Opening:
The regular meeting of the Parks and Recreation Advisory Board was called to order at
5:30 p.m on April 7, 2003 in Room 326 of the City Administration Building located at
113 West Mountain Street, Fayetteville, Arkansas by Chairperson Colwell.
Present:
Parks and Recreation Advisory Board members Bailey, Hill, Colwell, Eads, Pawlik-
Holmes, and Mauritson; City staff Edmonston, Coles, Hatfield, Nelson, Turner, Wright;
and Audience.
1. Approval of March 3, 2003 Minutes
MOTION:
Mr. Hill moved to approve the Parks and Recreation Advisory Board March
3, 2003 meeting minutes as corrected.
• Ms. Eads seconded the motion.
•
The motion was approved 5-0-0 with Bailey, Hill, Colwell, Eads, and Pawlik-
Holmes voting 'yes' and Mauritson absent for the vote.
2. Parks Maintenance Superintendent Announcement: Jeff Coles
Jeff Coles was introduced as Superintendent of Parks Maintenance.

open to discussion regarding land dedication.
Following the special meeting with neighborhood residents, it was decided that
land should be dedicated as public park land to ensure the green space will be
preserved for residents. Staff recommends a combination of land dedication and
money in lieu.
MOTION:
Mr. Hill moved to accept a combination of park land and money in lieu to
satisfy the Park Land Dedication Ordinance for the proposed Lafayette Loft
Apartments Development.
Mr. Bailey seconded the motion.
Upon roll call, the motion was approved 5-0-0 with Bailey, Hill, Colwell,
Eads, and Pawlik-Holmes voting 'yes' and Mauritson absent for the vote.

MOTION:
Ms. Pawlik-Holmes moved to accept money in lieu of a land dedication to
satisfy the Park Land Dedication Ordinance for the proposed Lazenby
Apartments development and request a waiver from City Council.
Mr. Colwell seconded the motion.

• 7. Bryce Davis Park Project: Rebecca Turner
Rebecca Turner, Park Planner, has been working with Mark Boyer of the
University of Arkansas Landscape Architecture Department to develop plans for
the Bryce Davis Park wetland pond area. Professor Boyer's Construction III class
focuses on a design -build project for the semester, and specifically, design and
construction of a wooden structure. Parks was approached by the University to
select a site where their expertise in design and construction could be donated.
Parks Staff selected Bryce Davis Park to continue efforts to preserve, and
eventually, improve the wetland pond area. The students will be building an
observation deck for the area as well as a handicap accessible ramp to access
the deck The students will provide both design services and labor for the
development of the bridge No CCA, pressure -treated wood will be used Parks
and Recreation staff requests to approve up to $8,500 for the Bryce Davis
observation deck and accessible ramp from the Northwest Park District Park
Land Dedication Fund. Ample funding is available for this project.
Professor Boyer presented a model and design for the project. The students
would like to begin work immediately and complete the project by May 10. The
project would provide something for the community while providing valuable
training for the students involved. Western cedar will be used for the observation
deck.

MOTION:
Mr. Hill moved to allocate up to Eight Thousand Five Hundred Dollars
($8,500) from the Northwest Park District Park Land Dedication Fund for an
observation deck and handicap accessible ramp at Davis Park.
Ms. Eads seconded the motion.
Upon roll call, the motion was approved 5-0-0 with Bailey, Hill, Colwell,
Eads, and Pawlik-Holmes voting 'yes' and Mauritson absent for the vote.
8. Amendment to City Ordinance Chapter 97.083 — Soliciting alms
Colwell read a draft of an ordinance amending Chapter 97, Code of Fayetteville
to allow non-profit organizations to raise funds in city parks.
MOTION:
Mr. Hill moved to amend the ordinance to authorize the Mayor or his/her
designee to approve park events.
Ms. Eads seconded the motion.

9. Skate Park Naming: David Wright
On March 11, 2003, Parks and Recreation hosted a Public Meeting to gather
potential names for the new Skate Park in Walker Park The meeting began with
a brainstorming session. After approximately 30 potential names were listed, the
public voted on their top ten names. These results are as follows:

