I. MOTION:KNIGHT/JAMES
The minutes from the January 9, 1995 regular PRAB meeting
were approved unanimously 5-0.
NOTION:MACKEY/WAITE
The minutes from the January 31, 1995 special meeting
were approved unanimously 5-0 with the following changes:
Waite: The motion needs to say approval to construct the
Lake Fayetteville trail including the necessary bridges.
James: Will the sports association's participation
numbers be ready for the City Council meeting?
Clark: It would be better to hold off on these numbers
because there are some discrepancies from earlier years.
II. LAKE FAYETTEVILLE SOUTH PAVILION DESIGN
Driver: We need to approve this design or provide
comments.
Clark: There will be laminated beams on the interior
rather than trusses do birds cannot build. The floor
will be a cement slab. This is like the pavilion at
Pinnacle Mountain.
Dugwyler: The fireplace has stone veneer. The State
will supply our designs to us.
Driver• Will this fit our needs for what we wanted?
Knight: This looks like a good pavilion and it will save
us money getting the designs from the State.
Knight: Are there plans for the restrooms?
Clark: No, not right now.

III. FACILITIES COMMITTEE REPORT
Waite: The two major outcomes of the meeting was the
reprioritization of CIP's of the sports park for Lake
Fayetteville South trail and to develop four Babe Ruth
fields on the Highway 265 property. We have not had the
meeting with the Babe Ruth people and they will have some
input. The parking lot and baseball field has been
approved at Walker Park. The Baseball Association had a
very workable plan.
Driver: Do we a municipal plan to assure incorporating
the sewer line?
Waite: On Highway 265 we will need a plan. That will
need to be phased in depending on the funding ability.
IV. COUNTRY WAY PROPERTY OWNERS
Joyce McCann: I have the copy of the agreement with
Jerry Sweetser. Dee had said that some people on
Magnolia said they wanted this trail to solve the erosion
problem. I have a petition with those neighbors
signatures not wanting the trail. Only one person I
talked with did want the trail. I talked to the Corps of
Engineers and they said the erosion problem would fall
back on the City. Corps asked what kind of feasibility
studies you have done to secure our homes and land from
what you are doing. If you put any obstruction in the
flood way, that would not be good. The fence Jodie Swope
wants would be such an obstruction. Has there been any
studies done on this?
Clark: There have been no studies, but we have also made
no plans for any obstructions.
McCann: You would have to build a bridge on the Magnolia
section for the house Jodie wants to secure. There are
two drainage ditches. The way I have figured would be a
total of 5 bridges.
Wright: Did you talk to Sweetser about selling?
McCAnn: We cannot get hold of him. He never seems to be
available. There was no mention on the PRAB minutes of
the discussion of this. What did Sweetser tell you?
Wright: That he had to bank to give us the land.
McCann: Do you have a legal description of this
property? I understand there are a few places he does
not plan on donating. At the end of Azalea is where
Jodie plans to build a house so that would not be
donated. There is a problem with the parking lot. Will
you take away green space on Township or create a traffic
problem on Country Way? Susan, what is the difference
between a neighborhood park and a city park?
Driver: They are all city parks. Gulley is a
neighborhood park and a community park.

McCann: I understood it was a neighborhood park only.
Of 14 people surveyed most drove even though they were
from Country Way.
Clark: The only plans now is to expand the parking lot
on Township.
Wright: That is parking space we had already planned on.
McCann: This is mostly a jogging trail park no swimming
pool? If everyone drives what will happen?
Waite: What is the problem? That is great that many
people are using the park.
McCann: They are already blocking driveways on Primrose
etc. The petition says we oppose this park because of
homosexuals, parking, traffic problem, etc. Why wasn't
this item on your minutes?
Driver: This item was not on the agenda for the meeting.
Waite: This was kind of a general meeting not to discuss
this property.
Mackey: This was not on agenda and no decisions were
made.
Driver: We are not here tonight to decide our concerns
but to hear your concerns.
McCann: Are the brides at Gulley Park set in concrete?
Clark: Yes
Driver: So your main concerns are parking, homosexuals,
and traffic? Of the 14 people surveyed almost all drove
from Country Way. This almost seems the opposite. There
is a trail to access.
McCann: This creates a hazard to our neighborhood
Knight: This problem is actually great because we have
so many wanting to use the park.
McCann: With all this traffic and the trail, it would be
a hazard to us. That property is ours by adverse
possession. We are planning to sue. We have taken care
of the land, and Jerry has abandoned it. The wheels are
in motion.
Wright: Did you talk to Jerry Rose?
McCann: Only about the City's part in taking the land,
not suing. Please take all this to heart.
Wright: Suppose you were in our shoes. If you had a
park plan to go by and it states we are supposed to
interlock with trails. We have grant money to achieve
our goals. When we find someone that is willing to
donate, we need to take it. What would you do?
McCann: Who says they have to connect? Who did this
master plan?
Wright: If we did not take land then we would never have
a park.
Mackey: Your problem with the people driving to Gulley
Park makes it sound like you don't like the park.
McCann: It is a neighborhood park.
Waite: It is a community park.

