MINUTES OF THE MEETING
OF THE BOARD OF CONSTRUCTION APPEALS
the Board of Construction Appeals was held on April 4,
City Administration Building, Room 326, Fayetteville,
Members Present: Neal Albright, Tommi Perkins, J. Palmer Boggs and
Gary Deckart.
Others Present:
Bert Rakes, Mickey Jackson and Beverly Erwin.
The meeting was called to order by Chairman Albright at 4:25 p.m.
The item on the agenda was from Albert Skiles for a variance on the
requirements of bedroom window sizes for a house which is already
constructed at 2673 Colette.
Because Mr. Skiles was not contacted for the meeting, it was left
up to the members of the board to decide whether to hold the meeting
or to wait until Mr. Skiles could attend. It was decided they would
go ahead and have the meeting because it wouldn't change their vote
for him not being at the meeting.
It was explained by Mr. Bert Rakes that the window opening that was
in the house is 18 1/2" X 35". There are two (2) windows side by
side with a mull between them. The total square footage is 4.49 square
foot. The code requires the opening to be 24" high and 20" wide and
have 5 square foot of openable area.
Perkins repeated what had been told to her in discussion that Mr. Skiles
had been told when he submitted the plans that the windows would not
meet the requirements.
Albright asked if overall the window would be about 6 feet wide.
Rakes commented the two (2) windows would be. But there was a mull
between them and when the mull was knocked out you were knocking out
the window.
Albright commented that it doesn't make them any higher when you knock
the mull out.
Rakes stated he was correct.
In answer to Perkins question, Rakes stated the minimum height is
24 inches.
Albright said that what they have is two windows 18 1/2" X 35" side
by side.
Rakes said there is two windows on one wall and another two windows
on another wall that are identical. The opening in each window is

Boggs made a move that if they don't meet the requirements they deny
the request.
Jackson asked if the house is finished. The solution will be to go
back and cut a new opening or find windows which meet the requirements.
He stated apparently he can't buy a window to fit in this opening
whish would meet the requirements.
Perkins stated he would have to buy windows that will meet the node
requirements.
Jackson asked if he would have to alter the building to make the windows
fit.
Rakes said he has some alternatives. The total window is over 3'
high with half of it being fixed. If he took and made a new window
frame for that and made a window that would swing out it could be
done in the same frame. There would be some expense involved. One
window is all that is required to meet the code in each bedroom.
Jackson stated his summary is a code with reasonable requirements
that we should stand behind it and enforce it. It seems he was warned
before the house was built.
Perkins seconded Mr. Boggs motion.
Boggs stated it seems there has been recent presidence for similar
action.
After no further discussion, the vote was unanimous for denial of
the variance.
The meeting was adjourned at 4:40.

NOTE: A fee of $10.00 shall accompany each Notice of Appeal.
Section 111.5 of the Building Code provides that the Board shall
meet within ten (10) days after Notice of Appeal has been re-
ceived. Section 112.1 of the Building Code provides that Notice
of Appeal shall be filed within ninety (90) days after the de-
cision is rendered by the building official.
