Mr. Raymond Nelson and Mr. H. E. Lieberenz. Mr. Young said he thought the University Baptist Church was omitted from the special church catagory P -1A. He also thought the new Zoning Ordinance too restrictive when applied to church buildings. A petition from the University Baptist Church to build within five (5) feet of the lot line had been disapproved by the Board of Adjustment since there was protest from residents in the neighbor- hood. The Board of Adjustment did, however, approve a compromise setback of twenty-five (25) feet. Mr. Lieberenz suggested churhes have the same setbacks as the neighborhood in which they are located. He also thought the Planning Commission should restudy requirements for churches and student religious centers at a special meeting. Such a meeting was scheduled for Tuesday, August 22, 1961, at 7:00 p.m. PUBLIC HEARING: • At 4:00 p.m, a public hearing convened for the purpose of studying revisions of the Zoning Ordinance. The secretary of the Planning Commission has a copy of the revisions. Section 5 Mrs. Siegel asked whether this section applied to new buildings only or to both new and additions to existing buildings. The setback for additions should conform to the regulations for the zone. Further study will be given this item. Section 9 Mr. Christie suggested changing the regulations regarding home occupations by allowing the neighbors to determine what would be permitted. For example, if 75% of the residents in a 400 -foot radius should approve the occupation. He would not, however, permit occupations in zones where they are now excluded. Mr. McPheeters questioned whether home consultation such as that done by architects and doctors and lawyers is rightly called home occupation and requires a permit. A better definition of home occupation could be written. Section 12 Mr. Bill Remagen: Christian Science Church wants to sell their building on Lafayette and Forest. He thinks it would be a desirable duplex and should be zoned R-3. Mrs. Wilson: She owns property on Wilson and Maple and would like to have her property remain R-4. • Mrs. January: Bought their apartment in 1944 and desires to keep it zoned as it 44 Minutes of August 15, 1961 • Mr. L. L. Browne: (Maple, Wilson, Vandeventer, Ila) He said the largest part of his area is R -Ly and he wants the three lots marked R -1B to remain R-4. Mr. Dwight Moore: (Maple, Vandeventer, Ila) He owns several apartment buildings in the area. There are only three single residences,and he wants it left R-4. Mr. Charles Phillips: He represents the southwest corner of Vandeventer and Maple. He purchased a triplex for rental property, and he wants it left R-4. Mr. L. L. Baxter: (Ila, Vandeventer, Shady) His property is R -1B. He feels that it is unfair to face on R-4. He would like the dividing line at the rear of the lots across from him. Mr. C. R. Rhodes: (Park, Davidson, Highland, Maple) He wants the eastern part of the area in question put into R -1B. Mrs. Lucille Smith: (Trenton) The north side of Trenton is commercial and the south has mainly duplexes and should be left in R-2. Mr. Robert Logan said there seems to be just one complaint: Why change the map? Miss Lighton explained the purpose of rezoning is not just to satisfy individuals, but to try to zone this difficult area properly. The Planning Commission will study the suggestions and publish the date of the meeting to make the decision • known. Mr. Collins was in agreement with Mr. Baxter Mrs. Cummings desires to retain the present zone designation. 40
