HomeMy WebLinkAbout1971-10-12 - Minutes - Archive0 MINUTES OF SPECIAL MEETING OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS A Special Meeting of the Housing Authority of the City of Fayetteville, Arkansas, was held on Tuesday, October 12, 1971, at 12:00 noon in Room 271, Downtown Motor Lodge, 21 South College, Fayetteville, Arkansas. The meeting was called to order and upon roll call the following members were present: Messrs: Whillock, Shelton, Baxter, Gould and Douglas Absent: None Also Present: David Faught, Ora Belle Rollow, Hugh Kincaid and Wesley Howe The Chairman ordered that the following Waiver and Consent be spread upon the Minutes: WAIVER OF NOTICE OF AND CONSENT TO SPECIAL MEETING • We, the undersigned, do hereby accept notice of this SPECIAL Meeting, waiving any and all irregularities in the service of notice and do hereby consent and agree that the Commissioners of the Housing Authority of Fayetteville, Arkansas shall meet in Room 271, Downtown Motor Lodge, Luncheon Meeting at 12:00 Noon, on the 12th day of October, 1971, for the following purposes. 1. Review of the Urban Renewal Plan, 2. Resolution approving the Urban Renewal Plan and Feasibility of Relocation for ARK R-105. 3. Approval of Cooperation Agreement bet- ween the Housing Authority and the University of Arkansas relative to Project ARK R-105. 4. Approval of Cooperation Agreement between the Housing Authority and the City of Fayetteville relative to Pro- ject ARK R-105. • 2 - S. Douglas There being a quorum present, the following business was transacted: After a review of the Urban Renewal Plan by David Faught the Chairman presented Gould and the vote Resolution #70 (copy attached): APPROVING AN URBAN RENEWAL PLAN AND CONDITIONS UNDER WHICH RELOCATION PAYMENTS WILL BE MADE FOR PROJECT N0, ARK. R-105 ' After discussion, Resolution #70 was adopted by motion of Mr. Shelton, seconded by Mr. Gould and the vote recorded: AYES: Whillock, Baxter, Gould, Shelton and Douglas NAYS: None The Chairman thereupon declared the motion carried and Resolution adopted unanimously. The Chairman presented Resolution #71 (copy attached): RESOLUTION APPROVING ENTERING INTO A COOPER- ATION AGREEMENT WITH THE UNIVERSITY OF ARK- ANSAS TO PROVIDE SECTION 112 NONCASH LOCAL GRANTS-IN-AID FOR PROJECT ARK. R-105 After discussion, Resolution #71 was adopted by motion of Mr. Douglas, seconded by Mr. Baxter and the vote recorded: AYES: Whillock, Baxter, Shelton, Douglas and Gould NAYS: None �7 - 3 - The Chairman thereupon declared the motion carried and Resolution adopted unanimously. The Chairman introduced Resolution #72 (copy attached): RESOLUTION APPROVING ENTERING INTO A COOPER- ATION AGREEMENT WITH THE CITY OF FAYETTEVILLE, ARKANSAS FOR PROJECT ARK. R-105 After discussion, Resolution #72 was adopted by motion Mr. Baxter, seconded by Mr. Shelton and the vote recorded: AYES: Whillock, Baxter, Shelton, Gould and Douglas NAYS: None The Chairman thereupon declared the motion carried and Resolution adopted unanimously. The Chairman presented Resolution #73 (copy attached): RESOLUTION OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS AUTHORIZING ' THE ACQUISITION OF A MAINTENANCE VEHICLE After discussion, Resolution #73 was adopted by motion of Mr. Gould, seconded by Mr. Douglas and the vote recorded: AYES: Whillock, Gould, Douglas, Shelton and Baxter NAYS: None The Chairman thereupon declared the motion carried and Resolution adopted unanimously. The Chairman presented Resolution #74 (copy attached): RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTE- VILLE, ARKANSAS AUTHORIZING THE HOLDING OF A PUBLIC HEARING IN CONJUNCTION WITH PROJECT ARK, R-105 After discussion, Resolution #74 was adopted by motion of Mr. Douglas, seconded by Mr. Shelton and the vote recorded: AYES: Whillock, Douglas, Shelton, Gould and Baxter NAYS: NONE 4 - There being no further business the meeting adjourned.'' i ATTEST: 1NG6�/2e 2Pz Secretary • APPROVED: i Chairman i I i RESOLUTION NO. 70 • RESOLUTION OF HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS APPROVING AN URBAN RENEWAL PLAN AND CONDITIONS UNDER WHICH RELOCATION PAYMENTS WILL BE MADE FOR PROJECT NO. ARK. R - 105 WHEREAS, in connection with an application of the Housing Authority of the City of Fayetteville, Arkansas to the Secretary of Housing and Urban