MINUTES OF REGULAR MEETING OF THE HOUSING AUTHORITY
OF THE CITY OF FAYETTEVILLE, ARKANSAS
The Housing Authority of the city of Fayetteville, Arkansas
met in Regular session at 8:30 a.m., September 16, 1981, in
the office of the Authority, #1 North School, Fayetteville,
Arkansas.
Upon Roll Call, the following were present:
Commissioners Present: Robert Windham, Lloyd Seaton, Sherman
Morgan, Judy Endress, and Jim Shreve
Commissioners Absent:
Others Present: Chad Kumpe, Bromo Wilson, Newton Hailey, Pat
Donate and Betty Jordan
There being a quorum present, the following business was trans-
acted:

Mr. Seaton moved the

The July Financial Statement. Mr. Seaton moved the approval,
seconded by Mr. Morgan, motion carried.
The Minutes of the Special Meeting of August 25, 1981. Mrs. Endress
moved that the minutes be approved as written, seconded by Mr.
Shreve, and motion carried.
The August Financial Statement. Mr. Seaton moved the approval,
seconded by Mr. Morgan, motion carried.
RESOLUTION AUTHORIZING THE WRITE-OFF OF CERTAIN NON -EXPENDABLE
EQUIPMENT LOST, DESTROYED, OR ABANDONDED. Mr. Seaton moved
approval, seconded by Mrs. Endress, motion carried.
RESOLUTION TO CHARGE OFF DELINQUENT RENTS. Mr. Shreve made the
motion, seconded by Mr. Seaton, motion carried.
RESOLUTION. AUTHORIZING THE AWARD OF THE LOW BIDDER SUBJECT TO HUD
APPROVAL AND PROVISION FOR THE EXECUTION OF THE CONSTRUCTION
CONTRACT ARK. 97-2. Mr. Seaton made the motion, seconded by
Mrs. Endress, motion carried.
RESOLUTION AUTHORIZING EXECUTION, RECORDING AND DELIVERY OF
" DECLARATION OF TRUST ". Mr. Shreve made the motion, seconded
by Mr. Morgan, motion carried.

RESOLUTION OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE.
TO PURCHAS THE ACRES AT ELEVENTH AND WILLOW, FROM THE CITY OF
FAYETTEVILLE. Mr. Seaton made the motion, seconded by Mr. Shreve,
motion carried.
Other Business:
After further discussion the meeting was adjourned.

RESOLUTION AUTHORIZING THE WRITE-OFF OF CERTAIN
NON -EXPENDABLE EQUIPMENT LOST, DESTROYED, OR ABANDONED
WHEREAS, the HUD Manual 7510.1 and 7511.1 provide for the write-off of
certain non -expendable equipment that is lost, destroyed or
abandoned, and
WHEREAS, the most recent physical inventory declares certain property
that needs to be written off
NOW THEREFORE BE IT RESOLVED BY THE COMMISSIONERS OF THE HOUSING AUTHORITY
OF THE CITY OF FAYETTEVILLE, that the following equipment be
written off the property ledger of the Housing Authority of
the City of Fayetteville

RESOLUTION TO CHARGE OFF DELINQUENT RENTS
A Resolution of the Board of Commissioners of the Housing
Authority of Fayetteville, Arkansas authorizing the charge off of
delinquent rents of certain former tenants in the ARK 97-1 Project
for period of October 1, 1980 to September 30, 1981
WHEREAS, in accordance with the Accounting Handbook RHM 7510.0,
Chapter 3, Section 13, certain past due accounts in the ARK 97-1
Low Rent Housing Project are considered uncollectable and all means
of collections have been exhausted, and there is no resonable prospect
of collection of such delinquent rents and that the probable cost of
further efforts to collect said rents would not be warranted;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS
OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, THAT:
The rents in the amounts designated, due from the former
tenants listed on the attached sheet are hereby authorized
to be charged off.

