HomeMy WebLinkAbout1984-03-19 - Minutes• MICROFILMED MINUTES OF THE MEETING OF BOARD OF CONSTRUCTION APPEALS March 19, 1984 A meeting of the Board of Construction Appeals was held on March 16, 1984 at the Central Fire Station, located at 303 W. Center, Fayetteville, Arkansas. Members present: Neal Albright, Dale Cress, Tommi Ackley -Perkins, Paul Parker. Others present: Joe Kisor, Joe Chamberlin, Freeman Wood --Building Superintendent, John Durham --Fire Inspector, Beverly Erwin --Inspection Clerk. The meeting was called to order by Chairman Neal Albright at 4:05 p.m. The first variance to be reviewed was submitted by Joe Kisor of Kisor Worley Inc. to leave the stairway at 2375 Twelve Oaks Dr. Albright asked for comments from Kisor. Kisor stated he is wanting a variance to leave the interior stairway as is on Twelve Oaks Dr. He stated this is a Kingsberry Prefab house. The stairway was not part of the house and was added by Kisor/Worley Inc. This is the first house they have built in Fayetteville and they were unaware of the ordinance stating dimensions of treads and risers. The house was already built and they just made a few changes, for example the stairs. The ordinance states the riser maximum must be 7 3/4 inches and the tread is 9 1/2 inches with a 1 inch nosing. As a matter of fact, they are very pleased. He apologized for not building it according to codes. He stated he wasn't aware of the codes. Ackley -Perkins asked what two rooms this ran between. Wood stated it didn't go between two room but was used as a balcony or a library. Wood also stated the stairs were walkable. He again stated his concern was insurance. Cress asked about the square footage of the house and also how many bedrooms the house had. • • • Kisor stated it had 2270 square foot and had 3 bedrooms. Durham stated this is not a fire hazard. He said there are other residences and commercials with same problem. If we turn down this variance we would have to start having the other people change their buildings. Ackley -Perkins moved to grant the variance. Cress seconded. Wood asked Ackley -Perkins if she moved to grant the varince on the understanding this room will not be used as a bedroom. Ackley -Perkins amended her motion. Ackley -Perkins made a motion to grant the variance. Cress seconded. Vote was unanimous to grant the variance. The second variance was submitted by Joe Chamberlin of Hardees Foods Systems, Inc. to build two Hardees restaurants in the fire zone classi- fication with wood frame instead of steel. Albright asked for comments from Chamberlin. Chamberlin stated he wished to build a Hardees store in the standard wood frame with brick veneer rather than masonry and steel. The cost would be much less if he uses wood. Wood stated the fire zone runs on Highway 71 North, Highway 71 South, and Highway 62 West to the city limits 150 feet either side of highway. He also stated the present codes require fire walls and parapet walls when joined together. Albright said that building has suffient land around it for set -backs. Cress asked if they had bought the land or were leasing it. Chamberlin stated they had a 20 year lease with continuing options on the property but the restaurant will be owned and operated by Hardees. Cress asked if they didn't get their lease what would happen if someone built a building next to it. Chamberlin stated he didn't know what the lease said about building on it if they didn't renew the lease. • Wood stated by Arkansas State Law you are required to have a 15 foot fire lane around the building or get a waiver from the fire chief. • • • Durham stated he sees no reason why they shouldn't get the variance. Parker made a move to grant the variance. Ackley -Perkins seconded it. Vote was unanimous to grant the variance. The meeting adjourned at 4:25.
