OF THE CITY OF FAYETTEVILLE, ARKANSAS
The Housing Authority of the City of Fayetteville, Arkansas met in Regular Session
at 8:00 A.M. Wednesday, February 28, 1990, in the office of the Authority #1 North
School, Fayetteville, Arkansas.
Clarence Fries, Chairman called the meeting to order.
Upon roll call, the following members were present:
Commissioners Present: Windham, Richardson, Hudspeth, Fries
Commissioners Absent: Morgan
Others Present: Bromo Wilson, Toady Edwards
The Minutes of the January 24, 1990 Regular Meeting, were approved by motion, seconded
and carried unanimously.
The January Financial Statement for January was approved by motion, seconded,
and carried unanimously.
RESOLUTION APPROVING A DRUG FREE WORKPLACE POLICY AND PROCEDURE. Resolution No.503,
was approved by motion, seconded, and carried unanimously.
There being no further business, the meeting was adjourned.

RESOLUTION NO. 503
RESOLUTION APPROVING A DRUG FREE WORKPLACE POLICY & PROCEDURE
WHEREAS, the Congress passed on November 18, 1989, as part of the
omnibus drug legislation, the Drug -Free Workplace Act of
1988, and
WHEREAS, the Department of Housing & Urban Development have published
certain regulations that require each Public Housing Agencies
Operating the Low Income Public Housing Programs to submit
a certification/for a Drug=F.reee Workplace (Form HUD -50070)
and such form requires that a policy be adopted,
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE FAYETTEVILLE
HOUSING AUTHORITY, that the attached Drug -Free Workplace Policy & Procedure
Peadopted .

DRUG FREE WORKPLACE POLICY & PROCEDURE
PURPOSE:
The purpose of this directive is to establish la specific policy for
dealing with controlled substance abuse in the workplace.
POLICY:
Drug use and abuse in or at the workplace is of utmost concern
Drugs in the workplace not only affect produtivity, but the
safety and the well being of all employees, the public at large,
and may result in damage to property due to impaired judgement.
Therfore, it is the policy of the Fayetteville Housing Authority
that the unlawful manufacture, distribution, dipensation, possession
or use of a controlled substance in or at the employee's workplace
is prohibited. Any employee violating this policy will be disciplined
up to and including termination.
"Controlled substance" is defined as any drug listed in 21 U.S.C.
Section 812 and other Federal Regulations. Generally, these are
drugs which have a high potential for abuse. Such drugs include,
but are not limited to heroin, marijuana, cocaine, PCP, and "crack".
Also included are "legal drugs" which are not prescribed by a licensed
physician.
There raill'be no distinction drawn between drug users and drug pushers
or sellers. Any employee who gives or in and way transfers a controlled
substance to another person or sells or manufactures a controlled substance
while on the job or at the workplace is subject to discipline up to and
including termination.
REQUIREMENTS AND PROCEDURES:
1. The Fayetteville Housing Authority requires that all employees,
as a condition of employment or continued employment, execute a
"drug free workplace •policy acknowledgement statement"
(Attachment A). The statment is required by the federal government
for employees directly engaged in the performance of work pursuant to
federal grant and/or contract, and the Fayetteville Housing Authority
requires this statement for all employees.
2. The signed and dated original statment is to be kept in the employee's
personnel file in the Personnel Office, with a copy being kept by each
employee's supervisor.

3. All employees must abide by the terms of the statement.
4. Notification must be made to the Fayetteville Housing Authority,
through his/her immediate supervisor, of any criminal drug
statute conviction for a violation occuring in the workplace
no later than five (5) days after such conviction.
5. The supervisor of an employee so convicted must immediately
report the conviction to his/her management. The Fayetteville
Housing Authority must notify the granting agency within ten
(10) days after receiving notice from the employee of a
conviction.
6. Within thirty (30) days of receiving notice of a drug statute
conviction from an employee, appropriate disciplinary action
against the employee up to and including termination, must have
been effected and/or the employee required to participate
satisfactorily in a drug abuse assistance or rehabilitation
program approved for such purpose by a federal, state, or local
health, law enforcement, or other appropriate agency.
DRUG FREE WORKPLACE CERTIFICATION:
The granting agency will require a certification of a drug free workplace
pursuant to the Drug Free Workplace Act of 1988. The granting agency form
will be the same or similar to the HUD form included as an exhibit. This
certification must be completed and submitted to the agency as a prior
condition to being awarded a grant.

Housing Authority hereby certify that I have received a copy of
and have read and understand Administrative Policy and Procedure,
the Fayetteville Housing Authority's policy of maintaining a drug
free workplace. I realize that the unlawful manufacture, distrubution
dispensation, possession or use of a controlled substance is prohibited
on or in the premises of my workplace and violation of this policy
can subject me to discipline up to and including termination. I
realize that as a condition of employment on.la federal ;grant on:contract,
I must abide by the terms of the policy and shall notify my employer
of any criminal drug conviction I receive for a violatign occuring
in the workplace no later than five (5) days after conviction. I
further realize that federal law requires that my employer inform
the federal agency (grantor) of a conviction within ten (10) days
of having received such notice, and I hereby waive any and all claims
that may arise for conveying this information to the federal agency.
