BUSINESS:
I. MOTION:WAITE/Mackey
The minutes from the November 7, 1994 meeting were
approved unanimously 6-0.
II. SWEETSER DONATION OF LAND
Driver: There was some question as to the drainage
problem along that creek. We believe there will be some
value of connecting Gulley Park and Routh Park. We need
to consider banking. It is approximately 12 acres.
Waite: It is hard to decide. I think the amount of
money has a very distinct bearing. I would feel more
comfortable with a concrete proposal.
Driver: We have no process for land appraisal. My
understanding is that we would bank it at the set value
per acre.
Waite: Some of the area is in the creek, and not able to
be built upon. That leaves some question. I think the
acceptance of the land and the banking issue are two
different recommendations.
McCann: Was any consideration given to the property
owners?
Driver: We have not had a public meeting, but we will.
McCann: This is about the third time this has come
through. We voice our objections each time. WE don't
want people walking through there. We do not want the
same problem here as the one at Lake Fayetteville South.
We have spent a lot of time cleaning up there when it
floods. But that is not the issue. We are worried about
opening that up to everyone.
Wright: We talked to two residents when we were at the
site. They were for us taking this land.
McCann: WE have a lot of people that oppose it.

Why wouldn't Sweetser want to sell this land to

Paul Dunn: When we had all the floods, it never got over
the bank. I am familiar what goes on with the park
situations. In Little Rock, we had a lot of problems
with drugs and homosexuals in a alley park with no
lighting. They finally had to shut down the one in
Little Rock.
Driver: We are trying to make a trail that does not use
motorized vehicles. These problems you mentioned can't
be a deterrent against acquiring park land.
Dunn: This was the same thing in Little Rock. They
acquired the alley for trails. It is not safe for the
children.
Knight: Have you got drug problem in Gulley Park? I
don't think it is fair to compare this with Little Rock.
We don't have any problems with Gulley now.
Dunn: Gulley is lit and police are there.
Driver: How is the drainage?
Dunn: I do not have a problem and I am right in the flood
plain.
Joyce McCann: We won't compare it to Little Rock; we
will compare it to Fayetteville. We have to clean it up
at after every flood. Mr Sweetser will be able to
provide more lots if you fix the creek. He won't be out
anything. He will get free maintenance. The people
along Country Way will not have privacy. Mr. Sweetser
agreed that as long as we maintained this land we could
keep it.
Driver: Do you have a copy of an agreement with Mr.
Sweetser?
McCann: Yes, at home. He said we could put gardens,
portable buildings, and maintain it while retaining the
privacy. The park patrol can drive into Gulley Park.
Who will foot patrol the trail? The City will have a lot
of expense for Jerry Sweetser to build a couple of new
lots.
Mackey: What are the estimates of the houses here?
McCann: Mine is about $90,000. It won't be the
residents or the City that profit from this. It will be
Jerry Sweetser.
Ed Hogan: The comparisons to other parks might happen.
It is possible. I have never seen Routh Park used in my
life. The land is in essence green space now. It is a
100 year flood plain and nothing can be done with it. If
you take the land, you have only aggravated your

responsibility. It is a green space now. Sweetser can
certainly use the money or land trade.
Wright: This may not be a trade. We want to know if it
is good for a trail.
Mackey: I think this banking thing is different from the
recommendation we made. It changes the picture.
Driver: We would have to have public meetings. If this
is the tip of the iceberg, we will have lots of public
comment.
Savage: Is there a precedent?
Knight: If this is thousands and thousands of dollars,
we don't want it. We need to see the agreement.
Driver: WE need Sweetser here.
MOTION:WRIGHT/SAVAGE,
The PRAB recommends to table this item.
MOTION APPROVED UNANIMOUSLY 7-0
This item will be considered again after PRAB sees
agreement with property owners and Jerry Sweetser. Also,
the PRAB wants Sweetser's proposal on the donation and
banking.
III. HIDDEN LAKE
Driver: One change is the path of the trail on the
drainage pond. They are giving 4.75 acres of land and
1.1 is required.
Milholland: We would actually be adding land. It would
provide better access to the park land. There would be
no public parking, but it is accessible from the cul-de-
sac. Now you will have 85 to 90 feet of access.
Marquess: There will be sidewalks through the
subdivision.
Milholland: If you wanted a few parking spaces, there
would be room to do it. You called it a retention pond.
What you see now is really close to what it will be like.
There is only water in it some times. A detention pond
will slow the water down and run it through the culvert.
The water will not stay there for long.
Driver: Will be explicit with the residents that this
will be a public trail?
Marquess: Yes they know it will be a park.
James: How narrow is it between Lot 37 and 38?
Milholland: Planning approved this if we deleted 38.
Clark: The pond will need some attention from time to
time. We are getting into an area we have not been in.
We need to look to the Street Department. If we allow
banking, what value are we looking at? On the south side
we could get a hard surface trail.
Milholland: My understanding is that for each living
unit you require certain acreage. I heard you say you

