HomeMy WebLinkAbout2007-03-02 MinutesMINUTES OF A MEETING OF THE CIVIL SERVICE COMMISSION March 2, 2007 A meeting of the Civil Service Commission was held on March 2, 2007 at 11 am Present:• Commissioners Coppinger, Bittle, Ledford, Hart, Brown and Adelman Absent: Commissioner Augustine Commissioner Coppinger called the meeting to order and stated the purpose of the meeting was to review a request for a hearing from firefighter Fred Lawley. This request was dated 2-26-07. The agenda involved setting a date for the hearing. Bobby Odom, attorney for Fred Lawley, stated that he requested that the commission set a hearing within 15 days of the complaint but the date of the hearing could be further away than 15 days if the Commission desired. Odom stated that he anticipated the hearing taking less than 1 day. Coppinger stated that based upon a review of the rule infractions listed he was concerned that more than one day might be necessary. Coppinger asked Odom if in his opinion the hearing would take more than one day. Odom stated he wasn't certain and it would depend upon what was discovered. Coppinger asked Chief Johnson who would be representing him during the hearing. Chief Johnson stated that depending upon the date of the hearing, he has selected Woody Bassett. Odom requested that the hearing begin in the morning so that a full day could be set aside. Commissioner Adelman stated that the date needed to be a Monday or a Friday and could not be during Spring Break week to meet with his availability. Coppinger suggested the 28th or 30th of March or April 4th Commissioner Brown was unavailable on the 28th but all other commission members were available that day. All commission members present were available on March 30 with a start time of 8:30am. Missy Leflar, HR Division Manager, excused herself to contact Woody Bassett regarding his availability on the 30th of March. Commissioner Brown stated that his son in law was a fireman and worked for Lawley for a period of time. If anyone had any objections to him participating in the hearing, they should let him know and he would withdraw. Odom stated that he would discuss this with his client and notify Kit Williams of their decision. Commissioner Adelman stated that it would be helpful to have as much documentation in advance from either side to proceed efficiently. The preference would be at least one week in advance. Commissioner Hart requested a copy of the personnel file as well as the investigation files. Commissioner Coppinger stated that he wanted to be certain that all parties are aware of the rules that provide that the Commission can choose to vacate the disciplinary action or uphold that action. Odom stated that they would stipulate to that. Regarding other business, Sherrie Langehennig, Human Resources, stated that the date of the entry level fire test was changed to April 23 and requested the availability of the Commissioners on April 27 to conduct interviews. Coppinger, Adelman, Hart, Ferguson and Brown will be available on that date. Missy Leflar returned stating that Woody Bassett would be available on the 30th at 8:30am. Coppinger made a motion to set the hearing date for March 30, 2007 at 8:30am in Room 219. Adelman seconded and the motion carried. Commissioner Adelman made a motion to adjourn. Bittle seconded and the motion carried. Meeting adjourned at 11:20am.
