A meeting of the Fayetteville Firemen's Pension and Relief Fund was held at 11 :00 a.m.
on September 30, 2004 in Room 326 of the City Administration Building.
PRESENT: Marion Doss, Pete Reagan, Danny Farrar, Robert Johnson, Mayor Coody, City
Clerk Sondra Smith, City Attorney Kit Williams and Marsha Farthing
ABSENT: Ronnie Wood
Mayor Coody called the meeting to order.

Approval of the Minutes:
• Pete Reagan moved to approve the August 26, 2004 minutes. Danny Farrar seconded the
motion. Upon roll call the motion carried 6-0. Ronnie Wood was absent.
Approval of the Pension List
Robert Johnson moved to approve the October, 2004 Pension List. Marion Doss seconded
the motion. Upon roll call the motion carried 6-0. Ronnie Wood was absent.
Loner Investments:
A copy of the Investment Report was presented to the Board.

Pete Reagan: The market is down put we are up 3.7%.
Mayor Coody: We're up 3.7%.
Kit Williams: For the year probably.
Danny Farrar: Yes, 3.8% last month and 3.7% this month.

Benefit Increase Resolution:
A copy of the Benefit Increase Resolution increasing the widow benefits for the widows of
volunteer firemen was given to the Board to approve and sign.
Kit Williams: Has everyone signed the resolution?
Pete Reagan: Everyone put Ronnie Woods.
Kit Williams: Is he going to be here today?
Pete Reagan: No, he is out of town.
Kelly Skelton Colleee Enrollment:
Sondra Smith: We received Kelly Skelton' s Proof of Enrollment.

Sondra Smith: We also received the Proof of Enrollment from Kim Skelton.
New Business:
Procedure for Notification of the Death of a Pensioner:
Sondra Smith: There is a memo in your packet from Denise Grizzle in accounting asking us to
set up a procedure for notification of a death of a pensioner.
Accounting has asked that I always supply them with a death certificate on a pensioner that has
deceased. It is very difficult to get a death certificate from the family of a pensioner when there
is no surviving spouse. We need to set up a procedure on notification of a death of a pensioner
and what we require as proof of death. Right now I depend on Marion Doss to notify me of
deceased pensioners. We need to decide if an obituary will be sufficient or if we want to
purchase a certified death certificate from the State. It will take approximately six to eight weeks
to get a death certificate from the State.

Marion Doss: I would be in favor of accepting a copy of a death certificate; I don't see where
we need one from the State.

Sondra Smith: The problem with that is if there is no spouse I don't know who the family
members are to be able to contact them to get a copy of the death certificate. Family members
are not listed on the affidavit unless they are dependents.
Kit Williams: I would think any reasonable evidence that the City Clerk believes is creditable
would be okay. I wouldn't limit it. I would say an obituary notice in the paper is pretty strong
evidence.
Marion Doss: I would say a copy of the obituary and then if there is a funeral home listed we
can contact the funeral home.
Kit Williams: It is always nice to get a death certificate if we can but we shouldn't put that as
an absolute requirement.
Sondra Smith: I have called a funeral home in the past and they are not allowed to give any
information out.
Pete Reagan: They can't.
Mayor Coody: If we see an obituary and quit paying them and they are still alive we will hear
from them.
• Sondra Smith: I would assume an obituary would be sufficient.
Marion Doss: If you will accept that then I am willing to.
Sondra Smith: I don't have a problem with the obituary it is accounting that has requested a
death certificate.
Kit Williams: We would like to get you one Marsha but sometimes we might not be able to.
Marsha Farthing: Thanks fine.
Pete Reagan: I can see where we should make an attempt.
Sondra Smith: If there is a widow and they want the benefit there is no problem in getting a
death certificate, it is the ones that do not have a surviving spouse.
Kit Williams: Or, if the widow dies.
Sondra Smith: I would like a motion so I will have it in the minutes for accounting.
Kit Williams: I think it should be any evidence that you find creditable. A death certificate is
desired but not required.

Marion Doss moved to accept any evidence that the City Clerk finds creditable as proof of
death. Danny Farrar seconded the motion. The motion passed 6-0. Ronnie Wood was

Dear Board of Trustees:
On September 30, 2004 you passed a resolution to allow the widows not covered
by Act 1370 of 2003 to be increased to a $ 100.00 base benefit.
In order for a benefit increase to be granted several components must be met.
Those components are: A) the annual employer contribution must equal or exceed the
actuarially computed employer rate and, B) sufficient fund assets must exist to cover
100% of liabilities for active member contributions and current retired lives plus 100% of
liabilities for service rendered by active members OR C) the funded percentage test must
be at least 97%. These provisions are detailed in PRB Board Rule 94.
The enclosed benefit increase valuation letter dated August 13, 2004 shows the
proposed benefit increase of a $ 100.00 base benefit for widows may be implemented and
still permit the fund to remain actuarially sound. Therefore, I certify this benefit increase
may be granted.
My decision is subject to review by the Arkansas Fire and Police Pension Review
Board. The next meeting is scheduled for December 15, 2004 at 9:30 a.m. in Little Rock.
However, this letter serves as authorization for your fund to implement this increase
effective with the date of your resolution September 30, 2004.

increase is feasible. I have also enclosed a copy of the minutes from the August 26, 2004
meeting. It is my understanding that the resolution must be approved by the Arkansas

A RESOLUTION TO ENACT A BENEFIT INCREASE
FOR WIDOWS OF VOLUNTEER FIREFIGHTERS TO
INCREASE THEIR MONTHLY BENEFITS TO A
MINIMUM OF $100.00 PER MONTH
WHEREAS, Jody Carreiro, approved actuary for the Arkansas Fire and Police
Pension Review Board has certified that increasing the benefits up to a minimum of
$ 100.00 per month for widows of volunteer firefighters would not cause the Fayetteville
Firefighters Pension Fund to become actuarially unsound.
NOW, THEREFORE, BE IT RESOLVED BY THE FAYETTEVILLE
FIREFIGHTERS PENSION BOARD:
Section 1 : That the Fayetteville Firefighters Pension Board unanimously
approves the benefit increase to widows of volunteer firefighters up to a minimum of
$ 100.00 per month effective immediately and request approval of this benefit increase
form the Arkansas Fire and Police Pension Review Board and the Executive Director.
We sign our names below on this 30'h day of September, 2004, to signify our
• approval of this Resolution requesting the benefit increase for widows of volunteer
firefighters.

Thanks for this info. Denise is requesting that the board define what month they intended the increase to
be effective. Since the resolution reads September 30th, I have included retro pay for September and
October on the schedule that I will be sending to you tomorrow. If the board did not intend to include
September, I will change it per their approval.