10. Active Living by Design Grant Steve Hatfield
Mr. Hatfield reported an application for the Active Living by Design Grant, a
national program of the Robert Wood Johnson Foundation, had been submitted.
Active living integrates physical activity into daily routines. The application, a
partnership with Bicycle Coalition of the Ozarks and Washington Regional
Medical Center, was one of 996 submitted. Fayetteville was not selected as one
of the 38 finalists, but Parks and Recreation will apply for the grant again.
11. Other Business
Mr. Hatfield reported the top six potential community park sites are currently
being appraised. Appraisals are due April 17.
Advisory Board members discussed the purchase of Mt. Sequoyah property.
Mr. Hatfield invited one or more Advisory Board members to seat a committee for
the skate park grand opening.
Over 1,400 trees were given away Saturday, April 5 at the fifth annual
Celebration of Trees.
Mr. Wright reported Parks and Recreation is introducing a Fun First recreation
program to emphasize fun for participants Invitations were extended for the
soccer festival Saturday, April 12 at Asbell/Lewis from 9:00 a.m. until 2:00 p.m.

development would include three multi -family units, necessitating a .05 acre land dedication. The
developer wishes to dedicate .164 acres, more or less to provide enough land to create the trail.

8. Amendment to City Ordinance Chapter 97.083 — Soliciting alms:
City Ordinance Chapter 97.083 states "No person in a park shall solicit alms or contribution for
any purpose, whether public or private." The City Attorney's office advised that use of City
parks for charitable fund raising activities can not be permitted. See attached letter. There are
many 501-3c and charitable organizations that utilize our parks for events such as the Humane
Society Dog Walk, Fayetteville Disc Association Fund Raiser, Lewis and Clark Frontier
Challenge and Adventure Race, Ozark Volleyball Club Juneteenth Celebration, Big Brother and
Big Sister Fund Raising Event, Prevent Blindness Light the Night for Sight event at Wilson Park,
Leukemia Walk, and Fayetteville Boys and Girls Club programs to name a few. See attached
draft of proposed ordinance amendment.
Staff Recommendations: To amend the ordinance so that the Mayor or his/her
designee may approve park events. Organizations may sell food
or promotional materials as approved by Park Staff.

RAISE FUNDS IN CITY PARKS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section I. That §97.083, Soliciting Alms, of the Code of the City of Fayetteville,
Arkansas is hereby repealed and the following is inserted in its stead:
§ 97.083. Soliciting alms.
(A) No person in a park shall solicit alms or contributions for any purpose,
whether public or private.
(8) Exception is made as to fundraising conducted by any non-profit
organization, which has first submitted an application and received approval
from the Parks and Recreation Division to host a Special Event.
Section 2. That §97.086, Vending and Peddling, of the Code of the City of
Fayetteville, Arkansas is hereby repealed and the following is inserted in its stead:
§ 97.086. Vending and peddling.
(A) No person in a park shall expose or offer for sale any article or thin
shall he station or place any stand, cart, or vehicle for the transpo
or display of any such article or thing.

RE: Use of City Parks for Fundraising
You have asked this office for advice concerning the use of City parks for
fundraising activities You state that this request was prompted by a recent spate
of inquiries by charitable organizations. § 97.083 of the Fayetteville Code of
Ordinances very clearly sets forth the following:
§ 97.083. Soliciting alms. No person in a park shall solicit
alms or contributions for any purpose, whether public or
private. (Emphasis added.)
We cannot help but conclude that this language amounts to an absolute ban on
the use of City parks for fundraising activities. Even though this language has
been on the books since April 1968, we are aware that some of these activities
may have occurred in the past. We cannot undo this. However, effective as of
this date, no further charitable fundraisers are to be held on park property.
If we can be of further assistance, please do not hesitate to call.

Where: St. Joseph's Catholic Church Sanctuary
Regarding: Parks Staff hopes to understand the thoughts of the neighborhood in regard to park land
dedication within the Lafayette Loft Apartments project. The North College Development company is
potentially developing 31(plus) multi -family units within the old St. Joseph's School complex. The land in
question is the playground and basketball area between the old church and school buildings. Parks staff

Revenues
1) During March, $600 was donated for memorial park benches
2) Three hundred -thirty permits totaling $5,111 were issued at Lake Fayetteville during
the month of March.
3) Three hundred permits totaling $4,616 were issued at Lake Sequoyah during the
month of March.
4) $10,155 in youth softball fees, $21,455 in adult softball fees, and $435 in fast pitch fees
were collected in March.
5) $75 in athletic rental fees was collected in March.
6) $159 in player fees was collected in March.
7) $84 in concessions proceeds was collected in March.
8) $750 in concert sponsorships was collected in March.

