WAIVER OF NOTICE OF AND'CONSENT TO SPECIAL MrBTING
we, the undersigned, do hereby accept notice of this
SPECIAL meeting, waiving any and all irregularities
in the service of notice and do hereby consent and
agree'that the Commissioners of the Housing Authority
of Fayetteville, Arkansas shall meet at their regular
meeting place at 8:00 o'clock a.m. on the 5th day
of;February 1969 for the following purposes:
To adopt a Resolution approving the undertaking
of Surveys and Plans for an Urban Renewal Project
• and filing of an application.
To transact•any other business that may come before
the meeting.
MINUTES OF SPECIAL MEETING OF THE
HOUSING AUTHORITY OF THE CITY OF
FAYETTEVILLE, ARKANSAS
A Special Meeting of the Housing Authority of the City of
Fayetteville, Arkansas, was held on the 5th day of February,
1970, at 8:00o'clock A.M.
The meeting was called to order and on roll call the following
members were present:
Messrs. Whillock, Shelton, Douglas, Baxter
Absent Members, J.W.Gould

Also Present were. Ora Belle Rollow, Garland Melton,Mayor
The Chairman ordered that the following Waiver and Consent be
spread upon the Minutes:

We, the undersigned, do hereby accept notice of this
Special Meeting, waiving any and all irregularities
in the service of notice and do hereby consent and agree

full and considered:
• After discussion, Mr. Douglas moved that the Resolution
be ado ted as introduced and read. The motion was seconded by
Mr.Shelton, and the following vote was recorded:
Ayes: Whillock, Shelton, Douglas, Baxter
Nayes: None
The Chairman thereupon declared the motion carried and the
Resolution adopted.
There being no further business to come before the meeting, Mr.
Mr. Baxter moved that the meeting adjourn, which motion was duly
seconded by Mr -Douglas and carried by unanimous vote.

• The undersigned hereby certifies, as follows:
(1) That he is the duly qualified and acting Secretary of the
Housing Authority of the City of Fayetteville, Arkansas, herein
called the "Applicant", and the keeper of its records; including
the journal of proceedings of the meetings of the Board of
Commissioners herein called the "Governing Body".
(2) That hhe attached resolution is a true and correct copy of
the resolution as finally adopted at a meeting of the Governing
Body held on the 5th day of February , 1970, and duly
recorded in his office;
(3) That said meeting was duly convened and held in all respects
in accordance with law and to the extent required by law due and
propernotice of such meeting was given; that a legal quorum was
present throughout the meeting, and a legally sufficient number
of members of the Governing Body voted in the proper manner and
for the adoption of said resolution; and all other requirements
and proceedings under law incident to the proper adoption or
passage of said resolution, have been duly fulfilled, carried out,
and otherwise observed;
(4) That an impression of the seal has been affixed below, It
• constitutes the official seal of the Applicant and this certificate
is hereby executed under such official seal.
(5) That the undersigned is duly authorized to execute this
certificate.

