HomeMy WebLinkAbout1983-01-28 - Minutes• MICROFILMED A MINUTES OF THE MEETING OF BUILDING BOARD OF ADJUSTMENTS AND APPEALS January 28, 1983 A meeting of the Building Board of Adjustments and Appeals was held at the Central Fire Station at 303 West Center, Fayetteville, Arkansas, on January 28, 1983, at 4:05 p.m. Members present: Dale Cress, Tommi Ackley, J. Palmer Boggs, Robert Ellis, Neal Albright Others present: Harry Vandergriff and Freeman Wood Meeting was called to order by Chairman J. Palmer Boggs. Boggs explained the request for a variance was submitted by Harry Vandergriff of 940 Sunset, Fayetteville, Arkansas, who is requesting a variance from a 36" railing height as required, to a height of 32". This is for a gazebo behind Mr. Vander- griff's home. Boggs then asked for comments from Freeman Wood, Building Superintendent. Wood explained that the Building Code originally called for a railing height of 42" and was ammended to 36". Vandergriff told the Board that he had been told the required height would have to be 36" high and have 6" spacing between spokes, but somehow in the building of the gazebo he forgot that there was a required height for the railing. He explained that it was not deliberate. Boggs asked the area around the gazebo. Vandergriff said it was 96' around with 8 sides. Wood stated that he appreciated that Mr. Vandergriff admitted he had been told and that he had made a mistake. Discussion then followed about the construction of the railing. Albright seconded the motion. Boggs asked for any discussion. During the discussion by the Board members, Wood suggested that they might want to add the stipulation that if ever the house sold that the railing be raised to 36". • Boggs asked if the motion needed to be amended? Albright thought it needed the stipulation. Discussion was then held on the probability of this building being converted to a residence. It does have water to it --no sewer. The gazebo is located downhill from the sewer line. It is heated. Ellis moved to amend the variance approval to include state- ment that should this building be converted to a residence the railing be raised to 36". Albright seconded the motion. Boggs called for discussion. After the discussion Ellis re -worded the motion to grant the variance with the stipulation that should the building be changed to a residence then the railing be changed to meet any current code requirements. The amendment was seconded by Albright. The vote was unanimousin favor df the variance. Meeting was adjourned at 4:25.
