HomeMy WebLinkAbout1966-09-21 - Minutes - ArchivePr IV I!� Page 23 MINUTES OF REGULAR MEETING OF THE HOUSING AUTHORITY OF FAYETTEVILLE, ARKANSAS A regular meeting of the Housing Authority of Fayetteville, Arkansas, was held at 10:00 a.m., Wednesday, September 21, 1966, in the Directors' Room in the City Administration Building, Fayetteville, Arkansas. Members present: L. L. Baxter, Hal Douglas, Ellis Shelton, J. E. Pomfret and Bill Gould. (All members were present.) Others present: J. A. Vizzier, City Attorney Hugh Kincaid, and City Manager Gerald Fox. The meeting was called to order by Chairman L. L. Baxter. The minutes of June 24, 1966, and July 13, 1966, were approved as written and mailed to the members. It was explained by J. A. Vizzier that the Housing Authority needed to adopt a new seal which would show the year the Authority was organized. A resolution adopting such a seal was read. On motion by Hal Douglas, seconded by J. Be Pomfret, the Housing Authority unanimously voted to adopt Resolution No. 7-66. RESOLUTION N0. 7-66 BE IT RESOLVED BY THE HOUSING AUTHORITY OF THE CM OF FAYETTEVILLE, ARKANSAS: That the seal submitted to this meeting is hereby adopted as the seal of this Authority and the Secretary of this Authority is hereby authorized and directed to imprint said seal on the margin of the minutes opposite this resolution. On motion by Ellis Shelton, seconded by Bill Gould, the Housing Authority unanimously voted to adopt Resolution No. 846. RESOLUTION N0. 8-66 A RESOLUTION AMENDING RESOLUTION N0. 246 OF JANUARY 19, 1966. WHEREAS, on January 19, 1966, the Housing Authority of the City of Fayetteville, Arkansas, adopted Resolution No. 2-66, adopting by-laws for the Housing Authority; and WHEREAS, it is now deemed necessary to amend said By -Laws of the Housing Authority. NOW, THEREFORE, BE IT RESOLVED BY THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That Article III, Section 2 of the By -Laws of the Housing Authority of the City of Fayetteville, Arkansas, be amended to read as follows: "Section 2. Regular Meetings. Monthly meetings shall be held without notice at the regular meeting place of the Authority at 10:00 A. M. on the third Wednesday, unless the same shall be a legal holiday, in which event said meeting shall be held on the next succeeding secular day at 10:00 A. M." VIZZIER, SFC] The secretary read a resolution approving the undertaking of a General Neighborhood Renewal Program and filing an application for Federal advance of funds. There was discussion. After the discussion, Hal Douglas moved that the Housing Authority adopt Resolution No. 9-66 I* September 21, 1966 Page 25 approving the undertaking of a General Neighborhood Renewal Plan and the filing of an application for Federal advance of funds. The motion was seconded by J. E. Pomfret and passed unanimously. RESOLUTION N0. 9-66 A RESOLUTION APPROVING UNDERTAKING OF GENERAL NEIGHBORHOOD RF104AL PLAN AND FILING OF APPLICATION FOR FEDERAL ADVANCE OF FUNDS. WHEREAS, under Title I of the Housing Act of 1949, as amended, the Housing and Home Finance Administrator may make advances of funds to local public agencies for the preparation of General Neighborhood Renewal Plans for areas defined in Section 102(d) of such Title where the interest of sound community planning makes it desirable that the urban renewal activities proposed for the areas be planned in their entirety; and WHEREAS, Title VI of the Civil Rights Act of 1964, and the regulations of the Housing and Home Finance Agency effectuating that Title, provide that no person shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination in the undertaking and carrying out of urban renewal projects assisted under Title I of the Housing Act of 1949, as amended; and WHEREAS, it is desirable and in the public interest that the Housing Authority of the City of Fayetteville, Arkansas, prepare a General Neighborhood Renewal Plan, presently estimated to cost $55,836.00, in that certain area, herein designated a General Neigh- borhood Renewal Area, located in the City of Fayetteville, County of Washington, and State of Arkansas, and described as follows: Beginning.at the intersection of Spring Street and Locust Street which is located at the Northwest corner of Lot 4, Block 11, of the Original Town of Fayetteville Plat; thence East along the center of Spring Street to the center of Town Branch; thence in a Southwesterly direction with said branch to the center of Huntsville Street; thence Northwest to the center of South Street; thence Southwest with the center of South Street to the center line of College Avenue; thence South with the center line of College Avenue to the center line of South Street; thence West with the center line of South Street to the center line of Locust Street; thence North with the center line of Locust Street to point of beginning. NOW, THEREFORE, BE IT RESOLVED BY THE CONFIISSIONERS OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS: Ir September 21, 1966 Page 26 1. That the proposed General Neighborhood Renewal Area des- cribed above is an area consisting of an urban renewal area or areas, which is of such size that the urban renewal activities in the urban renewal area or areas may have to be initiated in stages, consistent with the capacity and resources of the Housing Authority of the City of Fayetteville, Arkansas, over an estimated period of not more than 8 years. 2. That the undertaking of the preparation of the General Neighborhood Renewal Plan for the proposed General Neighborhood Renewal Area described above is hereby approved. 3. That it is the intention of this body to undertake an urban renewal project promptly upon completion of the General Neighborhood Renewal Plan and the preparation of an urban renewal plan for such project, which project shall embrace at least 10 per cent of the urban renewal area or areas within the General Neighborhood Renewal Area and shall be of the character contemplated by Section 110(c) of Title I. 4. That it is cognizant of the conditions that are imposed in the undertaking and carrying out of such urban renewal projects with Federal financial assistance under Title I. including those relating to a feasible method of relocation and the provision of necessary • local grants-in-aid, as well as the requirement of Section 102(d) of Title I that a General Neighborhood Renewal Plan conform to the locality's general plan and workable program for community improve- ment. 5. That the United States of America and the Housing and Home Finance Administrator be, and they hereby are, assured of full compliance by the Housing Authority of the City of Fayetteville, Arkansas, with regulations of the Housing and Home Finance Agency effectuating Title VI of the Civil Rights Act of 1964. 