MINUTES OF MEETING OF FIREMEN'S PENSION
AND RELIEF FUND BOARD
MARCH 4, 1974
4:30 P.M. CITY MANAGER'S OFFICE
Present; Donald Grimes, Chairman; Pat Tobin, Treasurer; Sandra Carlisle,
Secretary; Charles McWhorter, Fire Chief; and Fire Pension Board members
Larry Poage, Bill Boudrey, and Richard Baird.
Chairman Grimes called the meeting to order. Minutes of the February 4, 1974
meeting had been previously distributed to the Board members. Charles McWhorter
moved the minutes be approved. Larry Poage seconded the motion. The motion
passed unanimously.
Mr. Grimes read the attached letter from City Attorney Jim McCord concerning
widow's benefits. The secretary was directed to write Mrs. C. Frank Johnson
in regard to said letter. Charles McWhorter moved Mrs. Johnson was not
elegible for benefits, seconded by Richard Baird. Motion passed unanimously.
Charles McWhorter moved the Pension Fund Authorization List be accepted.
Richard Baird seconded. Motion passed unanimously.
Charles McWhorter presented a letter signed by Samuel W. Watts stating he
did not want to join the Pension Fund. Richard Baird moved the letter be
entered in the minutes, seconded by Larry Poage. Unanimously passed.
(A copy of said letter is attached hereto.)
Pat Tobin reported that Charlie Jordan paid in $208.49 and was now a
member of the Pension and Relief Fund.
Charles McWhorter reported that he would notify Larry Mason regarding re-
instatement for past services. Mr. Mason will have until the next meeting
to decide if he wishes to repay previous pension funds withdrawn.
Pat Tobin reported that he invested $35,000.00 for four (4) years at
7.55% interest at the Mcllroy Bank.
There being no further business, Bill Boudrey moved the meeting be adjourned.
Charles McWhorter seconded the motion which passed unanimously. Chairman
Grimes declared the meeting adjourned.

Eligibility of Firemen's
Widow for Firemen's Relief
and Pension Fund Benefits
where marriage occurs after
fireman retires
Pursuant to your request, I have reviewed the Arkansas Firemen's
Relief and Pension Fund Act in order to determine whether or not
the widow of a fireman is entitled to benefits under the Act if
her marriage occurs after the fireman's date of retirement. Ark.
Stat. Ann. Sec. 19-2208 provides that if any retired fireman shall
marry, after his retirement, his widow, or her child or children
shall not receive benefits under the Firemen's Relief and Pension
Fund Act.
