REQUESTS FOR QUALIFICATIONS
ATTORNEY WITH EXPERIENCE IN SECURITIES LAW

CITY OF FAYETTEVILLE, ARKANSAS
The Fire Pension And Relief Board of Fayetteville, Arkansas is requesting
statements of qualifications for an attorney or law firm to handle a possible securities
and breach of contract case involving a national brokerage company.
Scope of Services:
Investigate, analyze, litigate and appeal a potential case against Merrill Lynch on
behalf of the Fire Pension and Relief Board of Fayetteville, Arkansas regarding possible
securities violations, breach of contract, misrepresentation and other causes of action.
Requirements:
Applicants must be licensed to practice law in Arkansas and Federal Courts with
ten years of litigation experience. Applicants must have litigation experience in the
securities law area involving a national or regional stock brokerage firm. Applicants
must have an office in Fayetteville, Arkansas or associate with a firm with an office in
Fayetteville and be available in person for frequent briefings and consultation with the
Fire Pension and Relief Board of Fayetteville, Arkansas.
Selection Process:
•
A. Fees shall not be included with the qualifications and are not considered as a
basis of selection for the rating of highest qualified firms. However, only an attorney or
law firm that is willing to represent the Board on a purely contingent fee basis could be
retained. Fees will be considered during the negotiating process and will be a factor in
the award of any proposed contract.
B. The City of Fayetteville professional selection policy provides for the
procurement of professional services based upon professional qualifications. A
selection committee, as described m PUR-12 shall review and rate the submitted
qualifications The qualifications will be evaluated based upon a point system using the
percentages indicated below.
C. In evaluating the qualifications of each firm or individual, the committee shall
consider the following (assigning point ranges for each element from 20% to 40%, so
that the total of the four elements combined equals 100%):
1. The specialized experience and technical competence of
the firm or individual with respect to the type of
professional service required;
2. The capacity and capability of the firm or individual to
perform the work in question, including specialized
services, within the time limitations fixed for the
completion of the project,
3. The past record of performance of the firm or individual
with respect to such factors as control of costs, quality of
work and ability to meet schedules and deadlines, and

4. The firms or individual proximity to and familiarity with

Miscellaneous:
1. Qualifications must be submitted no later than December 23,
2002, 4:30 P.M. Qualifications received after this date and time
will be returned unopened.
2. Qualifications should be sent or hand -delivered to: Peggy Vice,
Purchasing Manager, 113 West Mountain, Rm. 306; Fayetteville,
AR 72701.
3. Seven (7) copies of the qualifications should be provided.
4. Qualifications should be labeled "RFQ 02-" on the outside of
the envelope.
