Upon roll call, the following were present: Commissioners Present: Taylor, Endress, Gould, Underwood Commissioners Absent: Morgan Others Present: Chad Kumpe, Bromo Wilson, Pat Donat, Fredia Sawin The Chairman ordered that the following Waiver and Consent be spread upon the Minutes: WAIVER OF NOTICE OF AND CONSENT TO SPECIAL MEETING We, the undersigned, do hereby accept notice of this SPECIAL MEETING, waiving any and all irregularities in the service of notice and do hereby consent and agree that the Commissioners of the Housing Authority of Fayetteville, Arkansas shall meet at their regular meeting place at 8:30 o'clock a.m., on the 30th day of November, 1978 for the following purposes: 1. Roll Call 2. A Resolution of the Board of Commissioners of the Housing Authority of the City of Fayetteville Arkansas, Establishing updated Fair Market Values for Acquisition of Land -Project AR R-105 3. Resolution Approving Application for Preliminary Loan for Low -Rent Public Housing /s/ William G. Underwood /s/ Phillip Taylor /s/ Judy Endress /s/ J. W. Gould There being a quorum present, the following business was transacted: I RESOLUTION NO. 300 RESOLUTION APPROVING APPLICATION FOR PRELIMINARY LOAN FOR LOW -RENT PUBLIC HOUSING • Chad mentioned to the Board. that the Little Rock HUD Office had approved the 52 Turnkey Housing Units and the $10,400 Budget now it is the Fayetteville Housing Authority's turn to approve. Resolution # 300 was approved by motion of Mr. Taylor, seconded by Mr. Gould and carried unanimously. • • RESOLUTION NO. 301 A RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE ARKANSAS, ESTABLISHING UPDATED FAIR MARKET VALUES FOR ACQUISITION OF LAND—PROJECT AR R-105 After discussion the following parcels were accepted at their highest appraisal. THE HOUSING AUTHORITY OF THE CITY OF FAYECLEVILLE, ARKANSAS ur ar t-SSECRETAR J✓� V K RESOLUTION NO. 300 RESOLUTION APPROVING APPLICATION FOR PRELIMINARY LOAN FOR LOW -RENT PUBLIC HOUSING WHEREAS, it is the policy of this locality to eliminate substandard and other inadequate housing, to prevent the spread of slums and blight, and to realize as soon as feasible the goal of a decent home in a suitable living environment for all of its citizens; and WHEREAS, under the provisions of the United States Housing Act of 1937, as amended, the United States of America, acting through the Secretary of Housing and Urban Development (herein called the "Government"), is authorized to provide financial assistance to local public housing agencies for undertaking and carry- ing out preliminary planning of low -rent housing projects that will assist in meeting this goal, and WHEREAS, the Act provides that there shall be local determination of need for low -rent housing to meet needs not being adequately met by private enterprise and that the Government shall not make any contract with a public housing agency for preliminary loans for surveys and planning in respect to any low -rent housing projects unless the governing body of the locality involved has by_resolution approved the application of the public housing agency for such preliminary loan; and - 4 WHEREAS, the Housing ,:Authority of the City of Fayetteville, Arkansas (herein called the "Local Authority") is a public housing agency and is applying to the Government for a.preliminary loan to cover the costs of surveys and planning in connection with the development of low -rent housing; NOW THEREFORE, be it resolved by the Board of Commissioners of the Housing Authority of the City of Fayetteville, ARK as follows: 1. Thatthere exists in the City of Fayetteville, Ark need for such low -rent housing which is not being met by private enterprise; 2. That the application of the Local Authority to the Government for a preliminary loan in an amount not to exceed $10,400 for surveys and planuing in connection with low -rent housing projects of not to exceed approximately 52 dwelling units is hereby approved. PASSED AND APPROVED THIS . - rt ATTEST_` e '`fr 9'D'`'*C DAY OF �j77j..�y,.p� - THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS SECRETARY.../ • • • RESOLUTION NO. 301 A RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE ARKANSAS, ESTABLISHING UPDATED FAIR MARKET VALUES FOR ACQUISITION OF LAND -PROJECT AR R-105 WHEREAS, the Housing Authority of the City of Fayetteville, Arkansas is prepared to acquire certain properties in conjunction with the Center Square Urban Renewal Project, ARK R-105; and WHEREAS by Resolution # 279 passed the 15th day of February, 1978, the Authority did establish fair market values for parcels 15-C, 15-D, 15-E, 15F based on independent appraisals dating 11/4/76, 2/1/77, 5/15/77;and WHEREAS, the Housing Authority realizes that these appraisals need to be updated because of the time period elapsed and where the Housing Authority admended Urban Renewal plan has been recently approved so the Authority can proceed with acquisition of these parcels, and; WHEREAS the Authority has secured at least, two independent updated app- raisals on said properties now being considered; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE ARKANSAS, THAT; 1. The attached schedule of values are hereby adopted. 2. R-105 I, Chad Kumpe, the duly appointed, qualified, and Executive Director of the Housing Authority of the City of Fayetteville, Arkansas, herein called the "Local Public Agency", hereby certify that I have been authorized by Resolution No. 301, duly adopted by the Board of Commissioners of the Local Public Agency, to make the following certification and that the statements contained herein are true and correct to the best of my knowledge and belief: Each Parcel, Center Square Urban Renewal Area, Project No. Ark. R-105 listed in the attachment to this proclaimer certificate has been appraised by at least two qualified, independent, professional real estate appraisors and a written and signed copy of each such appraisal is contained in the Local Public Agency files. Each such appraisal has been reviewed by Chad Kumpe, a qualified Local Public Agency real estate advisor on the Local Public Agency staff, and all corrections, revisions, or additions requested by such reviewer have been made by the original appraisor. The reviewer has prepared a written report which indicates that the appraisals are complete and consistent in the factual data contained therein, comply with existing statutory and administrative, and are acceptable for the determination of fair market value. Based upon such appraisals and the review thereof, the Local Public Agency has established the fair market value for each parcel listed herein and all documentation related to such determination is contained in the Local Public Agency files. The latest budget amount allowable for real estate'acquisition including amounts available in contingencies as approved by HUD on August 6, 1978, is not exceeded by the sum of the following: Cost of property previously acquired. b. Acquisition prices previously approved by HUD for properties not acquired. c. Fair market value determinations previously made by the LPA for properties not acquired but included in prior proclaimer certificates. d. Fair market value determinations for properties included in the proclaimer being filed. e.
