MINUTES OF THE MEETING
OF BUILDING BOARD OF CONSTRUCTION APPEALS
NOVEMBER 3, 1983
A.meeting of the Building Board of Construction Appeals was held
at the Central Fire Station at 303 West Center, Fayetteville, Arkansas
on November 3, 1983, at 4:10 p.m.
Members present: Dale Cress, J. Palmer Boggs, and Tommi Ackley.
Others present: John Marinoni, Jim Wilson, Larry Poage--Fire Inspector
Freeman Wood --Inspection Superintendent.
The meeting was called to order by acting Chairman J. Palmer Boggs.
The variance to be reviewed was submitted by John Marinoni, for Brennan -
Boyd Construction Co., Inc, to allow the construction of an enclosed
walkway at the 2nd floor level between the Mcllroy Bank and the
building to the west which is now occupied by John Cole's Clothing
Store. The proposed walkway would have an arched plexiglass roof and
storefront glass doors on each end. The variance concerns these two
features of the walkway.
Boggs called for questions or comments.
Discussion was held concerning the type of construction the two
buildings are and also what type of fire escapes each have.
Poage stated that there was an emergency exit that goes out on roof
from the Cole side, there are fire:stairs on the Mcllroy side.
Poage also stated that the Cole side had 3 hr fire wall protection,
and the McIlroy side had 4 hr fire wall protection.
Cress asked what the rating, would be for the glass. Poage stated
that at most the glass would have 1 hr fire protection, but it
would probably be less. Poage said code allows 40:^percent of the
wall to be glass with 1 hr fire protection.
Wood stated that the Building Code said that if the wall is over 20
feet from property line that you can have up to 40 percent glass.
Boggs asked about using 3 hr wire glass doors on the Cole side.
Poage said the maximum rating of wire glass is 2 hr.
Cress asked about these doors being proped open. Wood stated that if
used they would need self closers on them.
• Poage and Wood both stated that they would he comfortable with 2 hr
wire doors, as long as they were kept shut or a fusable link put on.
Cress moved to grant the variance as long as they used 2 hr rated
door frames with 2 hr wire glass and closers.
Ackley seconded the motion.
The vote was unanimous.With;J. Palmer Boggs, Dale Cress, and Tommi
Ackley voting.
The meeting was adjourned at 4:35 p.m.

Section 111.5 of the Building Code provides that the Board shall
meet within ten (10) days after Notice of Appeal has been re-
ceived. Section 112.1 of the Building Code provides that Notice
of Appeal shall be filed within ninety (90) days after the de-
cision is rendered by the building official.

• VARIANCE REQUESTED:
A variance is requested to allow the construction of an enclosed walk-
way at the 2nd floor level between the Mcllroy Bank and the building
to the west which is now occupied by John Cole's Clothing Store. The
proposed walkway would have an arched plexiglass roof and storefront
glass doors on each end. The variance concerns these two features of
the walkway.
REASONS FOR REQUESTING VARIANCE:
The proposed walkway as designed will compliment the existing architecture,
as well as providing access to the second floor of the adjacent building
which is needed for files and bookkeeping. Any other design would detract
from the outside appearance in this area of the square. A three hour
fire wall and door on the east end of the walkway would cut off all nat-
ural light in Mcllroy's 2nd floor elevator lobby and would greatly de-
crease the attractiveness of this area from the inside. The 2nd floor
elevator lobby now is all glass on the west side where the walkway would
start. A three hour fire wall and door on the west end would also cut off
the natural light and would not be as attractive as a glass door. Both
doors were to remain closed to prevent heat or air conditioning from
migrating from one building to the other. Fire doors held open with
fusible links would let light thru but the object of keeping the utilities
separate would be defeated.
INTERPRETATION OF BUILDING OFFICIAL APPEALED FROM:
Mr. Wood's interpretation of the code is that the walkway must be cons-
tructed of noncombustible materials and that the walls on each end must
have the same rating as the buildings being connected, ie. 3 hour const-
ruction.
REASONS DECISION OF BUILDING OFFICIAL SHOULD BE MODIFIED OR REVERSED:
In order to achieve the attractiveness of a vaulted roof across the
walkway, it is necessary to use curved plexiglass. Mr. Woods has stated
that safety glass on a straight hipped roof for example would be accept-
able since it is noncombustible, but we are opposed to that because it
would not look as attractive. Asthetics are also the main reason for
the aluminum and glass walls and doors on the ends of the walkway. From
the Mcllroy side, this will enhance the openness of the existing window
wall and will visually tie the connected areas together.
This project is in keeping with the overall revitalization effort of the
downtown area that has been underway for many years. The walkway will
allow about 1200 square feet of space to be utilized that formerly was
vacant. This will mean more space for people to work downtown which
will ultimately be good for the merchants and the restaurant owners and
the area in general.
