HomeMy WebLinkAbout1959-11-11 Minutesi r 1 U • CI MINUTES OF THE FAYETTEVILLE PLANNING COMMISSION MEETING OF NOVEMBER 11, 1959 Members of the Fayetteville City Planning Com- mission met in special session on November 11, 1959 at the office of E. E. Gose, with Clay Yoe, Chairman, presiding and other members present being George Caudle, Paul Young, Jr., Hugh Stubblefield, E. E. Gose and Suzanne Lighton. Mr. Ray Nelson of the University's Planning Division was also present. Mr. Caudle, Vide -chairman, temporarily took the chair. -The proposed plat of Green Valley Second Plat was presented and after an examination of it it was moved by Miss Lighton, seconded by Mr. Gose, and un- animously voted that the Planning Commission approve the plat and recommend to the City Council that it be approved. Miss Lighton reported that as a result of a detailed discussion with the several utility. • companies in Fayette- ville, an interpretation of item (f) Section 3 of Act 186 of Acts of 1957�of the application of that section of the State law)had been worked out.that was approved by the Arkansas Western Gas Companyp the Southwestern Electric Power Company, by the Southwestern Bell Telephone Companyy and by the Ozark" Electric Cooperative Corporation (REA). A copy of this interpretation is attached to these minutes and made a part of them. On motion of Miss Lighton, seconded by Mr. Stubblefield, it was unanimously voted that the Plan- ning Commission accept this 'interpretation as its interpretation of the specified paragraph of Act 186 and that the Planning Commission recommend to the City Council that this interpretation be adopted by the City. Discussion of the proposed Subdivision Regulations was resumed in the course of which it was suggested that the Plan- ning Cc ssion recommend that the City maintain a uniform file of plats approved by the City) under some sort. of geo- graphical indexing or relationship so that the area involved in any new proposed plat could always readily be checked against existing plats not yet shown on a map of the City* which was After discussion of the Subdivision Regulations,/ not completed, the meeting was adjourned to another special session on November 18, 1959• Respectfully submit ere • • • PROPOSED F 1, STATEMENT OF POLICY TIONS FOR PUBLIC UTILITY LINES It is the purpose of these regulations to set forth the regulations deemed neces- sary to carry out the duties of the City Planning Commission implementing the Master Street Plan and such other plans as may be adopted by thg„CitCouncil under the provisions of Arkansas Statutes Section 19-2825�e sc�q. These rules and regulations are adopted under the provisions of Arkansas Statutes Section 19-2827e for the Planning Commission's action as contemplated by Section 19- 28278. 2. MAIN TRANSMISSION LINES For any public utility line which requires a certificate of convenience and necessity from the Arkansas Public Service Commission for permission to be constructed, the utility concerned will, at the time of the filing of its application for a certificate of convenience and necessity with the Public Service Com- mission, file a copy of the plat or plats describing the lines for which the appli- cation is filed, with the City Planning Commission. The City Planning Com- mission will review said plat or plats to see if they conform with the plan or plans adopted by the City Council. In the event the proposed line, in the opinion of the City Planning Commission, does not conform with the plans in effect, then the City Planning Commission will so advise the Arkansas Public Service Commission, with,a copy of their letter to the utility concerned, for the Public Service Commission's consideration in connection with their determination of whether or not the public convenience and necessity requires the certification and approval of the line. 3. EXTENSIONS TO NEW SUB -DIVISIONS The following procedure shall apply to a new sub -division for which a certificate of convenience and necessity from the Arkansas Public Service Commission is not required. The sub -divider shall, at the time of filing his plat, notify the City Planning Commission and obtain approval from the Commission for the sub- division's provision for utilities. The Commission will review the plat to see that it conforms to the plan or plans then in effect. 4.