are worried about a trail. I don't think the detention
pond would affect a trail. It would not be a swift rush
of water just some backup for a short time.
Driver: This had no use except for flood plain.
Milholland: The retention is above the 100 year flood
plain.
Marquess: We took this over 4 months ago. It had 67
lots on it. The pond was gone in this proposal. We want
the pond. In a lot of cases, people donate land for
parks that cannot be used. We believe we are giving an
area that is good for a park. We will lose three lots by
keeping the pond. The appeal is concerning a drainage
issue that is on the other side on Ramsey. Even after a
large rain, the pond is still a clear blue.
Clark: How many houses per acre?
Milholland: There are 15 acres with 44 lots. This is
just shy of three houses per acre.
Clark: Banking must stay in the same quadrant.
Marquess: We should just trade acres. We are going to
put some nice things out there.
Waite: I think the acres will equal out. It's a
different multiplier.
Mackey: What is the benefit to the City?
Driver: This area will provide a recreation area with a
foot path. They have modified their development to meet
the needs of the people.
MOTION:WRIGHT/KNIGHT
The PRAB. recommends to bank the excessacreage with a
maximum_of twp acreswto be used in..the development of R-1
housing in the Northeast park district.

BRIDGEPORT
Rudasill: This is a retention pond and a detention pond.
It will protect the areas downstream.
Driver: Mr Doyle is willing to put this into writing.
Rudasill: There will be times when excess amounts of
water will come through there. We don't want water to
wash the park out. The pond will be 8 feet deep. We
want to talk to the Game and Fish Commission about proper
depths for fish.
Driver: You were going to look at dam plans to see if
anyone has fabricated a solution for the leaking problem
encountered in this type of soil.
Doyle: No, not yet
Rudasill: We just want to make sure you want a pond on
your property.

Doyle: We understand you don't have enough money. The
people in the area are concerned about maintenance of
their park. We have adopted a POA. It will say whatever
you do not do they will be responsible for.
Wright: Have you talked to any POA's that share a pond
like at Boardwalk?
Driver: That one is not open to the public though.
Doyle: We want it to be open to the public as a whole
for the community benefit. There are people that play
basketball there now. If people don't want this as a
public park they need to buy a house elsewhere.
Clark: I asked Legal Council about our liability. With
tort immunity we shouldn't have a problem. Siloam and
Springdale both have parks with water. There will be
some maintenance over the long haul. The question is how
long till it fills up with silt?
Rudasill: There will be provisions to drain the pond from
bottom.

The PRAB recommends to accept this proposal for a pond
the park as presented.

V. GREATHOUSE PARK LAND PURCHASE REQUEST
Clark: Mr. Jordan lives in the log cabin by the park.
He wants to utilize some park land for parking vehicles.
He wants to enter into a long term lease or purchase the
land. He has dump trucks and is looking for an extra 30
feet. I don't think we are in the business of selling
park land. The most we could do is to let him use some.
Driver: That would be letting park land be used for
private business.
MOTION:JAMES/WAITE
The PRAB denies the request to sell any land at
Greathouse Park to Bob Jordan.