Development for financial assistance under Title I of the Housing Act of 1949, as amended, the approval by the Governing Body of the Housing Authority of the City of Fayetteville, Arkansas of an Urban Renewal Plan for the project area involved in such application is required by the Federal Government before it will enter into a contract for loan or grant with the Housing Authority of the City of Fayetteville, Arkansas under Title I; and WHEREAS the rules and regulations prescribed by the Federal Government pursuant to Title I require that the conditions under which the Housing Authority of the City of Fayetteville, Arkansas will make relocation payments in connection with the Urban Renewal Project con- templated by the application and be officially approved by the Govern- ing Body of the Housing Authority of the City of Fayetteville, Arkansas; and WHEREAS there was presented to this meeting of the Govern- ing Body of the Housing Authority of the City of Fayetteville, Arkan- sas, for its consideration and approval, a copy of an Urban Renewal Plan for the project area, dated March 19, 1971, which Plan is entitled "Urban Renewal Plan for Center Square," and consists of 44 pages and three exhibits and 12 pages of definitions of terms for the project area in the aforementioned project and a set of conditions under which the Housing Authority of the City of Fayetteville, Arkansas will make Relocation Payments, which set of conditions is set forth in the Reloca- tion Program and attached hereto and marked for the Urban Renewal Pro- ject contemplated by the application; and WHEREAS the Urban Renewal Plan and the conditions under which the Local Public Agency will make Relocation Payments were reviewed and considered at the meeting; and . WHEREAS Title VI of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, color or national origin under any program or activity receiving Federal financial assistance and Executive Order 11063 prohibits discrimination on basis of race, color, creed or 0 0 national origin in sale, lease or other disposition of residential property (including land intended for residential use) or in the use or occupancy thereof: NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE. ARKANSAS: 1. That the conditions under which the Local Public Agency will make Relocation Payments are hereby in all respects approved. 2. That.the Urban Renewal Plan is hereby in all respects approved and the Executive Director is hereby directed to file a certified copy of the Urban Renewal Plan with the minutes of this meeting. 3. That it is hereby found and determined that the objectives of the Urban Renewal Plan cannot be achieved through more extensive re- habilitation of the Project area. 4. That the United States of America and the Secretary of Housing and Urban Development be, and they hereby are, assured of full •compliance by the Housing Authority of the City of Fayetteville, Arkansas with regulations of the Department of Housing and Urban Development effectuating Title VI of the Civil Rights Act of 1964 and applicable Executive Orders. RESOLUTION NO. 71 RESOLUTION APPROVING ENTERING INTO A COOPERATION AGREEMENT WITH THE UNIVERSITY OF ARKANSAS TO PROVIDE SECTION 112 NONCASH LOCAL GRANTS-IN-AID FOR PROJECT ARK R-105. WHEREAS, the Housing Authority of the City of Fayetteville, Arkansas has filed an application for a Loan and Grant pursuant to Title I of the Housing Act of 1949, as amended; and WHEREAS, pursuant to Section 112 of the aforementioned Act certain expenditures made in behalf of colleges and universities may be used to offset the local share of expenditures required by said Act; and WHEREAS, there exists $1,292,225 of eligible local noncash grants-in-aid which the Housing Authority of the City of Fayetteville desires to secure for the Center Square Urban Renewal Project, ARK R-105. NOW, THEREFORE, BE IT RESOLVED by the Housing Authority of the City of Fayetteville, Arkansas: • Section I. That the attached Cooperation Agreement between the Housing Authority of the City of Fayetteville, Arkansas, and the University of Arkansas is hereby approved and adopted. Section 2. The Chairman of the Board of Commissioners and the Secretary of the Housing Authority of the City of Fayetteville, Arkansas, are hereby authorized and directed to execute said agree- ment. ATTEST: • Secretary APPROVED: i E RESOLUTION N0, 72 RESOLUTION APPROVING ENTERING INTO A COOPERATION AGREEMENT WITH THE CITY OF FAYETTEVILLE, ARKANSAS FOR PROJECT ARK R-105 WHEREAS, the Housing Authority of the City of Fayetteville, Arkansas has filed an application for a Loan and Grant pursuant to Title I of the Housing Act of 1949, as amended; and WHEREAS, it is required by the Department of Housing and Urban Development that a Cooperation Agreement be executed be- tween the City of Fayetteville, Arkansas and the Housing Authority. NOW, THEREFORE, BE IT RESOLVED by the Housing Authority of the City of Fayetteville, Arkansas: Section I. That the attached Cooperation Agreement between the Housing Authority of the City of Fayetteville, Arkansas, and the City of Fayetteville is hereby approved and adopted. Section 2. The Chairman of the Board of Commissioners and • the Secretary of the Housing Authority of the City of Fayetteville, Arkansas, are hereby authorized and directed to execute said agree- ment. PASSED and APPROVED this ATTEST: 0 Secretary 12 day of October , 1971, APPROVED: A 101wo � RESOLUTION NO. 73 RESOLUTION OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS AUTHORIZING THE ACQUISITION OF A MAINTENANCE VEHICLE WHEREAS, the Housing Authority of the City of Fayette- ville, Arkansas, has under construction -or management 200 units of low rent public housing; and WHEREAS, there exists a need to acquire a vehicle to accomplish various maintenance activities; and WHEREAS, the Housing Authority has invited proposals for supplying said vehicle from various firms in the City of Fayetteville; and WHEREAS, Whit Chevrolet Company, Inc., has submitted the lowest bid for a 1972 one-half ton pickup equipped as specified: NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE HOUSING AUTHORITY OF THE CITY OF FAY- ETTEVILLE, ARKANSAS: • 1. That it is hereby found and determined the bid of Whit Chevrolet Company, Inc., is in compliance with the terms specified by the Housing Authority of the City of Fayetteville. 2, The Executive Director of the Housing Authority is hereby authorized to acquire a pickup truck and necessary optional equipment for an amount of $3,123.80. R-105 WHEREAS, under the provisions of Title I of the Housing Act of 1949, as amended, the Housing Authority of the City of Fayetteville, Arkansas, is required to conduct a public hearing prior to undertaking and carrying out an urban renewal project; and WHEREAS, the Chairman of the Housing Authority has tentatively established October 19, 1971, as the date of the public hearing. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE FAYETTEVILLE HOUSING AUTHORITY: • ATTEST: 1. That the Notice of Public Hearing attached hereto is hereby adopted by the Authority. 2. That this notice shall be published in such a manner as to conform to all local, state and federal requirements. 3. Secretary APPROVED: PAN P E COOPERATION AGREEMENT THIS AGREEMENT made and entered into this day of 19 by and between the Housing Authority i of the City of Fayetteville, Arkansas, a public body corporate and politic, hereinafter called the Authority, and the University of Arkansas, an educational institution of the State of Arkansas, here- inafter called the University. WITNESSETH: WHEREAS, the Authority is a public body created under and by virtue of the Arkansas law and as such transacting business and exercising the powers granted to it by law and by virtue of Resolu- tion No. 20165 adopted by the City of Fayetteville, a municipal corporation of the State of Arkansas, hereinafter called the City, at its City Council Meeting on the 29th day of December, 1965; and WHEREAS, the Authority, with the aid and cooperation, of the City has undertaken and is now carrying out an urban renewal program in the City in accordance with Arkansas law known as the Center Square Urban Renewal Project pursuant to Resolution No, and by the City on the day of 19 ; WHEREAS, the Authority has entered into contracts with the United States of America acting by and through the Department of Housing and Urban Development pursuant to which the United States of America has advanced or provided for the advance of the sum of TWO HUNDRED EIGHT THOUSAND FOUR HUNDRED and FIFTY-ONE DOLLARS ($208,451.00) pursuant to Title I of the Housing Act of 1949, as amended, to aid in financing the costs of certain surveys and plans for the clearance, preparation and disposition of the Center Square Urban Renewal Project hereinafter called the Project; .and WHEREAS, t:^.e Authnrity'propose.s in carrying out the Project to acquire property and improvements thereon within an area in the City described as follows: TrrFan — .