1) Installed new fencing along Hwy. 265 at Lake Fayetteville and repaired fencing at
Aquatic Park/Environmental Studies Center at Lake Fayetteville, Walker ball field,
Wilson Springs Research & Technology Park, Lewis, and Boat Dock at Lake
Fayetteville.
2) Modified bleachers at Walker Park to provide improved accessibility.
3) Installed bicycle racks at Hampton Softball Complex, Athletic Complex at Lake
Fayetteville, and Gulley Park.
4) Planted twelve trees at Mt. Sequoyah Gardens, two trees at Veterans Memorial at
Lake Fayetteville, five trees at Bayyari, thirteen trees at Finger, and seventeen trees
at Greathouse. Street plantings were also completed at Joyce St. & Hwy. 71B, North
Hills Blvd., Plainview & Milsap, Front St., Sixth St. & Huntsville Rd., 1-540 & Sixth
St., Old Wire Rd. & Broadview, and the Adopt -A -Spot area on Hwy. 71B. A total of
eighty-three trees were planted.
5) Renovated kiosk at Square Gardens.
6) Boat dock improvements at Lake Fayetteville.
7) Installed culvert and gate at Lewis for overflow parking.
8) Installed bollards at Lake Sequoyah to restrict pier access.
9) Overseeded and fertilized athletic fields. De -winterized

Recreational Programs
1) Completed Usage/Association Agreements with Fayetteville Youth Baseball and White
River Baseball Association.
2) Played 239 Youth Soccer games in March.
3) Registered 353 Youth Girls for the Youth Slow Pitch Softball Program. This will allot
Parks and Recreation 27 Youth Softball Teams.
4) Recruited 37 Youth Softball Coaches applications to become coaches in the Youth
Slow Pitch Program. Fayetteville Police Department has agreed to put each of these
applications through a background check to ensure our youth participants are as safe
as possible when participating in our programs.

5) .28 Adult Softball Teams participated in the 2003 Arctic Softball Classic on March 8,
2003. This was a rescheduled date due to rain that fell on the original weekend of
February 22-23.
6) Began working on 2003-2004 Fall Soccer Registration Form. This form will be
distributed on April 12, 2003 at the Youth Soccer Festival.
7) Conducted Umpire Training on March 5 and March 9 at Gary Hampton Softball
Complex.
8) Hosted a Youth Soccer Advisory Board Meeting March 31 at Fayetteville Parks and
Recreation Offices.
9) Completed Sponsorship drive and began producing marketing materials for Gulley
Park Summer Concert Series.

1) Eight staff members (Austin, Clay, Coles, Edmonston, Skordal, Waxier, Williams and
Wright) attended and passed Certified First Responder training offered by the

• Special Meeting Minutes
April 7, 2003
Opening:
A special meeting of the Parks and Recreation Advisory Board was held at 12:00
p.m., April 7, 2003 at the St. Joseph Catholic Church Sanctuary located at
Lafayette & Walnut, Fayetteville, Arkansas The purpose of the meeting was to
determine neighborhood desires for the park land dedication requirement of the
Lafayette Loft Apartments project.
Present:
Parks and Recreation Advisory Board members Bailey, Hill, Mauritson, Eads and
Pawlik-Holmes; City staff Edmonston, Hatfield, Hesse, Nelson, Turner; Rick
Alexander, Rob Merryship, Kathy Thompson, Marie Riley, Paul Warren, and Don
Marr.
Discussion:
The North College Development company proposes developing approximately 31
multi -family units within the St. Joseph complex. Rick Alexander explained various
alternative uses had been explored for the site before deciding on a residential
• development. Meetings with the Washington -Willow Neighborhood Association
have been conducted. Mr Alexander said a recurring concern of the neighborhood
was traffic and parking. The development has enough required parking for
residential occupants but not enough to accommodate visitors In order to
eliminate off-street parking the current playground area would have to be utilized
for additional parking. City Alderman, Don Marr expressed neighborhood concerns
regarding parking were primarily for special functions where both sides of
Lafayette Street were used. Resident Kathy Thompson encouraged on street
parking to slow traffic moving through the neighborhood. Washington -Willow
Neighborhood Association Vice President, Marie Riley, expressed a community
desire for green space. Because of the high volume of traffic along College
Avenue, Ms. Riley said the neighborhood was separated from Wilson Park and no
other park area is located in the immediate vicinity. Advisory Board member Craig
Mauritson explained that the green space in question would probably not be a
typical park with playground equipment. The area would most likely be a green
space with minimal amenities. Neighborhood representatives wanted assurance
that if the property was ever sold that the green space would remain available to
the public. If the property is dedicated to the City it will remain open to the public,
but if it remains with the development it may not.
The Parks and Recreation Advisory Board is scheduled to make a Park Land
Dedication recommendation tonight at its regular April meeting at 5:30 p.m. at the
City Administration Building.
