(Unified Development Ordinance No. 66.03K) Staff Recommendation: Accept money in lieu of land Developer Request: Combination of money and park land dedication Justification: Development is in close proximity to the University's intramural fields. The land the developer wishes to dedicate is located within the site's detention ponds, therefore rendering the land unusable during periods of rain. PRAB Motion: 5. Park Land Dedication Development Name: Noble Oaks 111 Engineer: Jorgensen and Associates, Dave Jorgensen Owner: Sweetser Properties Location: Oakland Avenue Park District: NW Units: 28 Multi -Family Units Total Acres: 1.24 acres Land Dedication Requirement: .48 acres Money in Lieu Requirement: $11,004 Existing Parks: Wilson Park (22 acres), Gregory Park (19 acres) Staff Recommendation: Money in lieu of land. Developer Request: Money in lieu of land Justification: Limited area of this development is prohibitive to a neighborhood park development. There are several existing parks within a half -mile of this new development. PRAB Motion: 6. Center Prairie Trail Land: Mill District developer, Tom Bordeaux wishes to dedicate land for a future development on W. Center Street. The land would be used to complete the Center Prairie Trail. The proposed development would include three multi -family units, necessitating a .05 acre land dedication. The developer wishes to dedicate .164 acres, more or less to provide enough land to create the trail. PRAB Motion: 7. Bryce Davis Park Project: Rebecca Turner Rebecca Turner, Park Planner has been working with Mark Boyer of the University of Arkansas, Landscape Architecture Department to develop plans for the Bryce Davis Park wetland pond area. Professor Boyer's Construction 111 class focuses on a design -build project for the semester, and specifically, design and construction of a wooden structure. Parks was approached by the University to select a site where their expertise in design and construction could be donated. Parks Staff selected Bryce Davis Park to continue efforts to preserve, and eventually, improve the wetland pond area. The students will be building an observation deck for the area as well as a handicap accessible ramp to access the deck. The students will provide both design services and labor for the development of the bridge. No CCA, pressure -treated wood will be used. Parks and Recreation staff requests to approve up to $8,500 for the Bryce Davis observation deck and accessible ramp from the Northwest Park District Park Land Dedication Fund. Ample funding is available for this project. Professor Boyer will present the design at the meeting. PRAB Motion: • • • 8. Amendment to City Ordinance Chapter 97.083 — Soliciting alms: City Ordinance Chapter 97.083 states "No person in a park shall solicit alms or contribution for any purpose, whether public or private." The City Attorney's office advised that use of City parks for charitable fund raising activities can not be permitted. See attached letter. There are many 501-3c and charitable organizations that utilize our parks for events such as the Humane Society Dog Walk, Fayetteville Disc Association Fund Raiser, Lewis and Clark Frontier Challenge and Adventure Race, Ozark Volleyball Club Juneteenth Celebration, Big Brother and Big Sister Fund Raising Event, Prevent Blindness Light the Night for Sight event at Wilson Park, Leukemia Walk, and Fayetteville Boys and Girls Club programs to name a few. See attached draft of proposed ordinance amendment. Staff Recommendations: To amend the ordinance so that the Mayor or his/her designee may approve park events. Organizations may sell food or promotional materials as approved by Park Staff. PRAB Motion: 9. Skate Park Naming: David Wright See Skate Park Naming attachment. PRAB Motion: 10.