RESOLUTION NO 37
• A RESOLUTION APPROVING UNDERTAKING OF SURVEYS
AND PLANS FOR AN URBAN RENEWAL PROJECT AND
FILING OF AN APPLICATION.
WHEREAS, under Title I of the Housing Act of 1949, as
amended (herein referred to as "Title I"), the Secretary of
Housing and Urban Development is authorized to extend finan-
cial assistance to local public agencies in the elimination
and prevention of the spread of their slums and urban blight
through the planning and undertaking of urban renewal projects;
and:
TgHEREAS Title VI of the Civil Rights Act of 1964 prohibits
discrimination on the basis of race, color or national origin
under any program or activity receiving Federal financial
assistance and Executive Order 11063 prohibits discrimination on
basis of race, color,creed or antional origin in sale,lease or
other disposition of residential property (including land in-
tended for residential use) or in the use or occupancy thereof;
and
WHEREAS it is desirable and in the public interest that the
Housing Authority of the City of Fayetteville, Arkansas make
surveys and prepare plans, presently estimated to cost approxi-
mately Two Hundred Fifty One Thousand and Twenty Four dollars
• ($251,024.00), in order to undertake and carry out an urban
renewal project of the character contemplated by Section 110(c)
of Title I, in that area proposed as an Urban Renewal Area,
situated in the City of Fayetteville, Arkansas, County of Wash-
ington, and State of Arkansas, which is described as follows:
Beginning at a point where the west right-of-way line
of College Avenue intersects with the north right-of-way
line of Spring Street; thence south along the west right-
of-way line of College Avenue to the north right-of-way
line of Center Street; thence east 185 feet along the
north right-of-way line of Center Street to the west right-
of-way line of County Avenue; thence south from said point
along the east right-of-way line 69 County Avenue to the
south right-of-way of Mountain Street; thence wast along
the south right-of-way line of Mountain Street to the east
right-of-way line of College Avenue; thence south along the
east right-of-way line of College Avenue to the south right-
of-way line of Rock Street; thence west along the right-of-
way line of Rock Street to a point 120 feet west of the west
right-of-way line of Church Avenue; thence north along a
line parallel to the west right-of-way line of Chruch Avenue
to the south right -Of -way line of Mountain Street; thence
west along the south right-of-way line of Mountain Street
to a point 160 feet west of the west right-of-way line of
Locust Avenue; thence north 170 feet along a line parallel
to the west right-of-way line of Locust Avenue to a point
100 feet south of the south right-of-way line of Center
Street; thence west from said point along a line parallel to
the south right-of-way line of Center Street to the west
right-of-way line of School Avenue; thence north along the
west right-of-way line of School Avenue to the south right-
of -way line of Meadow Street; thence west along the
• south right-of-way line of Meadow Street to the east
right-of-way line of West Avenue; thence south along
the east right-of-way line of West Avenue to the south
right-of-way line of Center Street; thence west along
the south right-of-way line of Center Street to the
centerline of the St.Louis and San Francisco Railroad
right-of-way; thence northwardly 820 feet along said
railroad centerline to a point which intersects with
the west extended and north right-of-way line of Spring
Street; thence east from said point along the west ex-
tended and north right-of-way line of Spring Street
to the point of beginning.
NOW,THEREFORE, BE IT RESOLVED BY THE HOUSING AUTHORITY
OF THE CITY OF FAYETTEVILLE, ARKANSAS:
1. That the proposed Urban Renewal Area described above
is a slum, blighted, deterioriated,or deteriorating area
appropriate for an urban renewal project, that the development
of such Area for predominantly nonresidential uses is necessary
for the proper development of the community, and that the under-
taking by the Housing Authority of the City of Fayetteville,
Arkansas, of surveys and plans for an urban renewal project of
the character contemplated by Section 110(c) of Title I in the
proposed Urban Renewal Area is hereby approved.
• 2. That the financial assistance available under Title I
is needed to enable the Housing Authority of the City of Fayette-
ville, Arkansas to finance the planning and undertaking of the
proposed Project.
3. That it is cognizant of the conditions that are imposed
in the undertaking and carrying out of urban renewal projects
with Federal financial assistance under Title I, including those
relating to (a) relocation of site occupants, (b) the provision
of local grants-in-aid, and (c) the requirement that the locality
present to the Secretary of Housing and Urban Development as a
prerequisite to approval of the application described below, a
Workable program for community improvement,as set forth in Section
101 (c) of Title I, for utilizing appropriate public and private
resources to eliminate and prevent the development or spread of
slums and urban blight.
4. That the United States of America and the Secretary of
Housing and Urban Development be, and they hereby aie, assured of
full compliance by the Housing Authority of the City of Fayette-
ville, Arkansas with regulations of the Department of Housing and
Development effectuating Title VI of the Civil Rights Act of 1964
and applicable Executive Orders.
• 5. That it si the sense of this body (a) that a feasible
method for the relocation of individuals and families displaced
from the Urban Renewal Area, in conformity with the requirements
of Title I,cna be prepared, and (b) that local grants-in-aid can
and will be provided in an amountwhich will be not less than
one-fourth of the Net Project Cost of the Project and which,
together with the Federal capital grant,will be generally equal
• to the difference between GRoss Project Cost and the proceeds or
value of project land sold, leased, or retained for use in accord-
ance with the urban renewal plan.
6. That the filing of an application by the Housing Autho-
rity of the City of Fayetteville, Arkansas for an advance of funds
from the United States of America in an amount not to exceed
Two Hundred Fifty One and Twenty Four dollars ($251,024.00) for
surveys and plans for an urban renewal project in the proposed
Urbna Renewal Area described above is hereby approved, and that
the Chairman of the said Housing Authority is hereby authorized
and directed to execute and file such application with the Sec-
retary of Housing and Urbna Development, to provide such additio"
nal information and to furnish such documents as may be required
by the Secretary, and to act as the authorized representative
of the Housing Authority of the City of Fayetteville, ARkansas.
