MINUTES OF THE MEETING
OF BUILDING BOARD OF ADJUSTMENTS AND APPEALS
January 5, 1983
A meeting of the Building Board of Adjustments and Appeals
was held at the Central Fire Station at 303 West Center,
Fayetteville, Arkansas, on January 5, 1983, at 4:30 p.m.
Members present: Dale Cress, J. Palmer Boggs, Neal Albright,
and Tommi Ackley.
Others present: B. W. Graue, Dr. Grady Glen Fincher, Free-
man Wood --Inspection Superintendent, Tom Tucker --Electri-
cal Inspector, Larry Poage--Fire Inspector.
Meeting was called to order by Chairman. Neal. Albright.
The first variance to be reviewed was submitted by B. W. Graue,
to use romex wiring instead of metal tubing, because of cost
involved and because location is in the fire zone. The variance
is for a proposed apartmentbuilding to be located at 314 West
Rock Street, Fayetteville, Arkansas. The city ordinance requires
metal tubing (conduit) to be used in the fire zone.
Albright called for questions or comments.
Discussion was held concerning location of the building.
Mr. Graue said there would be open space completely around
the building and there would be a four-hourl wall separat
ing the apartments clear to the roof line.
Tucker stated that if properly installed he could not see
any problems with using romex wiring.
Cress commented on the differences in wiring requirements for
commercial and residential buildings in regards to how many
people would be occupying agiven.space.
Larry Poage said he felt there would hot be any problens with
using romex wiring.
(1) Mr. Graue mistakenly quoted a four-hour wall, but, meant
a two-hour wall.

Wood reminded the Board that, this building had been before the
Board at the last meeting and the wall closest to any other
structure would be of block construction and Mr. Graue would
have to use conduit in the block wall.
Boggs asked the difference in cost to use conduit rather than
romex.
Both Graue and Tucker felt the cost would be double.
Cress stated he thought the Board should approve the variance
as the Electrical and Fire Inspectors both felt there would not
be any problem involved with using romex.
Tucker said he had contacted three insurance companies to see
if using the conduit wiring rather than romex in the fire zone
would lower the insurance rates. They said no.
Cress moved to grant the variance.
Boggs seconded the motion.
Albright asked for discussion then called for the vote.
The vote was unanimous in favor of granting the variance.
The second request for a variance was submitted by Dr. Grady
Glen Fincher for property he ownes at 2140 Green Acres Road,
Fayetteville, Arkansas. The reason for the variance is to
recognize Neal Albright's readings as an accurate elevation
rather.than what. the.1001Year,Fiood Plain Map:indicates.
- Albright, who was representing -Dr. Fincher, noted a correction
should be made on the Variance Application. Under the heading
:'Interpretation of Building Official Appealed From:", the 100
Year Flood Elevation according to the Flood Plain Map should
read 1,287, rather than 1,282; as.shown...

Boggs asked what type of building did Dr. Fincher plan to build
at this location.

Wood explained .that any type of building would require a variance
to build at this location.
Albright's presention included, maps, crossections, maps super-
inposed with the flooding that occurred on June 15, 1982, and
pictures taken of the property during the flooding on June 15,
1982, by Dr. Fincher.
Albright -stated'he:-used-'at-landmark:recognized by Corps of
Engineers as a beginning point. On.partstiof the property the
readings were almost identical, but varied as much as seven 74
feet at one point from the 100 Year Flood Plain Map.
Boggs questioned the possibility of getting insurance in the
flbod plain area.
Wood replied that insurance could be bought, but felt sure
they would have to pay the Flood Plain premium because the
insurance companies would go by the Flood Plain Maps.
Wood then read Article IV, Section 2933.2, Variance Procedures,
and Article 2941.1, Specific Standards for Construction of the
Flood Plain Building and Development Regulations for Fayette-
ville, Washington County, Arkansas. (See attached copies.)
Albright then passed around 'the pictures taken by Dr. Fincher
of his property during the June 15, 1982 flooding.
Cress asked if Wood had any question about the variance.
Wood explained that as Neal Albright is a Registered Engineer,
and with the information Mr. Albright had presented, it does
show the Flood Plain Map in error, but felt that if the Board
approved the variance, (taking Mr. Albright's readings of land
elevation rather than. the Flood Plain Map's) that the motion
contain a stipulation that whatever was built there would not
raise the flood level more than one foot on the adjoining pro_•
perty2 and that the finished floor elevations be a minimum
2 feet above the 100 Year Flood Elevation established by Neal
Albright.
Cress made a motionto grant the variance, recognizing the
1,280.00, 1,278.50, and 1,277.00 elevations established by
Neal A1•bright,-Registered Engineer, as the -100 Year Flood Plain
Elevations, (instead of 1,287.00, 1,282.00, and 1,278.00 as
shown on the Flood Plain Map), for the property at 2140 Green
Acres Road, with the stipulations that engineer data be submitted
upon application for Building Permit stating that any structure
erected on said land wou1ci not increase the base flood eleva-
tion at the proposed site4 more.thannone-foot and that finished
floor elevations be a minimum of.two feet above the 100 Year Flood
Plain Elevation established by Neal Albright.
Ackley seconded the motion.
The vote was unanimous with J. Palmer Boggs, Dale Cress, and
Tommi Ackley voting.
Meeting was adjourned at 5:25 p.m.
(2) The City of Fayetteville's ordinance states the flood level
at the site could not be raised more than one foot. At the
Board Meeting it was stated as not raising the flood level
more than one foot on the adjoining properties.