McCann: We just don't want the people any closer to our
house. The trail will do that.
McGuire: This trail is redundant. There are sidewalks
everywhere to get us to the park. What parent will let
a child walk a trail along a creek under 6th grade? (to
connect to Butterfield) Ferguson owns the property
behind me. We have offered to buy our property.
Mr. McCann: Over the 17 years we have owned the land,
Sweetser keeps putting us off on selling to us. I
canvassed the entire neighborhood on who would buy the
land before. I confronted him again. His reply was not
nice. He said it's worthless and we would have to get it
appraised. We don't understand the banking issue. If
this is allowed then it violates the spirit of the green
space ordinance.
Driver: Let me give you the perfect example of banking.
When a developer with continuous phases lets us know how
many units there will be and banks on the first phase.
This is the most positive form of banking.
McCann: I see a trade of 11 worthless acres. Have you
made a decision on banking?
Driver: It has not been formally considered.
Knight: Each green space decision stands on its own.
Jeff Hungate: In New York I was told what parks to go
to. If only they had known how these parks would turn
out before they created the parks. The best layout for
a park is one way in and one way out. If there are
multiple entrances, there is more crime. Police can come
in one way and criminals out another. We could put fences
but then it would be like jogging through a prison.
There would need to be a lot of lights because it is very
dark there. Gangs and drugs are everywhere. People
move here for the wholesome family environment.
Wade Colwell: I served on PRAB for 4 years. Sweetser
told me that the Country Way owners he had asked years
ago did not express an interest in buying the land.
Swope: He asked for offers and no one wanted to purchase
until the proposal for a park arose.
Colwell: Sweetser was concerned that if the neighbors
maintained the land for seven years it would become
theirs. He asked everyone to sign an agreement. I was
on the PRAB when we first approached Sweetser concerning
this property. This is connected to a great park. I
live by Wilson Park. Parks do increase property values.
I was appalled when I saw signs about free tax write offs
for Sweetser. I believe we have a situation where you
have used land you have considered yours and now the
whole community would be able to use it. We had
discussed a concrete wall for the erosion problem I saw
in one place I see this as only positive.
Man: This is our land. We have taken care of it and I
have not signed an agreement.

