HomeMy WebLinkAbout2004-08-30 - Minutes - Archiver • MINUTES OF THE SPECIAL MEETING OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS . The Housing Authority of the City of Fayetteville, Arkansas met in Special Session at 4:00 p.m., Monday, August 30, 2004, in the City Administration Building, Room 111, Fayetteville, AR. Janet Richardson, Chairperson, called the meeting to order at approximately 4:00 p.m. Commissioners Present: Janet Richardson, Robin Ross and Betty Turner Commissioners Absent: None Others Present: Fredia Sawin, Laura Higgins (Fay. Housing Auth.), Kit Williams (City of Fay.), Representatives of local Newspapers Announcement Janet Richardson formally announced the resignation of Nancy Bolin and Dusti Miller. • Ms. Ross then motioned to accept these two resignations, seconded by Ms. Richardson and carried unanimously. It was agreed that Robin Ross would be replacing Gary Garton's position with the term expiring 12/28/04 and Betty Turner would replace Randy Coleman's position which expires December 28, 2005. Discussion was made concerning the replacement of these two positions. Mr. Williams (City Attorney) gave his thoughts on the matter and further discussion was made between the board members. It was decided by all that it was important to try and replace Dusti Miller's position with another Resident Board Member. Ms. Richardson suggested getting the applicants that the city had reviewed and looking at those as possible candidates for the non-resident board member position, selecting one and remitting that name to the City for approval. Ms. Ross motioned to contact Don Marr (Councilman on the City of Fayetteville Board) to review possible candidates, seconded by Ms. Richardson and carried unanimously. Ms. Ross will contact Fredia Sawin with the information. Other Business Janet Richardson suggested training but all agreed to wait until the other board positions were filled. Ms. Richardson advised that she would honor her agreement to step down as Chairperson however, it was agreed that it would again be better to wait until all positions are filled at which time an Annual Meeting can be scheduled to elect new officers. is Mr. Williams reviewed the FOIA laws and stressed the importance of learning this law • and abiding by it. Mr. Williams advised the new board members to pick up a booklet that the City has concerning the FOIA laws and review it. Ms. Richardson stated that they also needed to decide when they would hold their regular meetings. At this time it is the third Tuesday of each month. Mr. Williams suggested removing this wording from the by-laws so it could be scheduled when it is convenient for all. There being no further business, meeting was adjourned. I only recently was appointed to the FHA in Apra, 2004, and have attended two board meetings and one twining session. I have not been involved in any meetings or decisions that would subject me to criminal or civil liability during my three-month tenure on the board. It has been brought to my attention that the Fayetteville City Council wishes to improve the FHA, and I completely support its decision if that includes a new FHA commission, free of the taint associated with any past criminal or civil sanctions. 'Therefore, for the better good of public housing in Fayetteville, I submit my resignation to assist the Fayetteville City Council in making decisions and determinations that will make the Fayetteville Housing Authority more efficient and productive. • My short tenure with the FHA began following the alleged violation of the Arkansas FOIA, and due to the fact that the Fayetteville City Council believes that perhaps a new board may be in the best interest of Fayetteville public housing, I resign my position as a commissioner of the Fayetteville Housing Authority. Even though short in nature, I have enjoyed serving on the PHA. I wish only the best for the Fayetteville Housing Authority and my fellow commissioners, and I give best wishes to the Fayetteville City Council and Mayor for their efforts to improve public housing in Fayetteville. Under Arkansas law, a tendered resignation by a public office can usually be withdrawn until officially accepted. It is with my deepest reynets that I tender my resignation from the Fayetteville Housing Authority Board of Commissioners c11''ective immediately. I have maintained that the violations committed this past April 20 were procedural in nature and not malicious acts. However, with your charges of misconduct in office based upon my Freedom of Information Act conviction, you consider the violation sufficient grounds for removal. 1 could better understand you wanting to dismiss an appointed official whose intention was to commit a crime that jeopardized the Housing Authority, instead of an act that had no direct impact upon the organization What you had was a Board with all the right intentions who made a fateful mistake las April. Personally. i thought my transgressions had been put behind us all and we were • moving positively to the future after our face-to-face meeting in executive session. I feel I was led astray because more than one Council member had encouraged me to hold firm to my civic commitment to the Housing Authority. When I learned that it was a unanimous decision to relieve me of my duties, I felt blind -sided. I have enjoyed my tenure on the Fayetteville Housing Authority Board and will take mostly positive memories with me. I have always strived to put the needs of the working poor first in my role as Commissioner, other community involvement and my employment. I look forward to the day when the current "media frenzy" will be behind us and when the important role of addressing the creeds of the residents of the Housing Authority will take center stage, Thank you for the opportunity to have served in this capacity.
