MINUTES OF THE MEETING
OF THE BOARD OF CONSTRUCTION APPEALS

A meeting of the Board of Construction Appeals was held on December
27, 1984, at the City Administration Building, Room 111, Fayetteville,
Arkansas.
Members Present: J. Palmer Boggs, Tommi Ackley -Perkins, Dale Cress.
Others Present: Kim Fugitt, Larry Poage--Fire Inspector, Freeman
Wood --Inspection Superintendent, Beverly Erwin --Inspection Clerk.
The meeting was called to order by acting chairman Boggs at 4:07 p.m.
The variance to be reviewed was for American College, who was represented
by Kim Fugitt.
Boggs stated the variance was to construct a building with combustible
materials in the fire zone. He asked the representative what the
function of the building was.
Fugitt stated the function was a private owned educational facility
like a vo-tech.
Boggs stated it is economic but is in the fire zone.
Fugitt stated the size of the building is nine thousand (9,000) square
feet. The building meets all requirements except for the type six
(6) construction.
Wood stated codes allow nine thousand (9,000) square feet 1n'type
six (6) construction for business and educational. We can issue the
permit if he uses type six (6). construction except for the fire zone
requirements.
Fugitt stated the building is masonry.
Boggs asked if the framing was the main concern.
Fugitt stated the wood trusses are the part that doesn't comply.
Poage asked if class five (5) would allow this type of building.
Wood stated yes.
Boggs stated they would need thirty (30) feet of clearance around
the building.
• Ackley asked what Fugitt meant when he wrote unobstructed clearance
on his application.
Fugitt stated there would be parking around the building except on
the North side which has landscaping.
Poage asked Fugitt what their plans were in the future if they needed
more room.
Wood stated they would have to have a fire wall or sprinkler system.
The new construction would have to come back to the Board of Construction
Appeals for approval, if they approved the construction with the stipu-
lation that a thirty (30) foot clearance remain around the building.
Poage asked how they planned on expanding in the future.
Fugitt stated the center of the building has a courtyard and if expansion
is needed that they would build in the courtyard.
Poage asked if they would have to have a firewall if the courtyard
was enclosed.
Wood stated additional property would be required if they added on.
Boggs asked Wood if someone else bought the building and changed the
use would it still have to come back to the Board for approval if
they planned an addition.
Wood stated they could put any stipulation they wanted on the approval.
Boggs asked if they could stop them from using the courtyard.
Wood stated yes.
Cress stated that they would have to get a permit to enclose the courtyard.
Ackley -Perkins asked if they would have to come back to the Board
of Construction Appeals.
Wood stated if they didn't want to sprinkle it they would have to
come to the Board of Construction Appeals.
Ackley made a move to grant the variance without further restrictions.
Cress seconded.
After no discussion, the vote was unanimous, 3--0.
The meeting adjourned at 4:17.

REASONS FOR P£QUESTING VARIANCE•
Due to scope of building and location we feel this type construction is
adequate to protect the safety=and'welfare'bf.the'p6blic':while^.being
economically more attractive to the owner.
INTERPRETATION OF BUILDING OFFICIAL APPEALED FROM:
See Section 301 S.B.C.C.I.
REASONS DECISION OF BUILDING OFFICIAL SHOULD BE MODIFIED OR
REVERSED:
Proposed building has a 30'-0° minimum unobstructed clearance on
all four sides. The exterior is brick, concrete or stucco veneer
(noncombustable materials) while the roof meets the standards of
section 706 type "B" roofing (Standing seam metal). The building
square footage (with allowable increases) is well\ below the maximum
allowable area for type VI construction whether business or educational
occupancy is used. Finally, there exists a fire sub -station less than
z mile from the property in question. _

NOTE: A fee of $10.00 shall accompany each Notice of Appeal.
Section 111.5 of the Building Code provides that the Board shall
meet within ten (10) days after Notice of Appeal has been re—
ceived. Section 112.1 of the Building Code provides that Notice
of Appeal shall be filed within ninety (90) days after the de—
cision is rendered by the building official.