Meek: This property was an endangerment and, we have
taken care of it.
Colwell: In many cases, the property is overgrown. A
beautiful sycamore tree died and had to be removed to
prevent flooding across the creek. The trail would
actually increase access to the park. It would increase
your access too. There would be more ways to fan out.
I think in the long term this is very positive. I think
you are upset about a few people talking about
homosexuals and vandalism. The City would open a right
of way that would mean removing trees, cutting grass,
etc. They would probably even put the trail around your
garden. I have helped develop Gulley Park. The whole
purpose of the Gulley Park Cow Paddy Run is to build
bridges, pavilion, etc. Our goal now is to light the
area. There is a woman by Wilson park. She has a flood
light that lights up for 50 feet. You are being selfish
by not providing this land to the community. You can
plant certain types of plants that have leaves year
around.
Don Ward: I live by Sonny Dunn. We have already lost
our privacy. We have to close our blinds so people
cannot see us. I bought lots from Sweetser. I bought it
because he said I could use the land to the creek. He
said just don't block the property if City needs to clean
creek. He said he could not sell it to me. I have lived
in Fayetteville all my life. The park was never
mentioned or else I never would have bought it. The City
should not accept subdivisions with this kind of drainage
problems. It is pertinent on the banking of green space
that the City keep in mind that it is contingent upon the
land that is being developed. Connecting parks seems
old. We can't expect to connect Fayetteville now. I
wold like to know who is running the city. If this goes
through I will lose all of my privacy. The Constitution
gives freedom. A false freedom is the right to do
anything I want to do. A true freedom gives me the right
to do what I ought to do. I wouldn't even consider this.
I would want to know what the neighbors want first. This
happened to me first.
Debra Stewart: There are two other points you need to
look into. Right behind my house there is a 15 foot drop
off to rock and deep water. I would be afraid of a child
falling or drowning. I run kids off from there now for
their safety. How will this area be patrolled? We have
a lot of high school and junior high students that live
around here. This is high risk with a no patrolled area
for them.
Debbie Meek: There is no stop sign by our house. We
have a widow that walks her dog by us. We have a light
by our house but it doesn't seem to matter. We have been
robbed through our garage. We had a man knock on our

windows when my daughters were home even with a street
lamp. Our dog was gone. People knock on our door then
run back to the park. The light is not so valuable.
When we moved in, we cleaned up the area. We were told
Sweetser would sell it to us. My main problem is
patrolling it. We can't build a fence high enough
because our house is so high. I take it personally
because it is so dangerous. We keep an eye on the widows
and we worry. The mayor said this is being used as a tax
write-off for Jerry Sweetser.
Steve Robinson: My tax dollars pay for all parks. I
thank Wade for his comments but that is naive thinking.
Do we have a park currently with a long channel now?
This will create a high risk area. We have more
petitions.
Mike Robinson: I am worried about cleanliness and
picking up trash. Will a city employee pick everything
up? I am worried about the safety of my children. When
playing in the back are they at risk for people using the
parks for other than park purposes?
Ed Hogan: Has anyone seen a single person in Routh Park?
The PRAB are unpaid volunteers and I respect that. If
you take this land you don't have to make it a park. If
you start fixing the erosion problems you will go over
budget on your bike trail. Do you have a personal
position on the banking issue?
Driver• No, we do not.
Wright: We base the banking on value only.
Mackey: I have not seen a dollar value placed on this
property yet.
Driver: PRAB voted on accepting the property. We were
then informed Sweetser only wanted to donate if it were
bankable. We felt we need further communication with
Sweetser which we have not had. That is why it was not
on agenda.
McCann: Can anyone explain this flow chart I have?
Dugwyler: That is for the Butterfield trail plan. It is
part of the ISTEA grant.
McCann: Why did the mayor's office fax me this flow
chart?
Driver: You will have to ask the mayor's office.
Wright: The Trail's committee advised DRAB to take this
land.
McCann: How was the trail motion given to the PRAB?
Their meeting was after yours.
James: They let us know they back our recommendation and
this is for tonight's meeting.
Dugwyler: The Trail's Committee minutes are put into the
PRAB agenda which is mailed out the Wednesday before the
meeting.
Mackey: This was tabled until we talk to Sweetser about
banking.

