Matt Bodishbaugh, Chairman, has called a meeting for Thursday, July 29, 1999, 1 : 15 P.M. at 113
W. Mountain St., City Administration Building room 113, to hear the appeal of Jim Key,
Wischmeyer Architects, appealing the decision of the Building Official.
Attached you will find the following:

Mr. Key has requested the use of a pull-down stair as access and egress from an attic storage in a
multi-tenant business (office) occupancy. The proposed storage is a room that is floored with
finished walls and ceiling. This is a Type VI (combustible), unprotected, and unsprinklered
building.
The room will have conditioned air and electrical lighting. The area of the room can vary
depending on the size of the tenant space. There are a total of approximately 6,000 square feet
available for the proposed attic storage rooms with a total ground floor leased space of
approximately 24,400 square feet.
The proposed attic room does not conform to code requirements for a mezzanine therefore, the
building code recognizes the room as a second floor that requires protected egress. The Building
Code is silent with regard to pull-down stairs.
The decision of the Building Official requiring a protected egress recognized by the Building
Code, that is, a stairway with one hour enclosure and one hour doors at the top and bottom, from
a tenant's attic storage room is being appealed. The appellant suggests that this is not an
occupied room except when taking and removing items stored.

ATTIC STORY - any story situated wholly or partly in the roof , so designated ,
arranged or built as to be used for business ; storage or habitation :
ZANINE - one or more intermediate levels between the floor and ceiling of a

STORY - that portion of a building included between the upper surface of a floor
and upper surface of the floor or roof next above .
40242 : 3 MEZZANINES : A mezzanine shall not be counted as a story when it meets
the following requirements :
402 . 2 . 3 . 1 The construction of a mezzanine shall be consistent with the type
of materials and fire resistance ratings required for the building in which
it is constructed .
402 . 2 . 3 . 2 The total area of mezzanines within a room shall not exceed one -
third that of the . room or space in which they are located . Enclosed space
under a mezzanine shall not be included in a determination of the size of
the room or space in which the mezzanine is located :
402 : 2 : 3 : 3 All portions of a mezzanine shall be open and unobstructed to the
room in which it is located except for walls not more than 42 inches ( 1067
mm) high , columns and posts .
EXCEPTIONS :
1 . Mezzanines or portions thereof need not be open to the room in
• which they are located , provided the occupant load of the aggregate
area of the enclosed space does not exceed 10 .
2 . In sprinklered buildings , a mezzanine having two or more means of
egress need not open into the room in which it is located , if at least
one of the means of egress provides direct access to an exit at the
mezzanine level .

701 . 2 SHAFT ENCLOSURES
openings through a floor and penetrations through a floor shall be protected
a shaft enclosure in accordance with 701 . 3 .
EXCEPTIONS :
1 . A shaft enclosure is not required for openings totally within a
dwelling unit and connecting four stories or less .
2 . A shaft enclosure is not required for a floor opening which
a . is not part of the required means of egress , and
b . is not concealed within the building construction , and
c . does not connect more than two stories , and
d . does not connect with a stairway or escalator serving other floors ,
and
e . is not open to any corridors in Group I and R Occupancies or to
corridors on nonsprinklered floors in other occupancies , and
f . is separated from floor openings serving other floors by construction
conforming with required shaft enclosures .
• 3 . A shaft enclosure is not required for penetrations by pipe , tube ,
conduit , wire , cable , duct and vents protected in accordance with 705 . 1 . 4
or 1001 . 3 . 3 .
4 . A shaft enclosure is not required for floor openings complying with the
special provisions for covered malls or atriums .
5 . A shaft enclosure is not required for approved masonry chimneys where
annular space protection is provided at each floor level in accordance with
1001 . 3 . 5 .
6 . A shaft enclosure is not required for floor openings in an open parking
garage .
7 . A shaft enclosure is not required for floor openings between a
mezzanine and the floor below .
8 . A shaft enclosure is not required in fully sprinklered buildings for an
escalator opening protected in accordance with one of the following
alternatives :
Alternative A - ( 1 ) The area of the floor opening between stories shall
not exceed twice the horizontal projected area of the escalator , and
( 2 ) Draft curtains and special sprinkler head locations shall meet the
requirements of NFiPA 13 , and
• ( 3 ) In other than Group B and M occupancies the escalator openings shall
not connect more than four stories , or
Alternative B - The opening is protected by approved power operated
automatic shutters at every floor opening . The shutters shall be of 2
Z/2
noncombustible construction and have a fire resistance rating of not less
than 1 1/ 2 hours . The shutter shall close immediately upon the automatic
detection of smoke by an approved device and shall completely shut off
• the floor opening . The escalator shall stop when the shutter begins to
close . The shutter shall operate at a speed of not more than 30 feet
( 9144 mm) per minute and shall be equipped with a sensitive leading edge
to arrest its progress when in contact with any obstacle , and to continue
its progress after release .
