MINUTES OF THE METING
OF BOARD OF CONSTRUCTION APPEALS
August 3, 1984
A meeting of the Board of Construction Appeals was held on August
3, 1984 at the City Administration Building, Room 111, Fayetteville,
Arkansas.
Members Present: J. Palmer Boggs, Dale Cress, Tommi Ackley -Perkins.
Others Present: Don Giles, Freeman Wood --Building Superintendent,
Beverly Erwin --Inspection Clerk.
The meeting was called to order by acting chairman, J. Palmer Boggs
at 4:20 p.m.
The variance to be reviewed was presented by Don Giles, Vice President
of First South to be located at 2971 N. College. They were requesting
a variance to build a wood frame building in the fire zone.
Boggs asked Wood what the building was.
Woods stated the building was a prefabricated structure out of wood,
which is combustible.
Cress asked what the location of the building was.
Wood stated it was located at Wal -Mart's parking lot on N. College.
He also stated the building was within 150' of the highway so it was
in the fire zone.
Giles stated the building would be facing Wal-Mart. He also stated
it would be about'2 lots away from Hardees.
Boggs asked if there was a chance of Hardees building within 20' of
this building.
Giles stated if they wanted to they would have to get a variance from
the Board of Construction Appeals.
Boggs asked why they wanted this type of building.
Giles stated the building was built off site and brought in and put
together. He also stated the building would meet the Standard Building
Code and other codes.
Cress stated that it doesn't meet fire codes but does it meet building
codes.
Wood stated he hasn't seen any plans on the building but it will have
to meet the building codes or he won't issue the building permit

Boggs asked if they haven't discussed changing the boundaries of the
fire zone before.
Wood stated they have discussed changing the zone but they haven't
talked to the Board of Directors concerning this. He stated that
if they wanted it changed to draft a letter to the Board of Directors.
Cress stated he thought they should stay late and discuss the fire
zone.
Boggs asked Giles the functions of the building.
Giles stated it was a Savings & Loan establishment.
Cress asked for Wood's comments on the setbacks.
Wood stated he was comfortable with the setbacks. He also stated
the building would have a fifteen (15) foot fire lane around the building
as required by Arkansas State Fire Code.
Ackley -Perkins made a move to grant the variance. She stated she
saw no problems with it.
Cress seconded.
Boggs stated he would like to get it settled about the fire zone.
This was the second variance from the fire zone this year.
Cress stated he thought a letter needed to be drafted for the fire
zone to be moved back
After no further discussion, the vote was unanimous for granting the
variance.
Giles stated that they were also constructing a building on Dickson
Street.
Cress asked if this variance was for 2971 N. College.
Giles stated yes.

Boggs stated they should draft a letter to the Board of Directors
asking to push the fire zone back. He also stated he felt Wood would
be better at drafting the letter.
Wood stated the letter would need to come from the Board of Construction
Appeals, but if they would decide on the proposed fire zone he would

draft the letter for them and then contact them to sign it.
Cress asked about the fire zone, if there was a first and second fire
zone.
Wood stated there was a first and second fire zone. The first fire
zone prohibits wood construction or hazardous uses.
Cress asked if the fire zone was enforced before Standard Building
Code got so strict.
Wood stated that the fire zone has been enforced for 30 years or more.
He also stated the intent of the fire zone was to protect the buildings
that were grouped together because firewalls are required.
Boggs asked what the hazardous uses were.
Wood gave some examples of the hazardous uses out of the Arkansas
Fire Code. He went further to state that no one has wanted to store
more than the code allows.
Ackley -Perkins asked if most things in the fire code aren't covered
somewhere else.
Wood stated yes they are covered somewhere else but are prohibited
above a certain point.
Ackley -Perkins asked if their insurance would change.
Wood stated if the letter goes to the Board of Directors they would
have' to check with insurance companies and see what they said. He
has checked with insurance companies and they wouldn't tell him if
it would make a difference.
Wood stated the way it's evaluated is each category is broken down
into departments, for example, fire zone, number of fire trucks, and
number of firemen.
Cress asked if the fire zone would be worth very many points.
Wood stated it was less than one hundred, since that was the limit,
but he wasn't sure how much each department was worth.
Boggs stated if they didn't draft the letter they would have to meet
every time a variance came up to decide whether to grant it or not.
Ackley asked if there was a thirty (30) foot set -back for the building.
Wood stated the code didn't require a thirty (30) foot open space

around the building. This was just something that the Fire Department
and the Inspection Department started using as a guide. He went further
to state an example, the maximum size a wood building can be is 7000
square feet, but if it has a thirty (30) foot open space around it
the size can be increased approximately 40% which would make it approx-
imately 10,500 square feet.
Cress stated that the fire department have been present at other meeting
like this one and they feel if there is a thirty (30) foot space around
the building, they can get the fire out before it spreads to another
building.
Wood stated if firewalls are used and constructed correctly, they
will stop a fire from spreading.
Cress made a move to draft a letter to the Board of Directors to change
the fire zone from the existing fire zone which as follows: 150 feet
either side of North to the City limits on Highway 71, South to the
City Limits on Highway 71 and, West to the City Limits on Highway 62
to 150 feet either side of Highway 71 North to North St., Highway
71 South to Fifteenth St. and West Highway 62 to the Overpass, and
East Huntsville East to Ray St. and let the Standard Building Code
control this.
The meeting adjourned at 4:55.

Section 111.5 of the Building Code provides that the Board shall
meet within ten (10) days after Notice of Appeal has been re-
ceived. Section 112.1 of the Building Code provides that Notice
of Appeal shall be filed within ninety (90) days after the de-
cision is rendered by the building official.