Wright: This must be banked in that quadrant.
McGuire: Here are some pictures from 1989. These
pictures only speak for the back of my house.
Randy Lee: I have a swimming pool and I have a concern
of people walking by it. Also lots of people have dogs
and there would be constant barking.
Jodie Swope: Jerry Sweetser is my dad and he will be at
the next meeting. Last time Mrs McCann was at the office
I told her when he would be back. No one contacted me
after that. I built a house on Azalea Terrace and I have
as much to lose as anybody. The creek runs through my
land. I understand that my family will retain an area to
build a spec house. I am in favor of the park even
though I will have something to lose. See attached
letter from Sweetser.
Jeff Hungate: I don't think Jerry Sweetser is on trial
here. Please check your law books on squatter rights
before taking this land.
McCann: In reply to Jodie Swope's statement, I had an
appointment with her and she said they would get back
with me and they did not.
Driver: I have paperwork on trails from planning. Rails
to trails information on vandalism etc. Most of the
studies that have been done on trails say these concerns
are legitimate concerns. Most of the people involved
have changed their minds to become favorable of trails.
Fear is every bit as contagious as trust. A person would
be crazy not to sign this petition concerning illicit
activity, etc. I would like to propose to you that we
not get in set stances but continue to explore it
together. I do think the educational material available
helps allay some of the fear of the unknown. I have an
Uncle John. My Uncle John was a Christian missionary who
took his six children to some of the worst places in the
world. Upon his retirement, Uncle John bought a house on
the lake in North Carolina. He was quite a gardener. He
had a beautiful garden of primroses. He was informed by
the city that they were going to build a trail on the
easement around his garden. So Uncle John built benches
for the people to watch the primroses open. He writes in
chalk on the sidewalk every day the time the evening
primroses open so the people when to come. We cannot
wait for a perfect world to occur to us. The opening of
anyone's back yards would be very painful when
considering the fear.
McCann: Will this material help us with dealing with
vandalism and homosexuals etc.
Driver: Please read it and we can discuss it next time.
Chuck Hanks: I live south of Ferguson Street and I think
the trail is a great idea. My kids use this are now.

Jorgenson: See attached letter. Can the money you
collect be used to make improvements to the park?
Driver: Why would a pasture not make a good park?
Jorgenson: From his standpoint, Fieldstone and
Bridgeport have a gulley that make a great setting for a
park but not his good pasture land.
Driver: He also needs to consider the money that was put
into this park by the developer at Bridgeport.
Wright: If the park were bigger more people from those
subdivisions could use it.
Jorgenson: Yes, this area needs a real park not just 5
to 7 acres.
Driver: This one strip of the pasture land is in
people's backyards. Could you give us an area for a sand
volleyball court and basketball area. With a good
location and equipment, this could seem like a better
park for this dense area. I would recommend land and
something that would enhance not only this land but the
whole park.
Knight: We want this property squared off and not get
the property behind the houses.
Clark: Bridgeport gave in land in excess and used some
of their own money to develop the park. That is why we
took what we did.
Knight: This is a beautiful flat land that would
complement the other. This would make people want to buy
in this subdivision.
Jorgenson: I am concerned about waiting a month.
Driver: We can meet on this sooner than our next meeting
if you need us to.

land, 1.75 acres, for the green space requirement for

to the existing park area and suitable for a park area.

Waite: We need to serve the kids in this area, but we

served only this development, I do not think we should
accept land.
Driver: The green space ordinance could mean for these
developers to give land to serve their subdivision.
Wright: How many people live around this area now?
James: The current acreage in this park district is 211
acres. The 2010 needs are 17 to 34 acres.
Driver: Could we locate it adjacent to the next
development?
Clark: We should

OTHER BUSINESS:
LAKE FAYETTEVILLE SOUTH TRAIL
James: Here is the trail map for Lake Fayetteville by
Tim Ernst. The two bridges are indicated. I am very
excited to get it done and let people enjoy it. I would
like to shrink the map down for people to see. We would
like to open it on national trails day early in the
summer and dedicate it.
Knight: Dale and I went to Lake Fayetteville South.
Three police cars were training their dogs there.
POLICE REPORT
Clark: I talked with Detective Hoyt and they said they
would rather think about it and if they had anything to
report they would. They have no suggestions at this
point.
Wright: What is the procedure?
Dale: There is a civilian park patrol and regular park
police. The park patrol leaves their vehicles and walks
the parks. Activities such as the ones at Lake
Fayetteville South happen everywhere.
Wright: I would like to know the normal frequency
pattern of occurrences. (Monthly, daily)
Driver: You could visit with these patrol and ask them
your question and report back to us.
Wright: I would like to see the standards of arrest
compared to other cities. I would like to alleviate the
fears.
VOLUNTEERS
Driver: I would like mention of volunteers such as youth
leagues, etc. I would like to see some recognition of
these.
SOFTBALL SANCTIONING
James: Dale, Chuck Yarbrough called me and had questions
about the softball league not sanctioning this year.
Clark: We have sanctioned either ASA or USSSA in the
past. We collected the fees and sent the money in to
sanction. Last year many teams sanctioned both ways. I
think the league can run well with the teams sanctioning
themselves. It doesn't mean we won't do tournaments.
Hopefully ASA and USSSA will be interested in conducting