VI. AD Hoc Report
Waite: The ad hoc committee has recommended a one cent
HMR tax and possibly a 1/4 cent sales tax to gain capital
funds. We need an education plan. We need a more formal
mechanism for private funds for parks. We will come up
with more concrete ideas at the last meeting.
Driver: I understood that we need a vote from this board
approving these funding sources.
Waite: The ad hoc approved a one cent HMR tax to be
coupled with an occasional sales tax. The projects and
amounts would be very specific.

Knight: My concern is that if we don't have a program
for that one cent. It sounds pretty good to say it is for
maintenance if we build into it controlling problem areas
such as drugs, etc.
Waite- It is not just a maintenance idea, but also
capital development. It is more sensible to acquire land
ahead of developments, but we do not have the money now.
Driver: I think the prioritization of projects will fall
to PRAB.
Knight: Can't we vote to approve this with a good
program?
Driver: Our board needs to approve this ad hoc
recommendation. The HMR tax would help us catch up with
capital improvements and help us maintain them. If we
need additional in the future we can implement a 1/4 cent
sales tax. There is no prioritization at this time.
Waite: HMR cannot handle the big items. We would need
to sell them individually.
Driver: WE as a board will be spearheading the education
aspect. Ad hoc members have also committed to this.
There is definite need for organized education.
Wright: What happens if we get the HMR and they lower
our budget?
Driver: It will help alleviate the city budget. The
city can divert some funds to help with infrastructure
needs. We tried to find funding that would not put the
needs of parks over the other needs of the city.
Wright: Will the hotel owners not like this?
Mackey: By them making more money, we make better
facilities and bring more people back into town.

The PRAB approves the recommendation of the Ad hoc
Committee to pursue funding sources through an HMR tax
and 1/4 cent sales tax.

VII. GREEN SPACE REPORT
Dugwyler: These are new forms I have made for the office
and for your information. We will base our
recommendations on this checklist. All of these things
on page 1, 2, and 3 are required in taking land or money.
Driver: I would like to see an addendum to this form for
the banking procedure.

VIII. LAKE FAYETTEVILLE TRAIL
James: Here is a letter from Tim Ernst. I would like
recommendations on this letter. The most critical items
are the bridges and drainage ditches. A bridge at Clear
creek and the dam are very important. Where do we go from
here?
Driver: Bill Ackerman has done a tremendous amount of
volunteer work around this area. Would a floating bridge
bear resemblance to the dock for the handicapped. Should
Johnny contact him?
James: Tim met with Hal Brown and coaches from the High
School.
Knight: The trail part would be easy with volunteers.
The bridges would be the hard part.
Drivers I feel this is a priority for many reasons. One
is that it will increase the usage of Lake Fayetteville
South. I recommend that this be top of the line.
Knight: I think it should be a top priority for Lake
Fayetteville South. The police want to close it but I
think it is important to fix the problem. We need to
push that pavilion as fast as possible. This park has no
use right now.
Driver: I disagree. I walk that trail all the time.
Mackey: If there is illegal activity going on, enforce
the law.
Wright: The police decided that is not a problem. I
called the Mayor and asked him to get a police officer to
our next meeting to see what will help with the
situation.
Driver: I want to compliment Johnny on the wonderful
job.
James: Will you see if someone will look at the
elevation on 265?
Waite: Do we need to reorganize CIP projects since we
don't know about HMR yet?
OTHER BUSINESS:
GREEN SPACE
Greg Bone: We are trying to rezone an area on Highway 16
West , west of 54th Street. The development would be 50
acres with a 5 acre outparcel in front. This would leave
45 developed acres if rezoned 1.5. The outparcel is an
existing single family residence. We will plat around
that. This is about 100 affordable housing lots. not
the total development should be 180 acres.
Wright: With one entry, it would be more of a
neighborhood park. How about land for this phase and cash
for the next phase. Could you call a special meeting if
necessary?
Driver: I would suggest an on site meeting.

WALKER PARK BASEBALL
Mackey: The first meetings for summer baseball are
tomorrow. What are plans for Walker?
Clark: We need a topographical survey and it is in Butch
Green's hands. He is trying to lay out the fields
requested there. Hopefully we will bring it to PRAB on
the first meeting in February.
POLICE REPORT
Wright: Do we want police to attend our next PRAB for
a report on parks.
Driver: That would be great.
