MINUTES OF REGULAR MEETING OF THE HOUSING AUTHORITY
OF THE CITY OF FAYETTEVILLE, ARKANSAS
The Housing Authority of the City of Fayetteville, Arkansas
met in Regular Session at 8:30 a.m.,•Wednesday, November 19, 1980
in the office of the Authority, #1 North School, Fayetteville,
Arkansas.
Upon Roll Call, the following were present:
Commissioners Present: Endress, Morgan, Shreve
Commissioners Absent: Windham, Seaton
Others present: Chad Kumpe, Bromo Wilson, Coretta Edwards - Tenant
'Supervison, Betty Jordan.- Secretary
There being a quorum present, the following business was transacted:
The minutes of the October 9, 1980 Regular Meeting were approved
by motion of Ms. Endress, seconded by Mr. Morgan and carried unanimously.
The minutes of the October 28, 1980 Special Meeting were approved
as mentioned, by motion of Ms. Endress, seconded by Mr. Morgan and
carried unanimously.
After discussion, the October Financial Statement was approved by
motion of Mr. Shreve, seconded by Ms. Endress and carried unanimously.
The Housing Authority Commissioners discussed the Option's on the Sites.
The commissioners also discussed Liability Insurance for Commissioners,
and the purchase of A maintenance truck, motion made by Ms. Endress, to
purchase the Chevrolet truck (upon stipulation of Mr. Windham, and
Mr. Seaton) seconded by Mr. Morgan and carried unanimously.
Other business discussed were commants from HUD report on the renuel of
leases being signed, and the credit given to tenants for childcare when
only one parent is employed.

RESOLUTION TO ADMEND ANNUAL CONTRIBUTION CONTRACT NO. 7031 FOR ARK. 97-1
Resolution No. 333 was passed and approved by motion of Ms. Endress, se'
conded by Mr. Morgan and carried unanimously.

RESOLUTION NO. 333
RESOLUTION TO ADMEND ANNUAL CONTRIBUTION CONTRACT NO. 7031 FOR ARK. 97-1
WHEREAS, the Department of Housing and Urban Development has requested
an admendment to the annual contributions contract and,
WHEREAS, such admendment is attached to this Resoultion now.
NOW THEREFORE, be it resolved that`the admendment be executed by the
Chairman and the Secretary of the Fayetteville Housing Authority.

AMENDATORY AGREEMENT NO. 3
TO ANNUAL CONTRIBUTIONS CONTRACT

THIS AGREEMENT, entered into as of the day of , 19 , between the
:UNITED STATES OF AMERICA (herein called "Government"), and Housing Authority nf the
City of Fayetteville, (herein called "Local Authority"):

1. WHEREAS, pursuant to the United States Housing Act of 1937, as amended (42 USC 1437,
et. seq.), and the Department of Housing and Urban Development Act (42 USC 3531), the
Government and the Local Authority entered into an Annual Contributions Contract on
ing
the 14 day of July , 19.2b for the purpose of financing low-income hous- other purposes; and
2. WHEREAS, Section 5(a) of the United States Housing Act provides that the Government
may make annual contributions to public housing agencies to assist in achieving and
maintaining the low-income character of their projects over a period not to exceed
forty years; and Section 9(a) provided that the Secretary may make additional annual
contributions to public housing agencies for the operation of low-income housing
projects; and
WHEREAS, Section 211(a) of the Housing and Community Development Amendments of 1979
(Public Law 96-153) amended Section 9(a) of the United States Housing Act to pro-
vide that any contract for contributions for the operation of low-income housing
"shall provide that no disposition of the low-income housing project, with respect
to which the contract is entered into, shall occur during and for ten years after
the period when contributions were made pursuant to such contract unless approved
by the (Government);" and further amended Section 9(a) to provide that the Government
may provide assistance for the operation'of a low-income housing project as long as
the low-income nature of the project is maintained;.
NOW THEREFORE:
'In order to comply with the above amendments to the United States Housing Act, the contract
is amended as follows:
Notwithstanding any other provision of this contract, no disposition of any low-income
housing project covered by this contract shall occur during and for ten years after the
period when contributions' were made for the operation of the project, unless approved by
the Government. In addition, the Government agrees to provide assistance for the opera-
tion of any such project; as provided by Section 41S of this contract, as long as the
low-income nature of. the project is maintained. The provisions of Articles II, III, IV
and V of this contract, relating to operation, are hereby extended for the duration of
such assistance.
WIN WITNESS WHEREOF, the parties have caused this Agreement to be executed in their respec-
tive names and the Local Authority has caused its seal to be hereunto affixed and attested
as of the date first above written.

The Atlanta International Insurance .Company has made their filing
with the' State. of Arkansas Insurance Department. If your indivi-
dual housing .authority. decides to purchase this coverage, Hornor
Woods Adams will submit the completed and signed application to
the insurance' 'company who has the right to deny coverage to any
housing authority. Coverage .would become effective the date the
Arkansas Insurance Commission approves the company filing, or if
after approval, the date the' company accepts the application.