tournaments as in the past. Mark Paul is in charge of
coordinating games at for Adult softball.
Wright: What exactly is sanctioning?
Clark: Basically just paying your fees.
Driver: It simply means you can compete in their
tournaments.
PURCHASING LAND IN SE PARK DISTRICT
Driver: I think it would be helpful to have a meeting
for a committee to search for suitable land and come back
to this board with a recommendation. We need a park
comparable to Gulley Park in the northwest and a park
area in the southeast quadrant.
FIELDSTONE PHASE III
Clark: We need to look at Fieldstone Phase III. We had
originally decided to take land for all three phases, but
we need to look at it again. The facilities committee
needs to look at the land and report back to the PRAB.
The special PRAB meeting will be Monday, February 13 at
4:00 pm at the Youth Center for Willow Springs and
Fieldstone.
LAKE FAYETTEVILLE SOUTH GATES
Clark: George and I looked for gate locations at Lake
Fayetteville South. We will locate two gates to keep
traffic from making the circle. We would open the gates
for large events.
Driver: Will we need to put additional parking by the
pavilion?

road leading into it.

BETTY TURNER REPORTED TO THE BOARD CONCERNING THE STATUS OF THE
FAYETTEVILLE COMMUNITY/SENIOR CENTER PROPOSED FOR WALKER PARK.
SHE HAD A "TURN KEY" ESTIMATE FROM AN ARCHITECT OF $2,000,000. THE COUNCIL
ON AGING HAS COMMITTMENTS OF $700,000 ALREADY. SHE NOTED THAT THE 2
MILLION FIGURE WAS A "TURN KEY" FIGURE INCLUDING EVERYTHING FROM
LANDSCAPING TO SILVERWARE. THE PROJECT SHOULD LOGICALLY BE DONE IN
PHASES.
THE BOARD DISCUSSED THE POSSIBILITY OF INCLUDING SOME FUNDING FOR THE
SENIOR CENTER IN THE PROPOSED HMR TAX PROPOSAL.
THE CHAIRMAN STATED THAT IT WOULD BE WISE AND PRACTICAL TO INCLUDE THE
SENIOR CENTER COOPERATION AND THE SCHOOL GYMS COOPERATION IN OUR HMR
PROPOSAL.
THE BOARD WOULD LIKE COPIES OF THE BASEBALL, SOCCER, BABE RUTH, GIRLS
SOFTBALL 1 YOUTH BASKETBALL AND THE ADULT LEAGUE SPORTS END OF YEAR
REPORTS FOR DISTRIBUTION TO THE CITY COUNCIL ON THE 7TH.
BILL WAITE WILL PRESENT THESE REPORTS AT THE BOARD MEETING MONDAY
NIGHT.
REPRIORITAZATION OF CAPITAL IMPROVEMENT PROJECTS
" SPORTS PARK DEVELOPMENT $100,000
" GREEN SPACE FUNDS IN NORTHEAST PARK DISTRICT $63,000
WE WILL USE SPORTS PARK DEVELOPMENT FUNDS TO DO SURVEY WORK, TOPO,
DESIGN AND BIDABLE SPECS. UPON COMPLETION OF THIS PHASE, WE WILL
CONSIDER ACTUAL CONSTRUCTION DETERMINED BY FUNDS AVAILABLE.
WE WILL USE GREEN SPACE FUNDS TO CONSTRUCT 2 BRIDGES FOR LAKE
FAYETTEVILLE.

MOVE THAT GREEN SPACE FUNDS IN THE NORTHEAST PARK DISTRICT BE USED TO
CONSTRUCT 2 BRIDGES ON THE LAKE FAYETTEVILLE TRAIL AND IF NEEDED TO TAKE
REMAINDER OF FUNDS FOR BRIDGES FROM SPORTS PARK DEVELOPMENT.

LICENSE AGREEMENT

1. SWEETSER hereby grants to the LICENSEE the right to
take possession and to occupy the real estate situated in

of real property owned and occupied by the LICENSEE.
2. The LICENSEE hereby accepts the possession and

of this Agreement by SWEETSER or by the LICENSEE.