•r..te-+zcse..n.+�-;r. �-"��-.-: ro•�v�.. .e-*�----.�•rc.c�c.>..c-. .mer - 2 .and _. 11 . WHEREAS, the Authority proposes to enter into one or more additional contracts with the said Department of Housing and Urban Development and thereby obtain additional Federal Assistance under said Title I of the Federal Act consisting of loans and cash grants, which agreements and contracts will require the City to provide local grants-in-aid to make up one-fourth of the net cost of completing said urban renewal project; and WHEREAS, the City is willing and able to provide said local grants-in-aid and cash grants in such amount or amounts as may be..required to earn the full Federal grant payable under • the Federal Act with respect to the Project; and WHEREAS, the Authority by its Resolution No, adopted and approved the development plan for the project in all respects, on day of 19 , said Plan being dated and the City likewise approved said Plan on the day_of , 19 NOW THEREFORE, in consideration of the premises and the mutual covenants hereinafter set forth, the Authority and the University agree:` I . 1. The Authority agrees to diligently and forthwith proceed with all actions, work and undertakings to carry out the Project, to enter into a contract or contracts with the United States of'America acting by and through the Department of Housing and Urban Development for a loan or loans and a capital grant available and authorized under Title I of the Federal Actin such amounts which together with the local grants-in-aid shall be sufficient to carry out the Project. 2, The University hereby agrees to contribute to the Pro- ;ect the following noncash local grants-in-aid: a. The University and the Authority hereby recognize and agree that Title VI of the Civil Rights Act of 1964, and the regulations of the Department of Housing and Urban Development effectuating that Title, provide that no person shall, on the ground of race, color, or national origin, be excluded from parti- cipation in, be denied the benefits of, or be subjected to discrim- ination in the undertaking and carrying out of urban renewal pro- jects as issued under Title I of the Housing Act of 1949, as amended. WITNESSETH: WHEREAS, the Agency is a public body corporate and politic, created bythe laws of the State of Arkansas pertaining thereto and • is transacting business and exercising the powers granted by said laws by virtue of Resolution No. 20-65, duly passed and adopted by the City Council of the City of Fayetteville,.Arkansas, on the V 20th day of December, 1965; and WHEREAS the Agency with the aid and cooperation of the City, proposes to undertake and carry out an urban renewal program in the City of Fayetteville, known as the Center Square Urban Renewal Project, ARK R-105 (hereinafter called the "Project") in . accordance with the Urban Renewal Plan therefor, heretofore approved by the City Board of Directors (formerly City Council) bearing the date of March 19, 1971, and pursuant to the provisions of the laws of the State of Arkansas as hereinabove referred to; and WHEREAS the Agency proposed in carrying out the Urban Renewal Plan for said Project to rehabilitate and/or acquire cer- tain properites and improvements thereon with the Project Area, as provided for in said Urban Renewal Plan; and WHEREAS the Agency proposes to enter into a Loan and Capital Grant Contract with the Department of Housing and Urban )eveiopment, an Agency of the United St tes of America, providing for financial assistance pursuant to Title I of the Housing Act of 1949, as amended, for the purpose of carrying out the provision of the Urban Renewal Plan, in the sum of: a N. �4•xf .?AM'TYYIi v .. 