MEMBERS PRESENT: OTHERS PRESENT: Dale Cress, J. Palmer Boggs, Tommi Ackley, and Paul Parker Freeman Wood „ Thomas Tucker, James Wilson', and Terry Gilmore The meeting was called to order at 4:30 p.m. by acting chairman, J. Palmer Boggs. He briefly explained the request of James Wilson to use pull chains in place of light switches in the mini -storage units he is .building at 1660 North College, Fayetteville, Arkansas. Freeman Wood explained the ordinance* passed in 1977 pertaining to the use of pull chains was presented to the Board of Directors with the intention of comletely doing away with the use of pull chains in any new structure. In reviewing the plans for Mr. Wilson, he had discovered the wording to.the ordinance did not do away with pull chains "all inclusive", but named areas where they could not be used. He said he felt that the wording of the ordinance could allow the use of the pull chains in the storage units, even though he felt that was not the intent of the ordinance. Wood said he felt the Construction Board of Appeals needed to make an interpretation on the ordinance. Thomas Tucker told that it was the intent of the Electrical Board that the ordinance be passed to not use pull chains in any new struc- ture . He also added thatit had been enforced that not any pull chains were allowed in new structures since 1977, when the ordinance had been passed. Wood said as the ordinance had not been challenged before, the wording of the ordinance had not been discovered until now. James Wilson stated he builds all types of buildings, residential and offices, and would never consider using pull chains in those types of buildings. He said he has built quite a few of these units in Tulsa and they°are designed kithtoll-up doors with pull chains directly iri.the center of the door, where the customer would find the pull chain with ease. He felt it would be easier to turn on the lights that way than hunting on the wall for a light switch. He indicated that his partner in Fayetteville had reviewed the build=.. ing codes for Fayetteville and they thought the pull chains would be allowed. r1 • • PAGE 2 Boggs called for comments from Dale Cress, who is an electrician. Cress stated there are several reasons he felt the pull chains should not be used. Safety and fire hazard were among the reasons. Wilson explained the additional cost of adding light switches rather than using the pull chains. He said there.will'be 518 -lights and the change to switches would run about $30 more per light. There would be 518 storage units. Boggs called for general discussion. Boggs called for a motion. Paul Parker made a motion that a variance was not required because of the wording of the ordinance. Ackley seconded the motion. Boggs called for a vote that a variance would not be needed because of wording in ordinance. The vote passed by majority with Boggs, Ackley, and Parker voting for the motion with Dale Cress opposing. Boggs asked: what the board thought of having the ordinance clarified by the City Board of Directors. Parker moved to have the ordinance clarified, stating that not any pull chains be used in any new structures "all inclusive". Ackley seconded the motion. Boggs called for a vote. The motion passed unanimously. The meeting was adjourned at 5:00 p.m. * Attached ordinance included as part of minutes. e NOTICE. That Chapter 8 of the Fayetteville Code of Or- dinances is hereby amended by adding Section 8-30.1 to read as follows: Notwithstanding any provision contained in the National Electrical Code to the contrary, the following provisions shall apply in the City of Fayetteville: (1) Any building available to the public for the holding of assemblies, conventions, or similar gatherings, including, but not limited to, hotels and motels, shall be wired with a rigid E.M.T. electrical system. E. Lights in bathrooms, kitchens, closets, open orches, and utility rooms shall be controlled by switches approved by the National Electrical Code. (3) Electrical panels shall contain breaker type disconnects: the use cf fuses as disconnects shall be prohibited. (I) Electrical current to general appliances, con- venience outlets and general lighting circuits shall be supplied by copper wiring having a minimum size of not less than $12-2/wg wire. (5) The minimum size for aluminum wire shall be not less than 02. Section 2. That all ordinances or parts thereof in conflict herewith are hereby repealed.
