The minutes from the February 6, 1995 meeting were approved unanimously 6-0. - II. LAKE WILSON TRAIL Woltjen: I am a member of the Ozark Highlands. I am asking permission to dedicate the Lake Wilson Trail to a lifetime member Joe and Maxine Clark. Joe will be 92 this year, and his wife has passed away. He is a geologist and she was a botanist. They both loved the Ozarks. We hope to have a dedication for the Clark Trail in April. Driver: Has the trail been able to come off the mountain by the dam? Woltjen: No. This is a great trail. It is not the usual city experience. There are beaver and other wildlife. III. VOLUNTEER AWARD RECOMMENDATION Driver: Mr. Clark has recommended Allen Dunn to receive a volunteer award from the city for his hard work constructing the gazebo at Gulley Park. MOTION:WAITE/WRIGHT The PRAB recommends to the City Council to award Allen Dunn a volunteer. award. MOTION APPROVED UNANIMOUSLY 6-0 IV. BOTANICAL GARDEN Donna Porter: The BGSO would like to put some signs around Lake Fayetteville identifying different plant life. The signs are made from metal that will not break down and secure easily to the bark of a tree. For vines and plants, we would use a 4 x 4 post with the label attached. The signs would include the botanical name, common name, and medicinal uses, etc. Our organization is very much alive and is aiming at educational aspects. Coco Montoya will be at the Hilton for a fund raiser. • • • PRAB Page 2 Driver: I hope children will learn to have more appreciation for art and things such as this. For example, when we got the bronze statues on loan, there were problems. I hope children will have more appreciation for art. James: Would you talk to Hal Brown before labeling? We are constructing a trail all the way around the lake. Could you label around the trail? Porter: We would like a sign recognizing our organization. Mackey: When would you place these signs? Porter: Late spring or early summer. MOTION:WRIGHT/WAITE The PRAB recommends the labeling of botanical species by the Botancial Garden Society on the Lake Fayetteville trail with the approval of the Environmental Study Center Director. MOTION APPROVED UNANIMOUSLY 6-0 Driver: We could look into green space funds when ready for the trail. No reason they should bear this burden alone. V. GREEN SPACE PLATS NORTH STREET APARTMENTS Owner/Developer: Carl Walker Location: Park District: Units: Land dedication: Money in lieu: Master Plan: No park acres; 1990 104 acres. Staff Recommendation: Money in lieu Corner of North and Gregg Northwest 23 multi family .46 acres $5,520 priority; neighborhood 11; 55 existing needs 41 to 82 acres; 2010 needs 52 to MOTION:WRIGHT/MACKEY The PRAB recommends to the Planning Commission to accept money, $5,520, in lieu of a land dedication for the green space requirement for North Street Apartments. Staff Recommendation: Money in lieu MOTION:WAITE/JAMES The PRAB recommends to the Planning Commission to accept money, $7,200, in lieu of a land dedication for the green space requirement for Jerry Caster Development. MOTION APPROVED UNANIMOUSLY 6-0 Salem Village Owner/Developer: Location: Park District: Units: Land Dedication: Money in Lieu: Total acreage: 40 acres Master Plan: No priority; existing park acres; 1990 needs needs 18 to 36 acres. Bob Whitfield W. of Salem, N. of Mt Comfort Northwest neighborhood 12; 9 7.5 to 15 acres; 2010 Bob Whitfield: This 40 acres is the first in Fayetteville village concept. I propose you accept land in lieu of money. The 13 acres will be green area. We would give city the southwest corner of this green area. The wetlands are being determined now. We don't foresee wetlands because it has been used as a pasture for 100 years. There are 3 to 6 acres in this corner. You now have a 9 acre park and the school . We are across the street to the southwest. Man interested in turning this to nature trail area. This is a good idea since close to school. Foot bridges needed across creek. We will supply bridges and trails and a gazebo. Mackey: You said you will get this back to wetlands in 10 years. Why not now? Whitfield: Right now there cows, beavers, etc. We have set aside 13 1/2 acres for floodway and flood plain. We will know more after the soils are determined. PRAB will meet on site Thursday March 9, 1995 at 4 pm. VI. LAKE FAYETTEVILLE TRAIL REPORT James: The purchase of materials for the bridges is in the City's hands and they