OF THE CIVIL SERVICE COMMISSION
January 6, 2004
A meeting of the Civil Service Commission was held on January 6, 2004 at 9:00 AM
in the Room 111 of the Fayetteville Administration Building.
PRESENT: Commissioners Bittle, Coppinger, Middleton, Tune, Ledford, Adelman
ABSENT: Commissioner Augustine
The Commission met to consider the following items and conduct Fire Captain oral
interviews.
1. Consider a waiver request from Officer Robert Hargus to take the Sergeant's
exam.
2. Set a date for a grievance hearing for Officer Creston Mackey.
The following motion was made by Commissioner Adelman and seconded by
Commissioner Tune to address Officer Hargus' request.
It is the determination of this Commission that no waiver is
necessary or appropriate. It was not the Commission's intent when
it amended its regulations on April 8, 2003 to exclude from eligibility
for a promotional examination any police officer or fire fighter who
was determined as of that date to be eligible to take that
examination and who has remained in continuous service with the
City of Fayetteville since that time.
Commissioners voted unanimously to approve the resolution.
The Commissioners discussed setting a date for the grievance hearing for Creston
Mackey. Commissioner Ledford made a motion to hold the hearing on February 17,
2004 at 9:00am. Commissioner Coppinger seconded this motion. The motion was
unanimously approved. The hearing will be held in Room 219. The Commission will
meet at 8:30 am just prior to the hearing to be briefed by City Attorney Kit Williams as
to protocol for the hearing.
Chairman Bittle requested Kit Williams to provide to the Commission with additional
information regarding the powers of the Commission with respect to modifying
disciplinary action taken by the Chief.
The Commission conducted the interviews for Fire Captain and certified an eligibility
list.
