HomeMy WebLinkAbout1984-01-06 - Minutes• MICR OFILMEI), MINUTES OF THE MEETING OF BOARD OF CONSTRUCTION APPEALS January 6, 1984 A meeting of the Board of Construction Appeals was held on January 6, 1984 at the Central Fire Station, located at 303 W. Center, Fay- etteville, Arkansas. Members present: Neal Albright„ Dale Cress, Tommi Ackley, Paul Parker, J. Palmer Boggs. Others present: Keith Newhouse,' Tom Tucker --City Inspector, Bert Rakes --City Inspector, Beverly Erwin --Inspection Clerk. The meeting was called to order by Chairman Neal Albright at 4:05 p.m. The variance to be reviewed was romex wiring instead of conduit orical Society building located submitted by Keith Newhouse to use to rewire the Washington County Hist - at 30 S. College. Albright asked for comments from Newhouse. Newhouse stated he is planning on rewiring the complete building. He also stated the expense would be larger with conduit than romex. He feels that the building is residential rather than commercial, there- fore it would be permissible to use romex. Tucker stated that he feels the building is commercial and is also in the one (1) fire zone. He also stated they charge revenue to get into the building. He said that any existing wire could be left and any wire that was added should be conduit. Ackley asked how much of building would be rewired. Newhouse stated that he hoped and had planned on all of it to be rewired. He stated that there are people there all of the time, but normally just a few at one time. Newhouse stated that they don't charge admission. Tom stated he had been through it twice and they charged both times. Newhouse stated he stood to be corrected. Rakes asked how they would conceal it. Newhouse said it would be concealed in the walls. 2 • • Newhouse said the only time there would be lots of people in the building was the annual Ice Cream Social and when it is open to the public. Tom again stated he felt when you pay to get in a building , it is com- mercial. i • Ackley asked about added expense using conduit. Newhouse stated he wasn't exactly sure but it would cost more. Cress, an electrician, stated the cost would run quite a bit more. It wouldprobably cost ten (10) percent more. There would be no more cost structurally. Boggs asked if the building wasn't commercial, then they could use romex. Tucker stated yes. Newhouse stated that he gets two (2) students to live there and_take care of the building. Ackley stated these two (2) students wouldn't use as much electricity as a commercial. She stated that there probably would be commercial usage during the Ice Cream Social and during the months it is open to the public. The rest of the time the usage would be low. Rakes asked Ackleywhat she was referring to when she said commercial. Ackley stated lights and office machines like you would find in a com- mercial. Albright asked about daily traffic in the building. Newhouse stated it wasn't open all of the time, only six (6) or seven (7) months out of the year. He stated the traffic would just depend from day to day. Parker stated that they need to decide if they have enough usage for commercial. Tucker stated the building is in the one (1) fire zone. Cress feel theyhave to consider it commercial and not residential. He also stated that what bothers him about using romex is elderly people will be visiting the building. Tucker stated that in Little Rock and Hot Springs, any wiring that is in the building can be left as is and any additional wiring must be conduit. He also stated the code read an assembly of fifty (50) or more people, the building must be in conduit. At the Ice Cream Social, there are sometimes as many as one hundred fifty (150) people present. Tucker stated he wasn't there t6 tell•.them'what to decide, but to protect the public. Cress asked if they will be changing the service. Tucker stated yes. • • • 3 Boggs moved that the variance be. granted. The motion died for lack of second. Ackley moved that the variance be denied. Cress seconed the motion. Albright asked for discussion. The motion carried with the vote: four (4) in favor and one (1) oppose. Section 111.5 of the Building Code provides that the Board shall meet within ten (10) days after Notice of Appeal has been re- ceived. Section 112.1 of the Building Code provides that Notice of Appeal shall be filed within ninety (90) days after the de- cision is rendered by the building official.
