The meeting was called to order at 12:00 pm by Waite.
I. GULLEY PARK TRAIL/SWEETSER DONATION OF LAND
Clark presented the PRAB with a proposal of settlement from
attorney Tom Pearson at the July 1, 1996 regular PRAB meeting.
The proposal will be considered by the City Council on July
16, 1996. The purpose of this special meeting was for the PRAB
to evaluate and reach a recommendation to give to the City
Council regarding this proposal.
DISCUSSION:
Clark. Chuck Rutherford and I walked the area and looked at
keeping the trail as close to the bank of the creek as
possible throughout that area. We looked at keeping the
trail within 25-30 feet of the creek bank at all times.
There would be minimum removal of shrubbery. Crossing the
creek, I thought a 4 ft culvert may work, but Chuck
suggested a span greater than that due to debris which
could cause flooding problems. Residents have used area
to pile brush, it's not a real problem, but there is
some. It looks to me to be a feasible thing. There is
some vegetation in that area, but there is not much
screening in the area where we would want to put a trail.
Ackerman. Who would pay for the survey?
Butt: I don't think a survey would be necessary. We believe we
can take the existing lot descriptions and extend 50 feet
back from where they are currently. You should be able to

do that without a surveyor.
Dugwyler: Would there have to be a new deed?
Butt: I believe the City would have to make new deeds.
Dugwyler: I don't think the City would make new deeds without a
survey.
Could this be done without additional costs to the City?
Sweetser would probably do that at his own expense.
There could be a fair expense to the City to add buffers.
If we agree to the fifty feet we would not assume any
costs for adding buffers.
Do you think property owners will be prepared for
construction of trail?
Not one of the owners is eager for a trail, and nothing
short of the City abandoning notion will make them happy.
However, this appears to be a reasonable settlement.
Michael Thompson said if we can reach a settlement with
the City all property owners would agree to it. If PRAB
adopted settlement, I should go back and get all property
owners to sign it stating their agreement.
If there is not a full concensus that owners agree then
our recommendation would be senseless.
.The conditions we have to have is agreement of all
property owners and no requirement of City for screening
or buffer zone.
I agree if City gives each property owner a warranty
deed. I don't think they should have to pay.
We were initially talking about 12 acres. What does this
do to that by taking 50 feet off?
It leaves a little more than 10 acres.
Stipulations we would like to add to proposal that there
would be no further requests for buffer zone, no expense
for survey or deed preparation, we'd also like to see
Sweetser still agree to the $10,000 he offered, and that
all property owners agree to this settlement.

THE CITY WOULD INCUR APPROXIMATELY $100 FOR RECORDING OF
THE DEED AND REVENUE STAMPS.

The PRAB recommends to agree to recommend settlement to
City Council with the stipulations that there would be no

no expense for survey or deed preparation, and that all
property owners agree to this settlement.

II. BID AWARD FOR PHASE I OF GIRLS SOFTBALL COMPLEX
Clark proposed presenting bid received to the City
Council. The low bid came from Red Deer for $309,600
which includes an asphalt parking lot, widening of South
Salem Road, a new sidewalk along South Salem Road,
landscaping, a storm drainage system, and rough grading
for four softball fields.

I propose to move bid received on to City Council. It is
the parking lot, widening of Salem St., red clay under
infields and concession stands, sidewalk, and all dirt
work. Red Deer built soccer fields at Lewis, so we have
dealt with them in the past.
Does it include auxillary water system')
No, it does not include an auxillary water system Just
City system. It does not .irrigate the fields, but that
work later would not affect what is already done.
We would use $280,000 from A&P funds and $50,000 from
Greenspace. We would use HMR funds next year.
What's the earliest we could get it to City Council?
August 2. It's impossible to get it on the agenda earlier
than that. •

The PRAB recommends presenting the low bid from Red Deer
for $309,600 to the City Council and expediting the
launch of Phase I construction on the Girls Softball
Complex.

III. REOUEST TO VACATE ACCESS EASEMENT AT HORSESHOE
• SUBDIVISION

Clark is opposed to giving any land away. He suggested
that if the property owner was willing to sell his
property at a reasonable price we might purchase it.
Richard agreed to not vacate easement because there is a
need for park land in that area.
MOTION ACKERMAN/JAMES
The PRAB agrees not to vacate access easement at
Horseshoe Subdivision Lot #48.
MOTION APPROVED UNANIMOUSLY 7-0.
IV. PURCHASE OF MRS. GULLEY'S REMAINING LAND

Clark informed the PRAB of his visit to Mrs. Gulley.
There is approximately 2.5 acres, 9 lots including house
and barn, which has been appraised at $129,650. He
suggested that the value was much greater to developers
than to us, and he believes Mrs. Gulley wants more than
the appraisal price. The purchase of the land would
provide parking off of Old Wire Road, provide a broader
access to public thoroughfare, and prevent houses from
being built in that area. The acquisition would benefit
Gulley Park, but it is very expensive for park land.
Dugwyler suggested that it could possibly be used for a
satellite maintenance center in the future. Ackerman
suggested that Staff or a subcommittee meet with Mrs.
Gulley and negotiate the value of the land to her, agree
on the price the City would be willing to pay, and
present a counter offer.
