HomeMy WebLinkAbout1971-08-06 - Minutes - Archive10 MINUTES OF SPECIAL MEETING OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS A Special Meeting of the Housing Authority of the City of Fayetteville, Arkansas, was held on Friday, the 6th day of August, 1971, at 4:00 o'clock P. M., in the office of the Authority. The meeting was called to order and upon roll call the following members were present: Messrs: Shelton, Douglas and Gould Absent: Whillock and Baxter Also Present: Ora Belle Rollow and David Faught The Vice -Chairman ordered that the following Waiver and Consent be spread upon the Minutes: WAIVER OF NOTICE OF AND CONSENT TO SPECIAL MEETING We, the undersigned, do hereby accept notice of this Special Meeting, waiving any and all irregularities in the service of • notice and do hereby consent and agree that the Commissioners of the Housing Authority of Fayetteville, Arkansas, shall meet in the Office of the Authority at 4:00 o'clock P. M. on the 6th day of August, 1971, for the following purposes. 1. Adopt Resolution Providing Assurances Pursuant to Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970. 2. Amend Resolution #59, Section 2, Approving Part 1 Loan and Grant Application for Project ARK R-105. 3• Consider Amending Resolution #39, Authorizing and Directing Submission of Application for a Low -Rent Housing Program. /S/ Ellis E. Baxter -1- 0 • There being a quorum present, the following business was trans- acted: The Vice -Chairman presented Resolution #64 (copy attached): RESOLUTION OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS PROVIDING ASSURANCES PURSUANT TO UNIFORM RELOCATION ASSISTANCE AND REAL PROPERTY ACQUISITION POLICIES ACT OF 1970 After discussion, Resolution #64 was adopted by motion of Mr. Douglas, seconded by Mr. Gould and the vote recorded: AYES: Shelton, Douglas, and Gould NAYS: None The Vice -Chairman thereupon declared the motion carried and Resolution adopted unanimously. The Vice -Chairman presented Resolution #65 (copy attached): RESOLUTION OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS AMENDING RESOLUTION NO. 59 AUTHORIZING THE FILING OF A PART I LOAN AND GRANT APPLICATION FOR PROJECT NO. ARK R-105 After discussion, Resolution #65 was adopted by motion of Mr. Douglas, seconded by Mr. Gould and the vote recorded: AYES: Shelton, Douglas, and Gould NAYS: None The Vice -Chairman thereupon declared the motion carried and Resolution adopted unanimously. The Vice -Chairman presented Resolution #66 (copy attached): RESOLUTION AMENDING RESOLUTION NUMBER 39 AUTHORIZING AND DIRECTING SUBMISSION OF APPLICATION FOR A LOW -RENT HOUSING PROGRAM After discussion, Resolution #66 was adopted by motion of Mr Douglas, seconded by Mr. Gould and the vote recorded: AYES: Shelton, Douglas, and Gould NAYS: None -2- a The Vice -Chairman thereupon declared the motion carried and Resolution adopted unanimously. There being no further business the meeting adjourned. ATTEST: OWN I M1111 I 0 • APPROVED: -3- CEO4 AN 1�/7/� RESOLUTION N0, 64 RESOLUTION OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS PROVIDING ASSURANCES PURSUANT TO UNIFORM RELOCATION ASSISTANCE AND REAL PROPERTY ACQUISITION POLICIES ACT OF 1970 WHEREAS, the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, P. L. 91-646 (hereinafter re- ferred to as the "Act") establishes uniform policies for the fair and equitable treatment of persons displaced as a result of Federal and federally assisted programs, as well as uniform policies on real property acquisition practices with respect to such programs; and WHEREAS, the Act has application to programs and projects receiving financial assistance under Title I of the Housing Act of 1949, as amended; and WHEREAS, the LPA has made application for financial assist- ance under Title I of the Housing Act of 1949, as amended for an urban renewal project designated as follows: Center Square Urban • Renewal Project, No. ARK R-105; and WHEREAS, the activities for which such assistance is sought will involve displacement and/or land acquisition occurring after January 2, 1971, the effective date of the Act; and WHEREAS, Section 210 and 305 of the Act require the provision of certain assurances before the head of a Federal agency can ap- prove any grant to, or contract or agreement with, a State agency, under which Federal financial assistance will be available to pay all or part of the cost of any program or project which will result in displacement or real property acquisition subject to the require- ments of the Act; NOW, THEREFORE, Be it resolved by the commissioners of the LPA: That the United States of America -and the Secretary of Housing and Urban Development be, and they hereby are, provided through the adoption of this Resolution, with the following assurances regarding conduct by the LPA of the project or program for which Federal fin- ancial assistance under Title I of the Housing Act of 1949, as amended, is sought. The LPA hereby assures that it has authority under state law