M. in the office of the Authority, 226 N. Block St., Fayetteville, Arkansas. AGENDA 1. Roll Call, 2. Approve Minutes of Annual Meeting of Feb. 22, 1971 and Special Meeting of March 8, 1971. 3. Approve February Financial Report. 4. Adopt Resolution - "Justification for payment made to Architect for special services performed for change of sites for Hi -Rise development". 5. Adopt Resolution - "Resolution of the Housing Authority of City of Fayetteville, authorizing the filing of a Part 1 Loan and Grant Application for Project ARK R-105". 6. Other Related Business. Secretary 0 MINUTES OF SPECIAL MEETING OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS A Special Meeting of the Housing Authority of the City of Fayetteville, Arkansas, was held on Friday, the 19th day of March, 1971, at 2:30 o'clock P. M., in the office of the Authority. The meeting was called to order and upon roll call the following members were present: Messrs: Whillock, Shelton, Gould and Douglass Absent: Baxter Also Present: Warren Seagraves, Frank Ruder, Bob Boyd, David Faught, Michael McDowell and Ora Belle Rollow The Chairman ordered that the following Waiver and Consent be spread upon the Minutes: • WAIVER OF NOTICE OF AND CONSENT TO SPECIAL MEETING • i We the undersigned, do hereby accept notice of this Special Meeting, waiving any and all irregularities in the service of notice and do hereby consent and agree that the Commissioners of the Housing Authority of Fayetteville, Arkansas shall meet in the Office of the Authority at 2:30 P. M. on the 19th day of March, 1971, for the following purposes: 1. Roll Call 2. Approve Minutes of Annual Meeting of Feb. 22, 1971 and Special Meeting of March 8, 1971. 3. Approve February Financial Report. 4. Adopt Resolution - "Justification for payment made to Architect for special services performed for change of sites for Hi -Rise development". 0 5. Baxter There being a quorum present, the following business was transacted: • Minutes of the regular meeting of February 22, 1971 and Special Meeting of March 8, 1971, were approved by motion of Mr. Gould, seconded by Mr. Douglass and the motion carried unanimously. The Financial Report of February 28, 1971 was approved by Motion of Mr. Gould, seconded by Mr. Shelton and the motion carried unanimously. J The Chairman introduced Resolution #58 (copy attached): JUSTIFICATION FOR PAYMENT MADE TO ARCHITECT FOR SPECIAL SERVICES PERFORMED FOR CHANGE OF SITES FOR HI -RISE DEVELOPMENT. After discussion, Resolution #58 was adopted by motion of Mr. Douglass, seconded by Mr. Gould and the vote recorded: AYES: Whillock, Gould, Shelton and Douglass NAYS: None The Chairman thereupon declared the motion carried and Resolution adopted unanimously. -2- ■ r The Chairman introduced Resolution #59 (copy attached): RESOLUTION OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, AUTHORIZING THE FILING OF A PART 1 LOAN AND GRANT APPLICATION FOR PROJECT ARK R-105. After detailed explanation from Mr. Frank Ruder, Director of Planning and Design UPC, of the Part 1 Loan & Grant Application, Resolution #59 was adopted by motion of Mr. Douglass, seconded by Mr. Gould and the vote recorded: AYES: Whillock, Gould, Shelton and Douglass NAYS: None The Chairman thereupon declared the motion carried and Resolution adopted unanimously. There being no further business the meeting adjourned. ATTEST: APPROVED: Chairman -3- 0 • RESOLUTION NO. 58 WHEREAS, architectural were provided by E. E. Jacks to a contract dated December 21, 1968; and services for Project Ark 97-1 and Warren Segraves pursuant 16, 1966, as amended February WHEREAS, at the request of the Housing Authority, said architects performed extra services in the administra- tion of surveying contract and duplication of services in site selection as a result of necessary and unavailable changes in sites for the low -rent housing project. Said services were essential and extensive and the charges for same ($875.75) were reasonable as is more fully indicated in the "Reply" portion of the audit findings and L.A. Reply annexed hereto as Exhibit "A"; and WHEREAS, because of the urgency at the time in finding new sites and the need for immediate action, the Housing Authority in its haste inadvertently failed to require compliance with Section 4.2 of the Architects Contract providing for submission of estimates for the cost of the additional work and written concurrence in same by HUD and the Authority prior to performance of the extra work; and WHEREAS, the oversight on the part of the authority and the architects in this regard and the subsequent pay- ment for said services by the Authority were made in good faith and without any intention of departing from the terms of the contract; and WHEREAS, the Authority deeply regrets this occurrence, but feels that in equity and good conscience the architects should be allowed to retain this compensation for valuable services performed. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That HUD is respectfully requested to waive the failure of compliance with Section 4.2 of the Architects Contract in this particular instance, and approve the payment to the architects as aforesaid for their necessary extra services. 2 - Section 2. That HUD be assured that no such failure or oversight on the part of the Authority will occur again in the future. PASSED this 19 day of arch 1971. CHAIRMAN SECRETARY A • I • RESOLUTION NO. 59 RESOLUTION OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS AUTHORIZING THE FILING OF A PART I LOAN AND GRANT APPLICA- TION FOR PROJECT NO. ARK -R-105• WHEREAS, it is necessary and in the public interest that the Housing Authority of the City of Fayetteville, Arkansas avail itself of the financial assistance provided by Title I of the Housing Act of 1949, as amended, to carry out the urban renewal project described as Center Square Urban Renewal Project and bounded as set forth in the attached Exhibit ''A" to this Resolution hereinafter referred to as the ''Project''; and WHEREAS, it is recognized that the Federal contract for such financial assistance pursuant to said Title I will impose certain obligations and responsibilities upon the Local Public Agency and will require among other things (1) the provision of local grants- in-aid; (2) a feasible method for the relocation of individuals and families displaced from the project area; (3) other local obligations and responsibilities in connection with the undertaking and carrying out of urban renewal projects; and • WHEREAS, Title VI of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, color or national origin under any program or activity receiving Federal financial assistance and Executive Order 11063 prohibits discrimination on the basis of race, color, creed or national origin in sale, lease or other disposition of residential property (including land intended for residential use) or in the use or occupancy thereof; and WHEREAS, the objectives of the Urban Renewal Plan cannot be achieved through more extensive rehabilitation of the Project area: NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS: 1. That the United States of America and the Secretary of Housing and Urban Development be, and they hereby are, assured of full compliance by the Housing Authority of the City of Fayetteville, Arkansas with regulations of the Department of Housing and Urban Development effectuating Title VI of the Civil Rights Act of 1964 and applicable Executive Orders. 2. That an application on behalf of the Housing Authority of the City of FAyetteville, Arkansas, for a loan under Section 102 (a) Ll 0 -2- of said Title I in the amount of $ 3,381,928 and for a project capital grant, a relocation grant, and a Federal grant for the making of rehabilitation grants to the full amount avail- able for undertaking and financing the Project is hereby approved, and that the Chairman is hereby authorized and directed to execute and to file such application with the Department of Housing and Urban Development, to provide such additional information and to furnish such documents as may be required in behalf of said Depart- ment, and to act as the authorized correspondent of the Housing Authority of the City of Fayetteville, Arkansas.
