HomeMy WebLinkAbout1968-03-05 - Minutes - Archive0 0 MINUTES OF,SPECIAL,MEETING OF THE HOUSING AUTHDRITYEOF FAYETTEVILLE, ARKANSAS MARCH 'S, 1968 A special meeting of the Housing Authority of the City of Fayette- ville, Arkansas was held at 10:00 a.m. Tuesday March 5, 1968 in the Director's Room in the City Administration Building, Fayetteville. Mambers present: J.W.Gould, Ellis Shelton, Carl Whillock Members absent: L.L.Baxter, Hal Douglas Others present: Gerald Fox, Hugh Kincaid, James Vizzier, Ernest Jacks, Warren Segraves, Ora Belle Rollow The meeting was called to order by Ellis Shelton. Mr. Whillock moved that the minutes of regular meeting in January be postponed for approval, Mr. Gould Seconded a nd vote was unanimous. Resolution No.18, amending Resolution No.10, dated September 20th, 1968 - "A RESOLUTION APPROVING CONDITIONS UNDER WHICH RELOCATION PAYMENTS WILL BE MADE" was presented for approval. After discussion a motion was made by Mr. Whillock that Resolution No. 18 be approved. Seconded by Mr. Gould and the vote was recorded: Ayes: Shelton, Gould, Whillock Nayes: NONE Motion was carried unanimously. Consideration of new sites for elderly housing was resumed from the meeting of February 21, 1968. A report from the investigation by Mr. Utley revealed that the Sisemore Tire Company alone would amount to approximately $100,000 for acquisition plus a sisable amount for business relocation and relocation adjustment payments. This was only a portion of the amount of area to be acquired in that block. Difficulty had already been encountered in securing options of the three parcels of site "G" already located in the block. After lengthy discussion with the architects on feasibility of other sites being considered Mr. Whillock moved that the following sites be further explored as to financial feasibility: 1.First choice - Maplewood addition lying between Rebecca and Davidson street and directly behind Safeway Store, 2. First Alternate - Approximately 3 acres lying in the heart of a block bounded by College -Spring -Willow -Center. The area to be defined by the architects. 3. Second Alternate - An area bounded by School -Center -West - and Meadow streets - known as Hillcrest School, Mr. Gould seconded the motion and the vote was recorded as follows: Ayes: Shelton, Gould, Whillock Nayes:NONE Motion was carried unanimously. 0 0 • The Executive Director was directed to (a) secure an estimated appraisel on the above sites and (b) arrange to canvass key property owners in the neighborhood surrounding the No 1 site chosen, using visual aides of photographs of existing high --arise housing and a rendering by the architects to demonstrate the type of structure and its functions which could be expected. The following resolution was presented for approval: RESOLUTION NO. A RESOLUTION AUTHORIZING AND DIRECTING THE CONDEMNATION OF CERTAIN LANDS IN THE CITY OF FAYETTEVILLE, ARKANSAS, FOR THE CONSTRUCTION, OPERATION AND MAINTENANCE OF A PUBLIC HOUSING PROJECT, NO, ARK.97-1. The resolution was read in full and approved by motion of Mr. Whillock, seconded by Mr. Gould and the following vote recorded: Ayes: Shelton, Nayes: NONE Motion carried Gould, Whillock unanimously There being no further business the meeting was adjourned. 41 ATTEST: 0 APPROVED: RESOLUTION NO, 18 RESOLUTION APPROVING CONDITIONS UNDER WHICH RELOCATION PAYMENTS WILL BE MADE, AND RESCINDING RESOLUTION NO, 10. WHEREAS, the rules and regulations prescribed by the Federal Government pursuant to Title 1 require that the conditions under which the (1) Housing Authority of the City of Fayetteville will make Relocation Payments in connection with the (2) ARK 97-1, Low - Rent Housing Project contemplated by the application and the Schedule of Average Annual Gross Rentals for Standard Housing in Locality to be used for determining the amounts of Relocation Adjustment Payments to be made in connection with the (2) ARK 97-1, Low Rent Housing Project contemplated by the Application, the Fixed Relocation Pay- ments Schedule be formally approved by the Governing Body of the (1) Housing Authority of the City of Fayetteville, Arkansas, and WHEREAS, there was presented to this meeting of the Governing body of the (1) Housing Authority of