will be getting back with us. The total for both bridges is $14,800 with volunteer labor. Driver: What volunteer labor? • • • PRAB Page 4 James: Mr. Ackerman has volunteered. There has been a question if we will open the trail to mountain bikes, horseback riders, etc. Mackey: I am concerned with this. We have always thought about this as a hiking trail. The two men that encouraged this trail are elderly. We don't need mountain bikes or a horse galloping with elderly walker. a horse galloping by. I would recommend this be only a hiking trail for all age groups. VII. MUD CREEK TRIBUTARY PARK Steve Robinson: Susan gave us information on other cities with trails. I have articles on rail trail opposition. Driver: I passed this information along because I felt it addressed some of the questions voiced. Robinson: These articles have many differences from our situation. On these the average distance from trail to homes was 2,000, 1,008 and 900 feet. Does anyone have any idea the widest point on this trail. It is 200 feet. There are some ideas in these articles we have not thought of such as illegal vehicles, noise, people asking to use phone, and parked cars. This report was written by a city engineer, planner, and research analyst. Sixty- five homes are being affected by this ,trail. These are just opinions in this report, except for the Washington Post article. They polled neighbors but they neglected to interview the people that sold their homes and moved after the trail was put in. The absence of the train had a great impact on property value. Less than two incidences per year of robbery by trail users according to study. This is no doubt a sales pitch. Driver: I did not mean this to be a document on our trail. There were some good points. Robinson: You are not providing a quiet trail. Wasn't Gulley originally a vest pocket park? Waite: This is a 23 acres park and one of our biggest parks. This is not a vest pocket park. Robinson: Everything you handed us is concerning rails to trails. There is no comparison to this trail. Driver: I did not give this to you to compare to rails but to read about the concerns involved. Robinson: I understood this was going to be a bike trail which would not work. I think I will plant blueberry bushes between me and the park. Mike Robinson: Has any action been taken? Do you have the exact description of the land? Do you have a time table to accept or reject this? Driver: We have not put this back on our agenda because we do not have Sweetser's determination on banking. • • • PRAB Page 5 Mike Robinson: The land there now is essentially green space. No one can build on it. I request not to allow land in mud creek to be put into a bank for green space. It violates the spirit of the ordinance. Driver: The intent to provide a bike network; is primarily targeting streets and abandoned rail corridors. This trail I believe has a very limited usage as far as being a thoroughfare for bikes. Mike Robinson: Will there be any restrictions? Driver: I have understood it is for a walking tail. I believe the usage comes later. I talked with Mrs. McCann and Mrs. Meeks and told them there has been virtually no plan. I understand you had a visit from the corps? Robinson: I don't know the results. Do you have plans to do flooding or environmental impact studies? Don't you have a plan for 5 bridges? Driver: No, there may have been initial staff sketches but no plans. Mackey: The 1970 flood plain study is on file in Don Bunn's office. Driver: Why would you have a bridge if there wasn't a floodplain? Robinson: I understand but it is the type of bridge. Are we violating FEMA? McCann: I am very disappointed that PRAB doesn't know stipulations and regulations better when accepting land. There will be a loss of privacy, trash, robbery, etc. With respect to the city ordinances: to promote public health etc.; protect human life and promote a property to hazards of flooding etc. The building inspector checks floodplains and floodways and makes sure necessary permits are obtained. The City of Fayetteville has allowed possible violations of city ordinances and federal regulations. The Gulley Park bridges are in violation because they go from floodway to floodway. City inspector did not verify or report a house on Azalea that has fill in the floodway. Boxwood has been finalized when a house has been constructed with a garage over the floodway. If the city violates