HomeMy WebLinkAbout1985-05-14 - Minutes• MICROFILMED MINUTES OF THE MEETING OF THE BOARD OF CONSTRUCTION APPEALS A meeting of the Board of Construction Appeals was held on May 14, 1985, at the City Administration Building, Room 111, Fayetteville, Arkansas. MEMBERS PRESENT: J. Palmer Boggs, Tommi Ackley -Perkins, and Gary Deckart. OTHERS PRESENT: Freeman Wood --Inspection Superintendent, and Beverly Erwin --Inspection Clerk. The meeting was called to order by acting chairman Boggs at 4:08 p.m. In answer to Ackley -Perkins question, Wood stated that he was representing the Arkansas State Highway Department. Boggs asked who proposed that the bridge be built. Wood stated that the State Highway Department did. • The members took a few minutes to read over letters from the State Highway Department and the Corps of Engineers. Deckart asked if the reason for the 0.1 foot increase is because of the pilings and abutments that would cause a small amount of back pressure. Wood stated that he is correct. Deckart also stated that the letter said one hundred (100) foot in back of the bridge. Wood stated that one hundred (100) foot to the South of the bridge or South which would be upstream which would be Southeast back behind Paradise Valley Golf course. At that point is where it would. be 0.1 foot above the 1.0 foot level that is allowed in the flood plain ordinance, so we are talking about 0.1 foot over the allowed level. Deckart asked if there are any residential structures that would be effected if it did flood to that point. Wood stated no. Wood stated that the only structures that are close to it are some town- houses which are up on a bank above it and the golf course on the other side. The only building on the golf course is a hut which would not be reached. He pointed out that 0.1 foot is not very much at all. Page 2 Board of Const. Appeals May 14, 1985 Boggs asked where this would affect the creek, and would the increase be where the creek shallows out. Wood stated that the ASHTD went to the Corp of Engineers and had them work this project up. The Corp of Engineers is who did the flood plain maps. Wood stated that he probably would not havecaught the increase. The Corp of Engineers caught it and recommended that they go to the Board for a variance. Ackley -Perkins stated she saw no problem with a variance, if they felt they needed one. Wood stated they needed one. He commended them in saying that they were nice enough to ask for the variance instead of just going ahead and doing it and not saying anything to us.. He said that a representative would have come up to the meeting but he didn't feel it was necessary for them to come up from Little Rock. Wood stated he felt that once the bridge was installed that it would help the situation in general instead of hindering it. It wouldn't help the water situation any but would help eliminate other safety hazards that are more life endangering than 0.1 foot increase of flood water. Deckart made a motion that the variance be accepted. Ackley -Perkins seconded. After no discussion, the motion carried with unaminity. We have run the backwater analysis of the proposed bridge using the flood insurance data for Mud Creek-. A copy of the floodway data with the conditions of the flood insurance study and a copy of the same with the new bridge is enclosed. Please note that the flood elevations just upstream from the new bridge are lower. Only at bridge section 4.000 is the 100 -year flood elevation raised 0.1 foot above the 1 -foot allowed floodway encroachment. It is recommended that a variance be obtained from the city of Fayetteville for the 0.1 -foot rise approximately 100 feet upstream from the bridge. Section 111.5 of the Building Code provides that the Board shall meet within ten (10) days after Notice of Appeal has been re- ceived. Old Missouri Road Washington County The Arkansas State Highway and Transportation Department (AHTD) has completed the design of a replacement for the Mud Creek Bridge and Approaches at Old Missouri Road in Fayetteville. It has been determined that the AHTD must request a Variance from the City in order to construct this project in compliance with local Building and Development Regulations. The Little Rock District Corps of Engineers analyzed this pro- ject for the City and the AHTD. They concluded that although the project did not increase flood elevations upstream of the proposed bridge, it did produce a 0.1 foot increase above the 1.0 foot increase in the 100 -year flood elevation allowed with the floodway encroachment. The Corps considered this structure to be consistent with the procedure for good floodplain manage- ment and recommended that the AHTD obtain a Variance from the City for the 0.1 foot rise approximately 100 feet upstream from the bridge. The AHTD Hydraulics Section certifies that the design of this project does meet the floodplain objectives of Fayetteville. We further certify that the project satisfies all requirements for granting of a Variance as listed in Section 2944 of the City of Fayetteville April 23, 1985 • Page 2 • • Fayetteville Code of Floodplain Building and Development Regula- tions. We request that the Building Board of Adjustment and Appeals grant a Variance for the construction of this project. A copy of the letter from the Corps dated April 11, 1985 and construction plan sheets from this project are included for your use.