the City of Fayetteville, Ark- ansas, for its consideration and approval a set of conditions under which the (1) Housing Authority of the City of Fayetteville, Arkansas will make Relocation Payments, and a Schedule of Average Annual Gross Rentals for Standard Housing in Locality date4iMarch 5, 1968 and a Fixed Relocation Payments Schedule dated September' --'2'00r19,6:7 -for the • ARK 97-1 Low -rent Housing Project contemplated by the application; and WHEREAS, the conditions under which the (1) Housing Authority of the City of Fayetteville, Arkansas will make Relocation Payments and the Schedule of Average Annual Gross Rentals for Standard Housing in Locality and the Fixed Relocation Payments Schedule were reviewed and considered at the meeting: WHEREAS, the conditions under which the Housing Authority will make Relocation Payments and the Schedule of Average Annual Gross Rentals for Standard Housing, -:and the fixed Relocation Payment Sche- dule approved by this Resolution are in conflict with those previous- lyrapproved by Resolution No. 10 of the Housing Authority; accordingly, Resolution NO. 10 should be rescinded. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That the conditions of the Department of Housing and Urban Development under which the (1) Housing Authority of the City of Fayetteville, Arkansas will make Relocation Payments are hereby in all respects approved. SECTION 2. That the Schedule of Average Annual Gross Rentals for Standard Housing in Locality attached hereto as Exhibit "A" is hereby in all respects approved. SECTION 3. That the Fixed Relocation Payments Schedule attached hereto as Exhibit "B" is hereby in all respects approved. SECTION 4. That the Executive Director is hereby authorized and directed to approve all claims for Relocation Payments, SECTION 5. That Resolution No. 10 of September 20 th , 1967, is hereby in all respects rescinded. PASSED this S th day of March , 1968. ...Chairman Secretary • • RESOLUTION NO. • A RESOLUTION AUTHORIZING AND DIRECTING THE CONDEMNATION OF CERTAIN LANDS IN THE CITY OF FAYETTEVILLE, ARKANSAS, FOR THE CONSTRUCTION, OPERATION AND MAINTENANCE OF A PUBLIC HOUSING PROJECT, NO, ARK, 97-1. WHEREAS, the Housing Authority of the City of Fayetteville, Arkansas, is in the process of developing and constructing a public housing project in the City of Fayetteville, Arkansas, Project No, Ark. 97-1, necessitating the acquisition of certain lands in the City of Fayetteville, Arkansas, for the construction, operation and maintenance of said project. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS OF THE HOUS- ING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That for the purpose of constructing, operating and maintaining a public housing project in the City of Fayetteville, Ark- ansas, pursuant to Project No, ARK 97-1 for which a public need exists, it is hereby determined that it is necessary to enter upon and acquire by eminent domain the lands of the following persons, as shown by the plat attached to this resolution, which plat is fully incorporated here- in by this reference: Theodore Coulter, and such other persons who may have interest in the lands designated on the plat as parcel 2 of Site "B". Southern Memorial Association, and/or its trustees, and such other persons who may have an interest in the lands designated on the plat as parcel 3 of Site "B". It is hereby declared that acquisition of the lands described and shown on the referenced plat is in the public interest and necessary for public use. SECTION 2. That the attorney for the Housing Authority is here- by authorized and directed to institute condemnation proceedings to ac- quire said lands in the manner required by law. SECTION 3. That as the questions in controversy in such proceed- ings are likely to retard the progress of said construction, the attorney for the Housing Authority is further authorized and directed to petition the Court for permission to provide an appropriate deposit with the reg- istry of the Court for making compensation and payment of damages, in order that immediate possession of said lands may be secured and construc- tion proceed prior to assessment and payment of damages. • ATTEST: PASSED AND APPROVED this J/� day of 1968.