FEMA, they will be notified. If not corrected these violations can cause a city to be removed from flood insurance. Loan companies can be fined and call our loans. The citizens of Fayetteville will have to pay. Kevin Santos deals with late deadlines, foot bridges, stepping stones, etc. Be educated. If you accept it, lets play by the rules. Ed Hogan: Someone will have to fix the erosion on Azalea and stop the manholes from overflowing in Gulley Park on Azalea. There are some FEMA violations. I would hate to be responsible for getting the Gulley bridges torn down. Debbie Meeks: Why do developers give insulting land? Shouldn't they give good land? PRAB Page 6 Don Marr: We as citizens of Fayetteville want to be listened to. I don't think this should be taken lightly. Driver: Excuse me, but I don't take this lightly. If you have an issue let me know. Mike Robinson: Do you have a maintenance plan, so it doesn't become a jungle? McCann: How would they access this to maintain this? They would need bridges to move equipment. Clark: We have no design. I think it would be foolish to crisscross drainage. We would mow if the neighbors want. Mr McCann: Were their consultants giving bids last week? Clark: No, not anything to do with this. Joyce McCann: What is the difference between this and Butterfield trail? Driver: I understand Butterfield trail is for kids to go to school. Butterfield is primarily for bikes. I don't know if this will link up These are tough questions. You may be asking questions that may be pertinent to us. Dugwyler: The ISTEA grant for Butterfield trail does not in any way include this piece of property. McCann: Who do we need to talk to? Driver: Kevin Santos is the link with trails advisory committee. Joyce McCann: Kevin needs to be more educated. Just like the incinerator problem. The City would not be in this mess if they would listen. Driver: I agree. There is no rush on this. I feel these questions need to come to light and be discussed. Mackey: I am concerned this has no end in sight. I was impressed that these owners have a contract with Sweetser for their own quiet enjoyment. I am against banking this for Mr. Sweetser. I feel we will end up with a community full of floodplains. We can't put picnic tables, gazebos, etc. I think these people deserve a closure on this. We need to make a vote on it. I have talked to numerous residents on the phone and I have looked at it. I think we need to get on with it. Wright: Does anyone live on the other side. If it stays as is now won't FEMA make you correct these problems, since you all have contracts? Debbie Meek: We don't all have contracts. We just maintain it. Mcguire: I keep it cleared and the underbrush cleared. Driver- Next time this is on our agenda we will make a decision. VIII. BABE RUTH REQUEST Danny Watson: The Babe Ruth Association requests more fields for baseball. We currently have two fields with is not nearly enough room. Everyone on the board was in • PRAB Page 7 • • agreement that the Highway 265 location is an excellent site. Would it be acceptable to use this land as a practice field now? We would just clear off a spot for an infield. Driver: Is it level enough without ground work? Watson: On north side. Driver: We still have to survey the land. The practice site you use may not be final site. Mackey: We had a meeting in December about a fourplex Babe Ruth complex. It has a big benefit of having a south facing slope. This is good for drying out after a rain. There is flint rock. It would take some grading for drainage. James: Is there any liability insurance for using an undeveloped field? Mackey: Babe Ruth has it. MOTION:WRIGHT/MACKEY The PRAB recommends to allow Babe Ruth to use the future site of Babe Ruth Baseball fields on Highway 256 for practice. MOTION APPROVED UNANIMOUSLY 6-0 IX. WALKER PARK PARKING LOT Clark: This will be 113 spaces. Driver: How will this do for our future parking needs? Clark: This figure was arrived at by our baseball people. Two more fields needs should be met. Driver: Have there been any more moves towards making these streets one way? Clark: No, we would have to force a decision. Parks staff has cleaned the underbrush. OTHER BUSINESS: Driver: There will be a softball meeting a week from tonight. Mackey: I have talked all weekend about this. Overall these people would like to be heard in a format of a public hearing. The meeting adjourned at 7:40 pm.