to comply with Section 210 and 305 of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 and agrees that, notwithstanding any conflicting pro- vision set forth herein: (1) Fair and reasonable relocation payments and assistance shall be provided in accordance with Section 202, 203, and 204 of the Uniform Act and applicable Department of Housing and Urban Development Regulations in effect at the time of displacement, to or for individuals, partnerships, corpora- tions or associations displaced as a result of the Project; (2) Relocation assistance programs offering the services described in Section 205 of the Uniform Act shall be provided' to such displaced individuals, partnerships, corporations or associations in the manner provided under applicable HUD Regulations in effect at the time of displacement; (3) Within a reasonable time prior to displacement, decent, safe and sanitary replacement dwellings will be available to such displaced individuals, partnerships, corporations or associations in accordance with Section 205 (c) (3) of the Act; (4) in acquiring real property in connection with the Project, • the LPA will be guided to the greatest extent practicable under state law, by the land acqusition policies set out under Sections 301 and the provisions of Section 302 of the Act; and (5) Property owners will be paid or reimbursed for necessary expenses as specified in Sections 303 and 304 of the Act; (6) The costs to the LPA of providing payments and assistance hereunder shall be borne in accordance with Section 211 of the Act; (7) Affected persons will be adequately informed of the bene- fits, policies, and procedures provided in the said Regulations; • (8) The relocation process will be carried out in such a manner as to provide displaced persons with uniform and consistent services, and displacement housing under Section 42.120 will be available and the same range of choices with respect to such housing will be offered to all displaced persons regardless of race, color, religion or national origin pursuant to Title VI of the Civil Rights Act of 1964 (42 U.S.C. 2000d), Title Vill of the Civil Rights Act of 1968 (42 U.S.C. 3501, et sec.), and Executive Order 11063 (27 F.R. 11527)• -2- • (9) The LPA will execute such amendements to its contract and execute, furnish and be bound by such additional documents as the Secretary of Housing and Urban Development shall deter- mine necessary to effectuate or implement the assurances provided hereunder. 0 I* Passed and approved this 6th day of August , 1971. ATTEST: -3- ►�(//TW�%ij�� E • RESOLUTION NO. 65 RESOLUTION OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS AMENDING RESOLUTION N0, 59 AUTHORIZING THE FILING OF A PART I LOAN AND GRANT APPLICATION FOR PROJECT NO. ARK R-105 WHEREAS, by Resolution No. 59 of March 19, 1971, the Housing Authority of the City of Fayetteville, Arkansas, authorized the filing of a Part I Loan and Grant Application for Project ARK R-105; and WHEREAS, prior to the filing of said application, Public Law 91-646, The Uniform Relocation Assistance and Real Property Acquisi- tion Policies Act of 1971, was adopted, containing a number of signi- ficant amendments to the basic urban renewal laws; and WHEREAS, it is deemed advantageous to the City of Fayetteville to amend the amount of loan requested under Section 102 (a) of Title I of the Housing Act of 1949, as amended, and amend the project capital grant and the relocation grant. NOW, THEREFORE, Be it Resolved by the Commissioners of the Housing Authority of the City of Fayetteville, Arkansas: Section I: That the sum of $3,381,928 be deleted from Section 2 and the sum of $3,402,127 be inserted in its place. Section 2: That all other provisions of Resolution No. 59 shall remain the same. Passed and Approved this ATTEST: 6th day of August , 1971. 6 ed-t';)p Secretary 1 1 � • RESOLUTION N0, 66 RESOLUTION AMENDING RESOLUTION NUMBER 39 AUTHORIZING AND DIRECTING SUBMISSION OF APPLICATION FOR A LOW -RENT HOUSING PROGRAM WHEREAS, On the 15th day of April, 1970, the Housing Authority of the City of Fayetteville, Arkansas, did authorize and direct by Resolution Number 39, Submission of Application for a Low -Rent Housing Program; and WHEREAS, said application requested financial assistance for 100 dwelling units of low -rent public housing to be provided by new construction and for a preliminary loan in the amount of $40,000; and WHEREAS, the Housing Authority desires to amend said application to request financial assistance for 100 dwelling units to be provided by leasing privately owned housing under Section 23 of the United States Housing Act of 1937, as amended. • NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section I: That the number 100 be deleted from Section 1 and the number 100 be inserted in Section 2. Section 2: That the sum of $40,000 be deleted from Section 1. Section 3: That all other provisions of Resolution Number 39 shall remain the same. Passed and Approved this 6th day of August 1971.