RESOLUTION AUTHORIZING THE AWARD TO THE LOW BIDDER SUBJECT
TO HUD APPROVAL AND PROVISION FOR THE EXECUTION OF THE
CONSTRUCTION CONTRACT UPON HUD APPROVAL OF PROJECT
ARK 097-002
WHEREAS, the commissioners of the Fayetteville Housing Authority
(herein called the "Housing Authority") have received sealed bids for
the construction of Project No. ARK. 097-002, which bids have opened,
tabulated, and found to be in proper form: and,
WHEREAS, the architect has recommended the acceptance of the bid
of Harrington Construction as the lowest and best bid.
NOW THEREFORE BE IT RESOLVED by the Commissioners of the Housing
Authority of the city of Fayetteville, Arkansas:
S ection 1. Harrington Construction Company are the apparent
✓ esponsible low bidder and the low bid is in the
amount of $ 1,395,000.00.
S ection 2. The Housing Authority recommends to the department
o f Housing & Urban Development (herein called "HUD")
that approval be given for the award of the contract
to the apparent responsible low bidder
S ection 3. Upon receipt of the written approval of HUD in the
award, (a) the chairman is hereby authorized to
notify the low bidder in writing of the award, and
set the date and time for execution of the contract,
and (b) said chairman is also directed and authorized
to execute the contract.
S ection 4, That Chad Kumpe, Executive Director of the Housing
Authority is hereby appointed to serve as contracting
o fficer for the construction of the project for the
Housing Authority. The contracting officer is also
delegated the authority to execute any and all change
o rders, supplemental agreements (limited by the policies,
rules and proceedures as set forth by HUD) affecting the
main construction contract as approved in section 3.

RESOLUTION AUTr'.ORIZING EXECUTION, RECORDATION
AND DELIVERY OF DECLARATION OF TRUST
•
WHEREAS, the HOUSING AUTHORITY OF THE CITY OF FAYETTEVIL•LE, ARKANSAS
(herein called the "Local Authority"), pursuant to
the Annual Contributions Contract' between the Local Authority and the

United States of America, has agreed to execute and record a Declaration
of Trust confirming and further evidencing, among other things, the
covenant of the Local Authority not to convey or encumber the Project(e)
covered by said Declaration of Trust, except as in the said Annual
Contributions Contract expressly authorized.
NOW, THEREFORE, BE IT RESOLVED by the Local Authority as follows:
1. The proper officers of the Local Authority are hereby autho-
rized and directed to execute and have acknowledged before a Notary
Public a Declaration of Trust.
2. The proper officer of the Local Authority is hereby authorized
and directed to record said Declarntion of Trust in the office of the
proper County official in which documents are filed for record, end to
deliver to the Department of Housing and Urban Development such copies
of said Declaration of Trust as may be requested.
3. The Declaration of Trust referred to in Sections 1 and 2 hereof

OF THE
HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE
WHEREAS, the Housing Authority of the City of Fayetteville,
Arkansas, has received the sum of One Hundred Thousand Dollars
($100,000.00) in contemplation of purchase of property to
construct fifty-two (52) low rental housing units, and
WHEREAS, the Housing Authority of the City of Fayetteville,
Arkansas, through its director, did deposit said sums in a certificate
of deposit with First Federal Savings & Loan Association of Fayette-
ville, Arkansas on August 17, 1981, and
WHEREAS, said certificate of deposit will not mature until
• October 17, 1981 (said certificate number being 52396), and
WHEREAS, said funds should not be withdrawn prior to October
17, 1981 in order to avoid loss of interest, if possible, and
WHEREAS, the Housing Authority of the City of Fayetteville,
Arkansas, desires to close its real estate transaction for the
purchase of the aforementioned land and thereby obtain a Deed
from the City of Fayetteville, Arkansas, the present title holder,
and
WHEREAS, the Housing Authority of the City of Fayetteville,
Arkansas, should endeavor to enter into an agreement with the
City of Fayetteville, Arkansas to immediately obtain the Deed to
the property and pledge that portion of the funds remaining in
the certificate of deposit and pledge payment for the property
• from the account with interest from the date of the Deed until date
of maturity payable to the City of Fayetteville, Arkansas,

NOW THEREFORE, BE IT RESOLVED, that the Housing Authority of
the City of Fayetteville,' Arkansas negotiate with the City of
Fayetteville, Arkansas for the right to obtain title to the property
and forego payment of the Eighty Thousand Dollars ($80,000.00) due
on purchase price until maturity of the aforementioned certificate
of deposit with the provision that the City of Fayetteville, Arkansas
would receive interest from the date of the deed until the date
of the maturity of the certificate of deposit on their pro -rata
share as it applies to interest accrued thereon, and the Director
should take all steps necessary to effectuate said agreement.