6. That the filing of an application by the Housing Authority of the City of Fayetteville, Arkansas, for an advance of funds from the United States in an amount not to exceed $55,836.00 for the preparation of a General Neighborhood Renewal Plan for the General Neighborhood Renewal Area described above is hereby approved and that the Chairman of said Housing Authority is hereby authorized and directed to execute and file such application with the Housing and Home Finance Administrator, to provide such additional information and to furnish such documents as may be required by the Administrator, and to act as the authorized representative of the Housing Authority of the City of Fayetteville, Arkansas. On motion by Bill Gould, seconded by Ellis Shelton, the Housing Authority unanimously voted to adopt Resolution No. 10-66 approving the undertaking of surveys and plans for an urban renewal project and filing of an application. RESOLUTION N0. 10-66 A RESOLUTION APPROVING UNDERTAKING OF SURVEYS AND PLANS FOR AN URBAN RENEWAL PROJECT AND FILING OF AN APPLICATION. WHEREAS, under Title I of the Housing Act of 1949, as amended (herein referred to as "Title I"), the Housing and Home Finance Administrator is authorized to extend financial assistance to local public agencies in the elimination and prevention of the spread of their slums and urban blight through the planning and undertaking of urban renewal projects; and WHEREAS, Title VI of the Civil Rights Act of 1964, and the regulations of the Housing and Home Finance Agency effectuating that Title, provide that no person shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination in the undertaking and carrying out of urban renewal projects assisted under Title I of the Housing Act of 1949, as amended; and WHEREAS, it is desirable and in the public interest that the Housing Authority of the City of Fayetteville, Arkansas, make . surveys and prepare plans, presently estimated to cost approxi- mately $101,704.00, in order to undertake and carry out an urban renewal project of the character contemplated by Section 110(c) of Title I, in that area proposed as an Urban Renewal Area, situated in the City of Fayetteville, County of Washington, and State of Arkansas, which is described as follows, to -wit: :I September 21, 1966 E�3�3 Beginning at the intersection of Meadow and Church Streets; thence East to the center of North East Street; thence South along the center of North East Street to the center of East Center Street; thence East along center line of East Center Street to a point North of the Northeast corner of Lot 5, Block 28 of Original Town Plat; thence South to the center line of Mountain Street; thence East along center line of Mountain Street to the center line of College Avenue; thence South along center line of College Avenue to the center line of Rock Street; thence West along center line of Rock Street to the center line of Block Avenue; thence North along center line of Block Avenue to center line of Mountain Street; thence West along center line of Mountain Street to center line Church Avenue; thence North along center line of Church Avenue to the point of beginning, containing in all Blocks 16, 17, 27, 29, 30 and Lots 5 through 15 of Block 28 all in the Original Town of Fayetteville Plat. N(VT THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS OF THE HOUSING AUTHORITY OF THE CITY OF FAYETTEVILLE, ARKANSAS: 1. That the proposed Urban Renewal Area described above is a slum, blighted, deteriorated, or deteriorating area appropriate • for an urban renewal project, that the development of such Area for predominantly nonresidential uses is necessary for the proper development of the community, and that the undertaking by the Housing Authority of the City of Fayetteville, Arkansas, of sur- veys and plans for an urban renewal project of the character con- templated by Section 110(c) of Title I in the proposed Urban Renewal Area is hereby approved. 2. That the financial assistance available under Title I is needed to enable the Housing Authority of the City of Fayetteville, Arkansas, to finance the planning and undertaking of the proposed Project. 3. That it is cognizant of the conditions that are imposed in the undertaking and carrying out of urban renewal projects with Federal financial assistance under Title I, including those relating to (a) the relocation of site occupants, (b) the provision of local grants-in-aid, and (c) the requirement that the locality present to the Housing and Home Finance Administrator, as a pre- requisite to approval of the application described below, a workable program for community improvement, as set forth in Section 101(c) of Title I, for utilizing appropriate public and private resources to eliminate and prevent the development or spread of slums and urban blight. 4. That the United States of America and the Housing and Home Finance Administrator be, and they hereby are, assured of full September 21, 1966 Page 29 10 compliance by the Housing Authority of the City of Fayetteville, Arkansas, with regulations of the Housing and Home Finance Agency effectuating Title VI of the Civil Rights Act of 1964. 5. That it is the sense of this body (a) that a feasible method for the relocation of individuals and families displaced from the Urban Renewal Area, in conformity with the requirements of Title I. can be prepared, and (b) that local grants-in-aid can and will be provided in an amount which will be not less than one-fourth of the Net Project Cost of the Project and which, to- gether with the Federal capital grant, will be generally equal to the difference between Gross Project Cost and the proceeds or value of project land sold, leased, or retained for use in accord- ance with the urban renewal plan. 6. That the filing of an application by the Housing Authority of the City of Fayetteville, Arkansas, for an advance of funds from the United States of America in an amount not to exceed $101,704.00 for surveys and plans for an urban renewal project in the proposed Urban Renewal Area described above is hereby approved, and that the Chairman of said Housing Authority is hereby authorized and directed to execute and file such application with the Housing and Home Finance Administrator, to provide such additional information and to furnish such documents as may be required by the Administrator, and to act as the authorized representative of the Housing Authority of the City of Fayetteville, Arkansas. r� PASSED this day of 2Ir , 1966.