2 A loan in the amount of $3,402,127 - such amount sufficient to enable it to defray ,the gross cost of the Project. (2) A Project Capital Grant in the maximum amount avail- able'for the Project. (3) A relocation grant in the maximum amount available for the Project; and (4) A rehabilitation grant in the maximum amount avail- able for the Project; and WHEREAS the City desires to provide "local grants-in- aid" in connection with said Project and has heretofore indicated its intention to do so in a Resolution approving said Urban Re- • newal Plan for said Project; NOW, THEREFORE, in consideration of the mutual covenants hereinafter set forth, the Agency and the City agree as follows: 1. AGENCY (a) The Agency agrees to proceed diligently and forth- with with all necessary actions, works and undertakings to carry out the proposed and approved Center Square Urban Renewal Project in the following described Project Area, and other areas as may be designated and approved, to carry out and fulfill the proposed Loan and Capital Grant Contract specifically between it and the United States of America, acting by and through the Secretary of Housing and Urban Development, said Project Area being identified as the Center Square Urban Renewal Project, ARK R -10S situated J0 in the City of Fayetteville, Washington County, Arkansas, this Pro- ject being specifically described as Exhibit I, Boundary Description, attached hereto and made .a part of this Agreement. (b) The Agency agrees to arrange and provide for the acquisition of properties and demolition of improvements thereon, to make available rights-of-way and easements, to cause those structures and properties to remain to be brought up to the standards as established in the Property Rehabilitation Standards for the Center Square Urban Renewal Project Area, and to make available for - 3 - • `-`disposition as soon as possible those lands which are to be re- developed for public and private purposes. (c) The Agency agrees to dedicate to the City without payment certain parcels of land for street rights-of-way and drainage rights-of-way, such areas being designated on the map R-224(3) Right -of -Way Adjustment Map, dated March, 1971. (d) The Agency agrees to demolish all structures located on properties acquired by the Agency and clear the sites as re- quired under the Urban Renewal Plan. (e) The Agency agrees to install certain eligible site improvements within the Project Area as required under the Urban =Renewal Plan as follows: • (1) The installation of eligible project improvements on streets in the Project Area - in the amount of $294,120, which amount shall be for -construction of streets, gutter thereon, the repair and installation of sidewalks, and engineer- ing fees including design and supervi- sion, all of which amount shall be for the above items. (2) For the installation of certain eligi- ble project improvements to the storm sewer and drainage system within the Project Area in the amount of $174,983, all of which shall be for the purchase of materials, installation of improvements, and the provision of engineering ser- vices including design and supervision. (3) The installation of certain eligible project improvements in the form of a pedestrain right-of-way development in the amount of $458,483, which amount shall be for the installation of a decor- ative pool, free standing canopies, de- corative pavement, landscaping, a pylon, lighting, retaining walls, benches, storm., drainage, and engineering fees including design and supervision,.all of which amount shall be for the above items. (4) The installation of certain eligible pro- ject improvements to the traffic signal- ization_system within the Project Area in the amount of $43,900, which amount shall be for the installation of signals and controllers, and engineering fees including design and supervision, all of which amount shall be for the above items. (6) The landscaping with street trees in certain areas of the project in the amount of $3,760. CITY The City agrees pursuant to and with the procedures as required by all applicable State laws, City Charter and Ordinances to provide local grants-in-aid and to cooperate otherwise in the • undertaking, carrying out, and completion of said'Urban Renewal Project in accordance with the approved Urban Renewal Plan there- for, in all respects, including but not limited to, the following: (a) To take all necessary steps to appropriate and to contribute to the Agency any monies that may accrue from any source that shall be received by the City as a cash grant-in-aid for the purpose of