The Parks and Recreation Advisory Board came to order at 4:15 pm.
MINUTES: Minutes of the March 13 meeting were approved as mailed
with the correction of Marge Hanlon spelling under item 8 and
the addition of Garden to Environmental Sculpture in item 7.
BUSINESS:
1. Park Horticulturist: Patti Reid has been hired as the Park
Horticulturist to begin work on Monday, April 2. She will
be introduced to PRAB at the April 10th meeting. PRAB
suggested that the Park Horticulturist job description should
be reviewed by the Personnel Committee within one year.
2. HCRS Grant Application: PRAB stated to use the entire
Master Plan for Wilson Park in the HCRS Grant application.
Estimates needed to be accumulated for each project.
3 Industrial Park Food Plain Master Plan: The City Purchasing
Agent is advertising for bid proposals for the Master Plan.
PRAB stated that they would like to meet with the approved
bidder to discuss the area and items to be considered in
developing a master plan.
4 Asbell Gym Renovation Opening Date: PRAB set the Ribbon
Cutting Opening Ceremony for the renovation of Asbell Gym
on Thursday, April 12 at 5:15 pm. The ceremony is as
follows: 1. Introduction/Welcome: Dale Clark
2. History/Project Critique: Bill Waite
3. Introduction of Mayor Noland - Bill Waite
4. Ribbon cutting: Mayor Noland
5. Activity
Invitation list: City Board, City Administration, PRAB,
Hunnicutt (contractor), George Knight, Dr. Simpson, Principal
Lyman, Charlie Russell, Asbell PTA, Volleyball Club, FYC Board,
Rick Osborne, Newspapers.
5 Green Space Ordinance Amendment: City Board amended the
Green Space Ordinance waiver so that the City Board of
Directors will be the governing body to approve or
disapprove a subdivision's request for a waiver of the
ordinance. The Ordinance did read that the Planning
Commision could grant a waiver. See enclosed attachment.

5. (Continued): Butterfield Trail Subdivision: The City Board
of Directors denied the request for a waiver of the Green
Space Ordinance by the Butterfield Trail Subdivision. It
was the consensus of PRAB that a request for money in lieu
of land be recommended to the Planning Commission.
6. Volunteers in the Parks: Connie Edmonston reported groups
to work as follows: March 30 at Gregory Park - Futrell &
Holcomb Halls, Sigma Nu Pledges; April 14 - Alpha Kappa Psi;
April 21 - Alpha Phi Omega. Unscheduled groups interested
in volunteering are Phi Gamma Delta, Agre Mech Club, Intra -
Fraternity Council.
7 Budget Review: PRAB will review the first quarter financial
report at the next PRAB meeting.
8 Status of Charles J. Finger Park and Walker Park North:
Dale Clark reported that the parking lots at both of the parks
are now under construction. The softball backstops and soccer
goals have arrived for the parks. Exact placement of the
playground and oicnic facilities will be mapped. The playground
and picnic facilities are to arrive the last of April. PRAB
stressed that "vandalism" should be considered in installing
the equipment and facilities.
9. Summer Programs: Softball will start the last of April.
Other programs such as the playground programs, arts and crafts,
children's theatre will start the first of June.
10. Summer Personnel: March 30th is the deadline for summer
applications for the parks and swimming pool. All positions
will be hired by April 15.
11. Wilson Park Parking Lot: Dale Clark reported that he has
been visiting with the City Purchasing Agent for procedures
for the parking lot bids. PRAB stated that they would like to
visit with the selected engineer concerning the parking lot.
12. Spring Park Tour Date: WEDNESDAY, MAY 16 at 7am. Please check
your calendars.L

BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That Article V, Section F, of Appendix C
to the Fayetteville Code of Ordinances is hereby amended by
adding the following paragraph:
In the alternative, these regulations may be
amended by majority vote of the City Board of
Directors without the Planning Commission first
holding a public hearing; and, the City's land use
plan , community facilities plan, master street plan
and other plans may be amended by majority vote of the
City Board of Directors without the Planning Commission
first holding a public hearing.
Section 2. The Board of Directors hereby determines
that the City's land development regulations are in immediate
need of amendment to conform to the Arkansas Supreme Court's
decision in City of Fayetteville v. IBI, Inc., 280 Ark. 484
(1983) and to make adequate provision for public parks; that
adequate provision of public parks is essential to the public
health and welfare; and that the immediate passage of this
ordinance is necessary to make adequate provision for public
parks. Therefore, an emergency is hereby declared to exist
and this ordinance being necessary for the public health and
welfare shall be in full force and effect from and after its
passage and approval.

BUTION IN LIEU OF LAND DEDICATION.

BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That Article III, Section A(1)(k)(1) of
the Fayetteville Code of Ordinances is hereby amended by
amending the first sentence to read as follows:
(1) If, under the City's Comprehensive Land Use
and Community Facilities Plan (General Plan 1970-
1990), a new park is to be located in the park dis-
trict where a subdivision is proposed and the sub-
divider does not dedicate land for park use in
accordance with said plan at a ratio of .0125
acres of land for each single family dwelling unit and
O1 acres of land tor each multi-familydwel�l'ng
unit permitte. n e su..ivision under the City's
zoning regulations, the subdivider shall be required
to make a contribution in lieu of land dedication
according to the following formula with such contri-
bution to be used for the acquisition of park land
that serves the subdivision: $8.5.00 for each multi-
family unit and $105.0 each sin le
perms -. in t e subdivision under the City's zoning
regulations.
Section 2. That Article III, Section A(1)(k)(5) of
Appendix C to the Fayetteville Code of Ordinances is hereby
amended to read as follows:
(5) All money received under this paragraph shall be
deposited in an interest-bearing account. Said money,
together with the interest thereon, shall be expended
by December 31, 1990, for the acquisition of park land
that serves the subdivision for which a contribution
in lieu of dedication has been made. The City shall
keep accurate accounting records on the
use of all such money. If said money has not been
expended as provided herein by December 31, 1990, the
Planning Commission shall hold a public hearing within
sixty (60) days to determine the disposition of said
money. Seven (7) days' notice of said public hearing

shall be given by publication in a newspaper of
general circulation in the city; and the subdivider
shall be given seven (7) days' written notice of
said public hearing by certified mail, return receipt
requested. Following the public hearing, the Planning
Commission may:
(a) determine that additional park land is
needed to serve the subdivision and surrounding
area; in such event, said money may be retained
for a reasonable period specified by the Planning
Commission, but if said money is not expended as
provided herein within said period, said money,
together with the interest thereon, shall be
refunded to the subdivider; or,
(b) determine that additional park land is
not needed to serve the subdivision and sur-
rounding area; in such event, said money
together with the interest thereon, shall be
refunded to the subdivider who made the contri-
bution.
Section 3. That Article III, Section A(1)(k) of Appendix
C to the Fayetteville Code of Ordinances is hereby amended by
adding paragraph (7) to read as follows:
(7) If the requirements of thisparagraph are
shown by the subdivider to cause undue hardship as
they apply to his proposed subdivision, the Planning
Commission may grant a variance to the subdivider
from such requirements, so that substantial justice
may be done and the public interest secured; provided
that the variation will not have the effect of nulli-
fying the intent and purpose of this paragraph.
Section 4. The Board of Directors hereby determines
that the City's ordinance requiring subdividers to make
provision for public parks must be amended to conform to
the decision of the Arkansas Supreme Court in City of Fayetteville
v. IBI, Inc., 280 Ark. 44 (1983); that the provision of adequate
parks is essential to the public welfare; and that the
immediate passage of this ordinance is necessary to provide
for adequate public parks. Therefore, an emergency is hereby
declared to exist and this ordinance being necessary for the

public welfare shall be in full force and effect from and
after its passage and approval.
