MINUTES.. OF THE MEETING
OF THE BOARD OF CONSTRUCTION APPEALS
A meeting of the Board of Appeals was held on January 30, 1992 at
the City Administration Building, Room 111, Fayetteville, Arkansas.
MEMBERS PRESENT: Neal Albright, Fred Sherman and Tommi Perkins.
OTHERS PRESENT: Steve Ward, CEO of Chamber of Commerce, Jeff
Koenig, President of Chamber of Commerce; Dennis Becker,
Architect, Rosilee Mugley, Senior Permit Clerk; Freeman Wood,
Inspection Superintendent, and Alett Little, Planning Management
Director.
The meeting was called to order by Chairman Neal Albright at 4:07
p.m.
The variance request was submitted by Dennis Becker, representing
the Chamber of Commerce. The appeal was for a request to install a
one in eight ramp instead of the required one in twelve slope
inside the building for the physically handicapped to use the
restrooms without using the existing steps.
According to the building code, a one in twelve slope is required
for the handicapped. An exit ramp is one in eight.
Dennis Becker showed the plans for the renovation and explained why
the ramp would need to be on the side closest to the restrooms.
The Chamber of Commerce plans to enlarge their meeting room and it
would not be feasible to have the ramp come in on the opposite side
of the restrooms in the building . The ADA says "readily
accessible" (as long as you can provide access or assistance). The
Chamber will have two attendants who will always be at the front
counter. There will be a sign that states, "Assistance is
available" if help is needed to get up the ramp. Mr. Becker
requested the Board of Appeals grant the variance so that the
restrooms would be better accessible to the handicapped. To have
a one in twelve slope in this area would create a hardship, so we
are proposing a simple one in eight which satisfies the building
code and in addition there will be attendants to provide any needed
assistance."
• The construction plans were discussed regarding the renovations and
the feasibility of placing the ramp according to the plans.

After several minutes of discussion, Tommie Perkins made the motion
to grant the variance. Fred Sherman seconded the motion with the
stipulation that the ramp meets the ADA requirements.
Neal Albright called for a vote. The vote was unanimous. The
motion passed and the variance was granted.
The meeting adjourned at 4:25 p.m.

REASONS FOR REQUESTING VARIANCE:
Renovation of the existing building does not reasonably and economically allow for the
required slope.
INTERPRETATION OF BUILDING OFFICIAL APPEALED FROM:
1982 SSBC Section 508.Z (b) 2 and section 1116 (f) requires a. slope not greater than
one (1) foot rise in twelve (12) feet for the physically handicapped access.
REASONS DECISION OF BUILDING OFFICIAL SHOULD BE MODIFIED OR REVERSED:
Assistance will be readily available and will be provided anytime the building is
open. Hand rails along ramp and signage explaining/asistance will be,provided.