carrying forward the Project, such cash, if any, to be deposited in the Project Expenditures Account maintained by said Agency in connection with the Project. (b) To maintain all public rights-of-way, easements, public lands, and improvements thereon and to accept the dedica- tion of rights-of-way as reflected on the map R-224(3), Right -of - Way Adjustment, and any other lands that may be dedicated under I� the Urban Renewal Plan. (c) Further, the City agrees to the payment of one- fourth of the Net Project Cost of the undertaking and completion of the Center Square Urban Renewal Project. (c) Further, the City agrees to the payment of one- fourth of the Net Project Cost of the undertaking and completion of the Center Square Urban Renewal Project. It is understood that the City will install necessary site improvements as required under the Urban Renewal Plan under an orderly schedule and such payment and participation shall not be contingent on the proceeds of a future bond issue. R -s- • (d) It is understood that the City will provide $45,000 of its required one-fourth share as "local grants-in-aid" by the construction, installation, and accomplishment of the following project or site improvements in the following amounts, all in accordance with the undertaking and completion of said urban renewal project: (1) To assure the adequacy of the storm drainage on Spring Street to handle drainage from without as well as with- in the project area the City will par- ticipate in the Spring Street drainage and street rebuilding, as needed in accord with project design, to the extent of $45,000. (2) The installation and construction of cer- tain ineligible project improvements out- side of the project boundary which are • necessary to assure the expeditious flow of traffic through the project area. These improvements are: a. The overlay of East Avenue from Rock Street to the project bound- ary and increase the northeast and northwest radio at the inter- section of East Avenue and Rock Street to 30 feet. b. The widening of Rock Street from East Avenue to Church Avenue to a 36 feet roadway. c. The widening and overlay of Church Avenue from Rock Street to the pro- ject boundary to a 36 feet road- way and increase the northeast radiuslat the intersection of Church Avenue and Rock Street to 30 feet. d. Overlay Block Avenue from Rock Street to the project boundary and increase the northeast and/or northwest radii at the intersection of Block Avenue . and Rock Street as needed to facilitate the traffic circulation. (e) It is estimated that the City will receive the amount of $1,292,225 toward its required one-fourth share as"local grants-in-aid" by the acquisition and demolition of substandard structures by the University of Arkansas in the total amount of $11292,225. I ' • (g) Act of 1964 and 6 - The City recognizes that Title VI of the Civil Rights the regulations and policies of the Department of Housing and Urban Development effectuating the Title prohibit discrimination on the ground of race, color, or national origin in the policies and practices of any public facility responsible for the proposed credit to the locality's share of the cost of an urban renewal project receiving financial assistance from the United States, The City hereby assures the United States and the Secretary of Housing and Urban Development that the proposed project improve- ments and public off-street parking facilities mentioned herein will be available to and serve all persons without regard to race, color, or national origin, • (h) The City agrees to make available for the benefit of the Project either cash or non-cash grants-in-aid to cover any deficit in local grants-in-aid which shall develop if the Secre- tary of Housing and Urban Development shall not approve the full estimated amount of such grant-in-aid credits. Further, the City agrees to pay in cash or local grants-in-aid to -cover any deficit which moy exist or develop by its failure to establish and support the amount of local grants-in-aid for site improvements and supporting facilitiesmentioned above, (i) The City further agrees in connection with the carrying out of the Urban Renewal' Project to zone and rezone, as may be appropriate, the Urban Renewal Area in conformity with the Urban Renewal Plan, and not in conflict with said Plan.
