Wednesday October 13, 1999 in the office of the Authority #1 North School, Fayetteville, Arkansas. Dan Hudspeth, Chairperson, Commissioners Present: called the meeting to order. Hudspeth, Clinehens, Watson, Commissioners Absent: Childress, Richardson Others Present: Bromo Wilson, Fredia Sawin & Matt Wagner with N. W. AR Times The Minutes of the September 8, 1999 Regular Meeting were approved by motion, seconded, and carried unanimously. The September Financial Statement was approved by motion, seconded, and carried unanimously. RESOLUTION TO ESTABLISH FLAT RENTS FOR LOW-INCOME PUBLIC HOUSING HILLCREST TOWERS, LEWIS PLAZA, WILLOW HEIGHTS, & MORGAN MANOR. Resolution No. 634 was approved by motion, seconded, and carried unanimously. RESOLUTION TO ESTABLISH POLICIES ON DISCRIMINATION IN HOUSING AND SEXUAL HARASSMENT. Resolution No. 635 was approved by motion, seconded, and carried unanimously. The Board of Commissioners voted unanimously for the Fayetteville Housing Authority to donate $600 to the Single Parent Scholarship Fund. Mr Wilson mentioned to the Board that a contract should be let by the next Board Meeting for the 1999 Comp Grant Funds to install new roofs at Willow Heights. There being no further business, the meeting was adjourned. THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS ATTEST: CHAIRPERSON RESOLUTION NO. 634 RESOLUTION TO ESTABLISH FLAT RENTS FOR LOW-INCOME PUBLIC HOUSING HILLCREST TOWERS, LEWIS PLAZA, WILLOW HEIGHTS, & MORGAN MANOR WHEREAS, the Quality Housing and Work Responsibility Act requires Public Housing Authorities (PHA's) to e stablish flat rents for public housing, and WHEREAS, PHA's have several options to use in establishing flat rents, such as Section 8 Rent Reasonableness files, survey of rents advertised in local newspapers, survey of similar unassisted units and "other". The PHA has chosen to use "other" and set the flat rents at 75% of the approved current payment standards for Washington County. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS, OF THE FAYETTEVILLE HOUSING AUTHORITY, that the flat rents for Hillcrest Towers, Lewis Plaza, W illow Heights and Morgan Manor Apartments are established as follows: HC TOWERS LEWIS PLAZA W ILLOW HEIGHTS MORGAN MANOR EFF BR 1 BR 2 BR 3 BR 4 BR $230 $240 $320 $438 $240 $320 $438 $240 $320 $438 $447 BE IT FURTHER RESOLVED, that the flat rents hereby e stablished will be reviewed annually to determine if adjustments are necessary. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE FAYETTEVILLE HOUSING AUTHORTITY, that the attached Policies On Discrimination In Housing And Sexual Harrassment are established. PASSED AND APPROVED THIS /3 DAY OFG f 1999 ATTEST: C SSA S 'C ETA ¥ Y THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLL-,ARKANSAS 0 CHAIRPERSON FAYETTEVILLE HOUSING AUTHORITY POLICIES ON DISCRIMINATION IN HOUSING AND SEXUAL HARASSMENT Fair Housing It is the policy of the Fayetteville Housing Authority (FHA) to comply with the Fair Housing Act and any regulations pertaining thereto. In this regard, the FHA will not engage in unlawful discriminatory housing practices because of race, color, religion, sex, national origin, handicap, orfamilial status. Sexual Harassment The FHA will not tolerate harassment, sexual or otherwise, against any tenant or a tenant's family members by an employee of the FHA. Sexual harassment includes any unwelcome sexual advances, requests for sexual favors, or other verbal or physical conduct or written communications of a sexual nature, regardless of where such conduct might occur. Reporting Any complaint of prohibited discrimination, harassment or sexual harassment should be reported to• the Executive Director, Bromo Wilson, or to the Public Housing Manager, Fredia Sawin, at the FHA office located at #1 North School, Fayetteville, Arkansas or by telephoning them at the FHA office at (501) 521-3850. Any person who believes they have been subjected to a crime, including but not limited to assault, battery, or sexual assault should contact the Fayetteville Police Department. Investigation All complaints shall be investigated by the FHA management. The investigation shall be appropriate to the complaint, taking into consideration its seriousness, the extent to which it is or can be substantiated, and the nature of the resolution desired by the complainant. The investigation shall include interviewing the complainant and the person accused. After investigation, the FHA shall attempt an informal settlement of the complaint in accordance with the FHA grievance procedure posted at the FHA office; provided, however, if the complainant does not wish to personally appear in the informal settlement conference with the accused person, the FHA person conducting the investigation shall meet separately. The procedure under the grievance procedure shall be followed and in the event either party is not satisfied with the decision, they shall have the right to obtain a formal hearing in accordance with the FHA grievance procedure. • • • • Disclosure To the extent possible, the matter complained of will be kept confidential and shall be disclosed only to the immediate parties. However, any complainant should understand that some disclosure may become necessary. Disciplinary Action A written report of the resolution shall be made both to the person alleged and the complainant; however, the details of any discipline against an FHA employee may or may not be disclosed, depending upon the circumstances. The resolution of the complaint may include any discipline against the FHA employee, including dismissal. If substantiated, a written report of the complaint shall be kept in the file of the FHA employee. Notwithstanding anything above to the contrary, employees of FHA acknowledge that they are employees at will and may be discharged with or without cause. Retaliation No retaliation shall be taken against any tenant because of the filing of any complaint. Such retaliation may be a violation of federal law. In the event a complainant feels that there has been retaliation, it shall be reported as set forth above. Other Remedies Nothing contained herein shall preclude any complainant from any other remedies that they may have under any local, state, or federal laws or regulations pertaining to the Fair Housing laws, discrimination, or sexual harassment, including the right to contact the Department of Housing and Urban Development at (501) 324-5931 or its Fair Housing Division at (501) 324-6296. Provided, however, nothing contained herein is intended to make the FHA subject to any local, state, or federal laws to which it is not otherwise subject. Fayetteville, Arkansas 72701 Dear Bromo, The Fayetteville Housing Authority generously contributed $500 in 1998 to the Single Parent Scholarship fund of Washington County. We greatly appreciate the Housing Authority's past support and hope that a contribution of an equal or increased amount might be possible this year. Our efforts to help impoverished single parents to attend college have resulted in great success for most of those to whom we have extended our incentive scholarships. In 1999, we made 189 awards worth $85,050 to students attending the University of Arkansas, the Northwest Technical Institute, Northwest Arkansas Community College, and Har-Ber School of Nursing. According to our follow-up records, almost 70% of our recipients either remain in school or have earned their degrees. Among graduates, a full 92% report that they are employed and earning a higher than poverty -level salary. Many are now working as skilled professionals throughout northwest Arkansas, in businesses, schools, hospitals, and in government positions. Because of the 40% increase in the number of applications received this year over 1998, we are appealing to donors to help us meet the added need for scholarships among single parents by contributing at a higher level. Should the housing Authority be in a position to make a $600 contribution in 1999, it would enable us to provide more scholarships to worthy individuals.
