MINUTES OF A MEETING
OF THE
PARKS AND RECREATION ADVISORY BOARD
November 13, 2001
A meeting of the Fayetteville Parks and Recreation Advisory Board was held on November 13, 2001 at 12:00
p.m. at the Parks and Recreation Division located at 1455 Happy Hollow Road, Fayetteville, Arkansas.
PRESENT: Parks and Recreation Advisory Board members Hill, Colwell, Cook, Eads, Mauritson,
Shoulders and Ackerman; City Staff Edmonston, Gulley, Schuldt, Nelson; Fadil Bayyari and Shawki Al-
Madoun

Justification: Bayyari Park is already located within this subdivision.
Additional park land in this area is not suggested by the
proposed Park Master Plan.
In 1995, the Parks and Recreation Advisory Board recommended accepting a land
dedication to satisfy the requirement for David Lyle Subdivision. The requirement was 3.83
acres. Mr. Bayyari dedicated additional land for a total of 6.98 acres. Mr. Bayyari asked
the Parks and Recreation Advisory Board to consider the excess dedication in Phases I and
II to help fulfill the Park Land Ordinance requirements for this development in Phase III
A perusal of past Parks and Recreation Advisory Board and Planning Commission minutes
uncovers no mention of banking land for future development. The PRAB minutes from July
24, 1995 read. ` PRAB recommends to the Planning Commission to accept land,
approximately 6.99 acres, for the green space requirement for David Lyle Subdivision. The
green space requirement for David Lyle is 3.83 acres Fadil Bayyari will donate the.
remainder of the land contingent on him choosing the name for the park." The deed explains
the land dedication of 6.98 acres covered 153 single family residential Lots.
The Parks and Recreation Advisory Board does not want to set a precedence for other

developments where additional land has been given.

Mr. Bayyari said he was unfamiliar with the term banking. Ms. Edmonston pointed out the
language is included in the ordinance.
Mr. Bayyari stated he had donated a conservation easement to Ozark Regional Land Trust2
for the protection of the scenic farm and forest along a mile of the West Fork of the White
River. These 60 acres provide a protective and scenic buffer for the adjacent city park and
prevents future development.
Mr. Bayyari said he hoped the Parks and Recreation Advisory Board realized the extent of
his contributions and urged them to recommend to the Planning Commission that
consideration be given for this addition.
Mr. Colwell stated Mr. Bayyari had been generous by donating nearly twice the required
amount of land and felt the Park Land Ordinance requirements for David Lyle Duplex
Addition should be waived.

Mr. Schuldt reminded everyone that the actual park land fee is determined at final plat, and
the amount is currently under review by ordinance. Any changes [to the ordinance],
however, would take affect thirty days after City Council approval.
MOTION:
Mr. Hill moved to recommend to the Planning Commission to consider the excess
park land dedicated in 1996 be accepted in lieu of the Park Land Ordinance
requirement for David Lyle Duplex Addition. If not approved by the Planning
Commission, the Parks and Recreation Advisory Board recommends money in lieu
of a land dedication. Furthermore, any additional surplus acreage will account for
the park being named Bayyari and will not be considered as land banked for future
development.
Mr. Shoulders seconded the motion.
Upon roll call, the motion was approved 7-0-0.
