HomeMy WebLinkAbout1970-09-16 - Minutes - ArchiveMINUTES OF REGULAR MEETING OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS The Housing Authority of the City of Fayetteville, Arkansas met in regular session at 10:00 o'clock A.M. on Wednesday, September 16, 1970, in the Director's Room of the City Administration Building. The meeting # was called to order by the Chairman and on roll call the following members were present: Messrs.: Whillock, Baxter, Douglas & Gould Absent: Shelton Others Present: Warren Segraves, Hugh Kincaid, Ora Belle Rollow The minutes of the meeting of August 19, 1970 were approved by motion of Mr. Baxter, seconded by Mr. Douglas and carried unanimously. The financial report for the month of August was approved by • motion of Mr. Gould, seconded by Mr. Baxter and carried unanimously. Warren Segraves, Architect, reported that construction was progressing satisfactorily, although Sites B and J were behind schedule. The Executive Director reported that Part I Application of Survey & Planning was 20% complete and progress was according to schedule. The Chairman presented the following resolutions for con- sideration: Resolution # 47, hereby attached, LEGAL CONTRACT FOR Survey & Planning. Resolution # 48, hereby attached, LEGAL CONTRACT FOR Low Rent Housing. There was a motion by Mr. Douglas, seconded by Mr. Gould and carried unanimously that these resolutions be adopted. The Board interviewed Michael McDowell to fill the position of Assistant Director. After the interview, Mr. Baxter • 0 moved that Michael McDowell be employed as Assistant Executive Director at an annual salary of $11,500.00 and a monthly car allowance of $35.00, with an increase of salary after one years employment if performance was satisfactory. Also, to pay the expense of moving house- hold goods from Parsons, Kansas to Fayetteville, Arkansas. Mr. Douglas seconded the motion and the vote recorded: Ayes: Commissioners Whillock, Douglas, Baxter and Gould Nayes: None Motion carried unanimously. I(2) That the attached Resolutions are true and correct copies of the Resolutions as finally adopted at a meeting of the Governing Body held on the 16th day of September, 1970, and duly recorded in his office; i i(3) That said meeting was duly convened and held in all respects in accordance with law and to the extent required by law, due and proper notice of such meeting was given; that a legal quorum was present throughout the meeting, ;and a legally sufficient number of members of. the Govern- ing Body voted in the proper manner and for the adoption of said Resolutions; and all other requirements and pro- ceedings under law incident to the proper adoption or passage of said resolution, have been duly fulfilled, carried out, and otherwise observed; j(4) That an impression of the seal has been affixed below. It constitutes the official seal of the Applicant and this certificate is hereby executed under such official seal. I (5) That the undersigned is duly authorized to execute this certificate. Secretary �_ 0 RESOLUTION NO. 47 RESOLUTION APPROVING CONTRACT FOR LEGAL ADMINISTRATIVE SERVICES (URBAN RENEWAL) WHEREAS, Attorney, Hugh R. Kincaid, is now ren- dering legal services to the Housing Authority in connection with Central Square Urban Renewal Project No. Ark. R -105(A), and has been rendering services to the Authority in connection with said project since the inception of same commencing with the approval of the Advance Planning Contract on May 27, 1970 and execution of same on May 28, 1970; and WHEREAS, said services have and are being rendered by the Attorney and accepted by the Authority with the expectation that said Attorney would be compensated therefor in accordance with the terms of a contract to be executed by said parties when the parties could come to an agreement on all the terms for said contract; and • WHEREAS, the Authority and the Attorney have now reached agreement upon the terms for said contract and desire to approve same to commence and be effective with the inception of said services. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That the contract, dated June 1 , 1970, between the Authority and the Attorney, Hugh R. Kincaid, for legal services in connection with Central Square Urban Renewal Project, No. Ark. R -105(A), be and the same is hereby approved effective June 1 , 1970. SECTION 2. That the Authority hereby ratifies, approves and confirms all acts and services heretofore undertaken by said Attorney in connection with said project and deems them done and performed pursuant to said contract. PASSED AND APPROVED, this 16 day of September , 1970. APP �I7ED : C(/ CHAIRMAN • ATTEST: SECRETARY 0 RESOLUTION N0. 48 RESOLUTION APPROVING CONTRACT FOR LEGAL SERVICES (PUBLIC HOUSING). WHEREAS, prior to June 1 , 1970, Attorney, Hugh R. Kincaid, had been rendering legal services to the Housing Authority on an hourly basis; and WHEREAS, effective June 1 f1970, it was the intention of the Au ority to place said Attorney on a retainer basis for future services in connection with public housing projects and to compensate him for services which he continued to render after said date according to a retainer fee contract to be executed by the Authority and the Attorney when said parties could reach agreement upon all the terms for said contract; and WHEREAS, the Authority and the Attorney have now reached agreement upon the terms for said contract and desire to approve same to commence and be effective with • the inception of said retainer arrangement. NOW, THEREFORE,BE IT RESOLVED BY THE COMMISSIONERS OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That the contract dated June 1, 1970, between the Authority and the Attorney, Hugh R. Kincaid, for legal services in connection with public housing projects be and the same is hereby approved effective June 1 1970. SECTION 2. That the Authority hereby ratifies, approves and confirms all acts and services undertaken by said attorney from and after June 1 , 1970, in connection with public housing projects and deems them done and performed pursuant to this contract. SECTION 3. All resolutions in conflict herewith are hereby rescinded effective with the commencement date of said contract. PASSED AND APPROVED, this 16 day of September , 1970.
